Abstract:Most scholars, politicians, and activists are following individualistic theories of privacy and data protection. In contrast, some of the pioneers of the data protection legislation in Germany like Adalbert Podlech, Paul J. Müller, and Ulrich Dammann used a systems theory approach. Following Niklas Luhmann, the aim of data protection is (1) maintaining the functional differentiation of society against the threats posed by the possibilities of modern information processing, and (2) countering undue information power by organized social players. It could be, therefore, no surprise that the first data protection law in the German state of Hesse contained rules to protect the individual as well as the balance of power between the legislative and the executive body of the state. Social networks like Facebook or Google+ do not only endanger their users by exposing them to other users or the public. They constitute, first and foremost, a threat to society as a whole by collecting information about individuals, groups, and organizations from different social systems and combining them in a centralized data bank. They transgress the boundaries between social systems that act as a shield against total visibility and transparency of the individual and protect the freedom and the autonomy of the people. Without enforcing structural limitations on the organizational use of collected data by the social network itself or the company behind it, social networks pose the worst totalitarian peril for western societies since the fall of the Soviet Union.

Abstract:The Freedom of Information Act is a statute of great constitutional significance. The Act heralded a right to publicly held information which government had attempted to keep private. FOIA laws have their origins in the pre-digital age and any discussion of information rights must take on board the contemporary reality of the global digitization of communications via social media networks and the enhanced capabilities of state intelligence agencies to conduct surveillance over electronic communications. The General Data Protection Regulation seeks to give greater security to personal data. However, private information is harvested by private tech companies which they have obtained often ‘voluntarily’ and used by intermediaries to influence public events, public power and elections—as illustrated by recent scandals involving the practice of ‘data farming’ by social media networks and the sale of personal data to political campaign consultants seeking to pinpoint electors and thereby affect the outcomes of national elections and referenda. Government surveillance is age-old, but the emergence of digital power has enabled public authority to invade our private lives far more intrusively and effectively. The most recent example is the Investigatory Powers Act 2016. All this poses substantial challenges for the public regulation of information access in a growing confusion of public and private in the constitution. Courts, meanwhile, have to balance demands for privacy protection, open justice and secrecy.

Abstract:Theory, Culture &Society, Volume 39, Issue 4, Page 145-171, July 2022. This article contains reflections on the further structural transformation of the public sphere, building on the author's widely-discussed social-historical study, The Structural Transformation of the Public Sphere, which originally appeared in German in 1962 (English translation 1989). The first three sections contain preliminary theoretical reflections on the relationship between normative and empirical theory, the deliberative understanding of democracy, and the demanding preconditions of the stability of democratic societies under conditions of capitalism. The fourth section turns to the implications of digitalisation for the account of the role of the media in the public sphere developed in the original work, specifically to how it is leading to the expansion and fragmentation of the public sphere and is turning all participants into potential authors. The following section presents empirical data from German studies which shows that the rapid expansion of digital media is leading to a marked diminution of the role of the classical print media. The article concludes with observations on the threats that these developments pose for the traditional role of the public sphere in discursive opinion and will formation in democracies.

Abstract:Digital communication now pervades all spheres of life, creating new possibilities for commodification: personal data and communication are the new resources of surplus value. This in turn brings about a totally new category of threats to privacy. With recourse to the culture industry critique of early critical theory, this article seeks to challenge basic theoretical assumptions held within a liberal account of privacy. It draws the attention to the entanglement of technical and socio-economic transformations and aims at elaborating an alternative framing which takes into account that privacy is not in the first place a pre-political space for individual freedom but a constituted sphere in which social power relations are reproduced in a particularly deceitful way. With recourse to positions of critical theory, this article revisits the conceptual ambiguity of liberation and oppression and looks to draft prospects for a socio-theoretical justification and critique of privacy, updated for the digital age. Following the tradition of critical theory, the argument focuses on (new) forms of domination in and by privacy. It aims to prepare the ground for a critique of the social’s increasing commodification as well as an idea of privacy understood as reflexive participation in social practices.
Protecting human health and security in digital Europe: how to deal with the "privacy paradox"?

