Abstract:In the last decades, space activities have become more automated and digitized due to the technological development. As such, it is crucial to consider cyberspace and its risks to guarantee safety, security, and long-term sustainability of space activities, as well as to ensure that activities in outer space are carried out for the benefit of humankind. The paper assumes that both areas are global commons and numerous interactions exist between them, notably in terms of cybersecurity. Indeed, there is an increasing risk of attack against satellites, including interferences, jamming, and hacking, which reveals that the security aspects of satellite systems and data transmission cannot be overlooked, and the risk of cyberwarfare is real. Cybersecurity regulations at international, regional, and national levels to determine the potential elements applicable to space activities are examined in this paper. The paper stresses the need to bring together actors involved in the domain of cyber and in space activities with the aim to implement a structured, appropriated, and responsive regulatory framework to cyberthreats by considering the interdependence between these two areas. In this regard, it is argued that a compartmentalized approach with relation to cyber and outer space should be avoided.

Abstract:<p>The Earth's orbital space is increasingly threatened by debris. It is frequently described as a common-pool resource vulnerable to a 'tragedy of the commons' scenario. Scholars have suggested ambitious policy proposals to tackle the tragedy of space debris and assure the sustainability of the Earth's orbits. Their proposals can be classified into three categories: hierarchical regulations, economic incentives and property rights. All three categories require some form of central coordination. However, there might be an alternative approach to the problem and other potential solutions. Elinor Ostrom suggested that decentralized, polycentric systems are appropriate for governing common-pool resources. Anecdotal evidence suggests that a polycentric form of governance can encourage a more sustainable use of the Earth's orbits.</p>

Abstract:Near-Earth space is becoming increasingly privatized, with the number of satellites in low-Earth orbits predicted to grow dramatically from about 2,000 at present to over 100,000 in the next decade due to the launch of planned satellite constellations. In addition to their direct impact on astronomy, the manner and pace of 'occupying' near-Earth space raises the risk of repeating the mistakes of colonization on a cosmic scale. We must consider the impact of satellite constellations, and related future initiatives, on the essential human right to dark skies and on cultural sky traditions across all peoples. We must also include all stakeholders for near-Earth space in the process of developing new policies for space treaties and planetary protection, the consequences of which will reach far beyond this century. We advocate for a radical shift in the policy framework of international regulatory bodies towards the view of space as an ancestral global commons that contains the heritage and future of humanity's scientific and cultural practices.

Commodity and the commons: accumulations of capital on the space frontier

Abstract:Designated as one of the global commons, outer space steadily matures as a commodity frontier at which to propel the designs and imaginaries of capitalist economy. While plans to mine the Moon, massify space tourism and colonise Mars are still works in development, the routes of its conquest expand exponentially down here on Earth, as its spectacular proceedings are mediated into a range of images, events, artefacts, samples, and experiences that disperse across the productive and reproductive ambits of terrestrial cultures. These spin-off commodities herald the evolution of the high-tech structures of power that seek to seize control over shared natural and social resources and temper the ways in which the species assembles around the commons of space. I attend to the endeavour to incorporate space into the capitalist world-system by exploring the cultural logics that precede and underpin its expansions along its 'final frontier'. Highlighting the role of commodity in more-than planetary accumulations of capital, I suggest that its proliferation is not merely an outcome of nascent forms of technological imperialisms as they set out to claim their cosmic share, but a vital resource from which to thrust their appetites for production, consumption, and destruction out there.

Constraints on Interstellar Sovereignty

Abstract:Human space exploration and settlement of other planets is becoming increasingly technologically feasible, while mission concepts for remote and crewed missions to nearby star systems continue to be developed. But the long-term success of space settlement also requires extensions and advances in models of governance. This paper provides a synthesis of the physical factors that will constrain the application of sovereignty in space as well as legal precedent on Earth that likely applies to any crewed or uncrewed missions to other stellar systems. The Outer Space Treaty limits the territorial expansion of states into space, but the requirements for oversight of nongovernmental agencies and retention of property ownership enable the extension of state jurisdiction into space. Pragmatic constraints from historical precedent on Earth suggest that new space treaties will be unlikely to succeed and new global space agencies may have limited jurisdiction over states, while hard constraints of the space environment require adherence to technical capabilities, political feasibility, and long-term sustainability. These factors form a three-prong test for assessing the viability of interstellar governance models. This discussion of interstellar governance is intended to further the conversation about sovereignty in space prior to the first intentional launch of any interstellar spacecraft.

Abstract:This article addresses the current lack of a legal framework for the use of space resources found on asteroids and other celestial bodies. In a world of growing inequality and in face of the increasing commercialization of space, governance structures are needed to ensure that the benefits of the “province of all mankind” are not solely reaped by those industrialized nations that have the technological and financial capabilities. Drawing upon the practical achievements of the International Seabed Authority governing the extraction of natural resources from the seabed in areas beyond national jurisdiction, a discursive policy framework for the equitable development of the global commons of space is proposed. Acknowledging the importance of a multi-disciplinary approach, the normative structure is complemented by the insight gained from stakeholders from across sectors, in a critical effort to unite political, ethical, and commercial considerations.