Abstract:This article is the result of an international research between law and ethics scholars from Universities in France and Switzerland, who have been closely collaborating with technical experts on the design and use of information and communication technologies in the fields of human health and security. The interdisciplinary approach is a unique feature and guarantees important new insights in the social, ethical and legal implications of these technologies for the individual and society as a whole. Its aim is to shed light on the tension between secrecy and transparency in the digital era. A special focus is put from the perspectives of psychology, medical ethics and European law on the contradiction between individuals' motivations for consented processing of personal data and their fears about unknown disclosure, transferal and sharing of personal data via information and communication technologies (named the "privacy paradox"). Potential benefits and harms for the individual and society resulting from the use of computers, mobile phones, the Internet and social media are being discussed. Furthermore, the authors point out the ethical and legal limitations inherent to the processing of personal data in a democratic society governed by the rule of law. Finally, they seek to demonstrate that the impact of information and communication technology use on the individuals' well-being, the latter being closely correlated with a high level of fundamental rights protection in Europe, is a promising feature of the socalled "e-democracy" as a new way to collectively attribute meaning to large-scale online actions, motivations and ideas.
A Critical Take on Privacy in a Datafied Society

Abstract:Privacy is an increasingly feeble constituent of the present datafied world and apparently the reason for that is clear: powerful actors worked to invade everyone's privacy for commercial and surveillance purposes. The existence of those actors and their agendas is undeniable, but the explanation is overly simplistic and contributed to create a narrative that tends to preserve the status quo. In this essay, I analyze several facets of the lack of online privacy and idiosyncrasies exhibited by privacy advocates, together with characteristics of the industry mostly responsible for the datafication process and why its asserted high effectiveness should be openly inquired. Then I discuss of possible effects of datafication on human behavior, the prevalent market-oriented assumption at the base of online privacy, and some emerging adaptation strategies. In the last part, the regulatory approach to online privacy is considered. The EU's GDPR is praised as the reference case of modern privacy regulations, but the same success hinders critical aspects that also emerged, from the quirks of the institutional decision process, to the flaws of the informed consent principle. A glimpse on the likely problematic future is provided with a discussion on privacy related aspects of EU, UK, and China's proposed generative AI policies.

Abstract:Conceptions of privacy differ by culture. In the Internet age, digital tools continuously challenge the way users, technologists, and governments define, value, and protect privacy. National and supranational entities attempt to regulate privacy and protect data managed online. The European Union passed the General Data Protection Regulation (GDPR), which took effect on 25 May 2018. The research presented here draws on two years of media reporting on GDPR from French, German, UK, and US sources. We use the unsupervised machine learning method of topic modelling to compare the thematic structure of the news articles across time and geographic regions. Our work emphasises the relevance of regional differences regarding valuations of privacy and potential obstacles to the implementation of unilateral data protection regulation such as GDPR. We find that the topics and trends over time in GDPR media coverage of the four countries reflect the differences found across their traditional privacy cultures.

What was privacy?

Abstract:Why is that question in the past tense? Because individuals can no longer feel confident that the details of their lives--from identifying numbers to cultural preferences--will be treated with discretion rather than exploited. Even as Facebook users happily share the names of their favorite books, movies, songs, and brands, they often regard marketers' use of that information as an invasion of privacy. In this wide-ranging essay, McCreary, a senior editor at HBR, examines numerous facets of the privacy issue, from Google searches, public shaming on the internet, and cell phone etiquette to passenger screening devices, public surveillance cameras, and corporate chief privacy officers. He notes that IBM has been a leader on privacy; its policy forswearing the use of employees' genetic information in hiring and benefits decisions predated the federal Genetic Information Nondiscrimination Act by three years. Now IBM is involved in an open-source project known as Higgins to provide users with transportable, potentially anonymous online presences. Craigslist, whose CEO calls it "as close to 100% user driven as you can get," has taken an extremely conservative position on privacy--perhaps easier for a company with a declared lack of interest in maximizing revenue. But TJX and other corporate victims of security breaches have discovered that retaining consumers' transaction information can be both costly and risky. Companies that underestimate the importance of privacy to their customers or fail to protect it may eventually face harsh regulation, reputational damage, or both. The best thing they can do, says the author, is negotiate directly with those customers over where to draw the line.

Abstract:Private intrusion, interception, and surveillance (PIIS) markets represent a key vehicle for the global expansion of digital surveillance regimes. Yet, due to their opacity and notorious secrecy, these markets have received relatively little scholarly attention. Triangulating between a unique dataset comprising 5973 industry presentations, interviews, and industry reports, this article provides novel insights into the evolution of market structures and public control efforts. Conceptualizing the PIIS-market as a dynamic and fluid assemblage, we highlight how the enmeshment of social, political, and technological dimensions shaped hierarchies and agencies of control. Our findings point towards the existence of three intersecting dynamics of territorialization, changing technological affordances, and ordering that persistently undermined attempts to limit market operations. In reflecting on these past failures, the presented approach points towards the importance of timing and highlights a need to re-conceptualize control in state-market relations from an assemblage perspective, pragmatically working across bureaucratic boundaries and leveraging disparate power centers across the public and private divide. Considering the growing interest in economic dependencies and the strategic dimension of high-tech markets, these findings have a wider relevance to current debates about the rise of economic security states.

Beyond Privacy: Articulating the Broader Harms of Pervasive Mass Surveillance

Abstract:This article begins by recounting a series of mass surveillance practices conducted by members of the “Five Eyes” spying alliance. While boundary- and intersubjectivity-based theories of privacy register some of the harms linked to such practices I demonstrate how neither are holistically capable of registering these harms. Given these theories’ deficiencies I argue that critiques of signals intelligence surveillance practices can be better grounded on why the practices intrude on basic communicative rights, including those related to privacy. The crux of the argument is that pervasive mass surveillance erodes essential boundaries between public and private spheres by compromising populations’ abilities to freely communicate with one another and, in the process, erodes the integrity of democratic processes and institutions. Such erosions are captured as privacy violations but, ultimately, are more destructive to the fabric of society than are registered by theories of privacy alone. After demonstrating the value of adopting a communicative rights approach to critique signals intelligence surveillance I conclude by arguing that this approach also lets us clarify the international normative implications of such surveillance, that it provides a novel way of conceptualizing legal harm linked to the surveillance, and that it showcases the overall value of focusing on the implications of interfering with communications first, and as such interferences constituting privacy violations second. Ultimately, by adopting this Habermasian inspired mode of analysis we can develop more holistic ways of conceptualizing harms associated with signals intelligence practices than are provided by either boundary- or intersubjective-based theories of privacy.

Abstract:Researchers find weaknesses in current strategies for protecting privacy in large datasets. Many anonymized datasets are reidentifiable, and norms for offering data subjects notice and consent over emphasize individual responsibility. Based on fieldwork with data managers in the City of Seattle, I identify ways that these conventional approaches break down in practice. Drawing on work from theorists in sociocultural anthropology, I propose that a Human Centered Data Science move beyond concepts like dataset identifiability and sensitivity toward a broader ontology of who is implicated by a dataset, and new ways of anticipating how data can be combined and used.

Abstract:It is commonplace to say that we are living in troubled times. Liberal democracy is in crisis. Academic freedom is seriously constrained. The media offers less insight and analysis than could be expected given the proliferation of communication tools. Based on decades of research into the social and ideological functioning of discourse and with a focus on politics, universities, and the media, Jef Verschueren offers an analysis of current practices, asks whether we are all complicit, and makes suggestions for what we can do. Central to this book is the notion of derailed reflexivity, referring to the observation that politics, institutions, and news reporting tend to be excessively aimed at public opinion, impression management, and clicks, to the detriment of policies addressing social justice issues, high-quality service, and media content. Highlighting that education is the cornerstone for democratic choices and ensures that we can critically assess media content, this book shows that shared responsibility can be a source of hope and that everyone has the power to intervene. Complicity in Discourse and Practice is a call to action for readers and a plea for actively minding the ecology of the public sphere. These few introductory pages set the stage for an exploration of the extent to which people share responsibility, in discourse and in practice, for what happens in a world shaped by political developments in liberal democracies, by bureaucratization in institutions, and by the flow of media content. Complicity is introduced as the key notion.

Abstract:Privacy law is at a crossroads. In the last two years, U.S. policymakers have introduced more than 50 proposals for comprehensive privacy legislation, most of which look roughly the same: they all combine a series of individual rights with internal compliance. The conventional wisdom in privacy scholarship explains this uniformity by looking to catalyzing precedent: the General Data Protection Regulation in Europe or the California Consumer Privacy Act. This article challenges that emerging consensus. Relying on contemporary sociological and critical studies scholarship, this article develops the concept of the social practice of privacy law and argues that recent privacy proposals in the U.S. look similar because the practices of privacy law are performative: they have socially constructed what we think privacy law is and should be. In other words, we have not only become accustomed to conceptualizing privacy law in a certain ways; we have come to see the rights-compliance model as the normal, ordinary, common sense modality of privacy law. So constructed, privacy law is flawed, with substantial negative effects for privacy, equality, and justice. Individual rights are misplaced weapons against the population-level harms of data-extractive capitalism. They also allow industry to weaponize our rights against us. Privacy law-as-compliance is even more troubling. It is internally inconsistent, protects the interests of the most powerful industry players, and elides informational capitalism’s substantive injustices. This article provides a full critical account of the latest developments in privacy law, focusing on its practices rather than law on the books alone. It details and challenges current privacy law’s focus on individual rights and internal compliance. And it explores potential new directions for privacy law based on the developing law and political economy literature, including new practices and performances that center privacy law around principles of power, equality, and democracy.

Abstract:On 25 January 2012, the European Commission presented its long awaited new “Data protection package”. With this proposal for a drastic revision of the data protection framework in Europe, it is fair to say that we are witnessing a rebirth of European data protection, and perhaps, its passage from an impulsive youth to a more mature state. Technology advances rapidly and mobile devices are significantly changing the landscape. Increasingly, we carry powerful, connected, devices, whose location and activities can be monitored by various stakeholders. Very powerful social network sites emerged in the first half of last decade, processing personal data of many millions of users. Updating the regulatory framework was imminent and the presentation of the new package will initiate a period of intense debate in which the proposals will be thoroughly commented upon and criticized, and numerous amendments will undoubtedly be proposed. This volume brings together some 19 chapters offering conceptual analyses, highlighting issues, proposing solutions, and discussing practices regarding privacy and data protection. In the first part of the book, conceptual analyses of concepts such as privacy and anonymity are provided. The second section focuses on the contrasted positions of digital natives and ageing users in the information society. The third section provides four chapters on privacy by design, including discussions on roadmapping and concrete techniques. The fourth section is devoted to surveillance and profiling, with illustrations from the domain of smart metering, self-surveillance and the benefits and risks of profiling. The book concludes with case studies pertaining to communicating privacy in organisations, the fate of a data protection supervisor in one of the EU member states and data protection in social network sites and online media.

Can we protect our secrets against those who wield superior technological powers? Can we trust those who provide us with tools for protection? Can we even trust ourselves, our own freedom of choice? Recent developments in quantum cryptography show that some of these questions can be addressed and discussed in precise and operational terms, suggesting that privacy is indeed possible under surprisingly weak assumptions.

Abstract:The rearmament of West Germany was an important goal of U.S. foreign policy during the early 1950s. However, this was a contested issue among the German population. In this context, former professional soldiers played a crucial role. U.S. intelligence agencies initiated covert operations that were designed not only to influence this key group but also to set up clandestine personnel pools for paramilitary action. The core of this endeavor was their cooperation with former Waffen-SS general Felix Steiner and the founding of the 'Gesellschaft für Wehrkunde' (GfW), a network of ex-officers that was dedicated to defense studies. This organization quickly developed into an important propaganda tool and a military think tank. After U.S. intelligence terminated its support, the German Federal Government took over GfW and used it as a means to establishing the West German armed forces. The case of the GfW also sheds light on the problematic cooperation between former Nazi functionaries and U.S. intelligence and highlights the divergence of German and American concepts for paramilitary operations.

Abstract:The article considers the right for privacy and secrecy as an opportunity to have a life sphere hidden from the government, society and other individuals. The study is based on a holistic approach including logical, hermeneutical and comparative methods. The historical process of the origin of publicness triggered the development of legal guarantees, personal freedom, and political involvement. This was accompanied by the occurrence of the sphere of privacy where an actor is protected from state and public interventions. Whereas the public sphere is associated with openness, transparency, total accessibility, the private sphere is connoted with darkness, opacity, and closedness. The need for privacy and secrecy is determined by the human vulnerability. One of the critical components of privacy is the right of an individual for control his personal information. To protect one’s own private sphere, one puts on a social mask when speaking in public. In an intimate relationship, unlike in a public one, he voluntarily waives protection by allowing those closest to him access to personal information. The restricted private sphere is sometimes a source of apprehension and a desire to penetrate other people’s secrets, both from the totalitarian state, which seeks to suppress and unify the individual, and from curious members of society. For the purpose of retaining the social world, a person in the course of socialisation learns to respect other’s privacy, behaving discreetly and tactfully. The right for privacy and secrecy is related with freedom, dignity, and the autonomy of personality.