Abstract:As a particular common pool resource (CPR), space has undergone tremendous changes and the current space governance has already shown its negative effects. To promote sustainable space development, this paper aims to establish a new compound and collaborative governance framework. The framework consists of four parts, including institutional arrangements, organizational system, implementation mechanism, and implementation actors. Institutional arrangements for space governance refer to the related laws and regulations, which are core part of the entire system and can be reflected throughout the organizational systems, implementation mechanism, and implementation actors. Organizational systems should contain three levels-international level, regional level, and state level. The implementation mechanism covers five procedures-information sharing, negotiation, collaboration, evaluation, and feedback. And the implementation actors mainly include relevant governments, international organizations, enterprises, experts and scholars, universities and research institutes, news media, and others. In this framework, all implementation actors are associated to formulate a "honeycomb" architecture, which means the actors should avoid the way of working separately and facilitate the implementation of multi-collaboration in space governance so that the true collaboration can be actualized.

Abstract:The shell bound by the Karman line at a height of 80 to 100km above the Earth's surface, and Geosynchronous Orbit, at 36,000km, is defined as the orbital space surrounding the Earth. It is within this region, and especially in Low Earth Orbit (LEO), where environmental issues are becoming urgent because of the rapid growth of the anthropogenic space object population, including satellite "mega-constellations". In this Perspective, we summarise the case that the orbital space around the Earth should be considered an additional ecosystem, and so subject to the same care and concerns and the same broad regulations as, for example, the oceans and the atmosphere. We rely on the orbital space environment by looking through it as well as by working within it. Hence, we should consider damage to professional astronomy, public stargazing and the cultural importance of the sky, as well as the sustainability of commercial, civic and military activity in space. Damage to the orbital space environment has problematic features in common with other types of environmental issue. First, the observed and predicted damage is incremental and complex, with many contributors. Second, whether or not space is formally and legally seen as a global commons, the growing commercial exploitation of what may appear a "free" resource is in fact externalising the true costs.

The Territorialization of the Global Commons: Evidence From Ocean Governance

Abstract:The international system of states displays an inherent drive to territorialize the global commons. But territorialization is not a continuous process—it occurs in episodes. In this article, I use one case from ocean governance, the expansion of territory into near-shore areas of the seas, to advance a twofold argument about the nature of these episodes. First, I argue that the root causes of this drive to territorialize "empty space" are located in global politics, norms, and economics. Second, a territorializing episode occurs when there are impelling economic incentives, and when great powers are unable or unwilling to oppose territorialization. However, this can lead to different outcomes: sovereign territories, functional territories, or internationalized territories. Oceanic space has seen a series of these territorializing episodes since the end of the Second World War and functional territorialization has become more prevalent over time.

Abstract:<p>The prioritization and improvement of ethics, planetary protection, and safety standards in the astrosciences is the most critical priority as our scientific and exploratory capabilities progress, both within government agencies and the private sector. These priorities lie in the belief that every single science mission—crewed or non-crewed, ground-based or not—should heed strict ethical and safety standards starting shortly after mission conception. Given the inevitability of the private sector in influencing future crewed missions both in and beyond low-Earth orbit, it is essential to the science community to agree on universal standards of safety, ethics, planetary protection, and especially antiimperialism. These issues will impact all areas of space science, and even matters related to national defense and biodefense. Delegation of power and strict communication standards not only to protect the lives of the explorers but protect the environments of wherever humanity decides to venture. Opening up the multidisciplinary approach of space exploration to international law and governance regarding planetary protection, safety, and creating comprehensive and ethical standards across all space faring institutions is needed for the future of space exploration. Agreement and enforcement by the United Nations Office of Outer Space Affairs and the cooperation of participating governments in setting guidelines will prove critical in improving standards for future science missions. Ultimately, moving international space law and domestic space policy from a reactive nature to a proactive one will ensure the future of space exploration is one that is ethical, transparent, and antiimperialist. The prioritization of safety, planetary protection, and ethical practices of space exploration and its subsets is heavily dependent on a clear, progressive, and precautionary approach to international and domestic space law and must be executed by both individuals as practice and by governments as policy, simultaneously.</p>

Abstract:Commons governance theory is central to identifying and managing conflicts arising from natural and cultural resources traps. Scholars - using game theory and economic analysis of law - have proposed alternative models, consisting of a set of mitigated scenarios, multiple players, and new equilibria in commons governance. Likewise, novel legal innovations of the commons have also been designed. Reinterpreting the commons in light of political economy, ecology, and pluralistic approaches, a critical review of existing scholarship, economic analysis of law, and case study investigations are performed. Examining an array of views - including governance of water in Ecuador, Bolivia, and Italy - a research and policy agenda is put forward to offer original interpretations and novel holistic perspectives. Germane environmental policy implications deriving from SDGs, resilient governance, and polycentric perspectives are thus extrapolated. Finally, pluralistic frameworks drafted by mitigation and adaptation are measured by improved sustainable development performance in commons, resource, and water governance.

Abstract:The freedom of access to outer space has resulted in an exponential increase of objects located in Earth’s orbits. In the coming decade, up to 100,000 satellites in large constellations could be added to Low Earth Orbit (LEO) alone. These new activities require coordination with preexisting ones and consideration of the balance between the different interests at stake. This article addresses satellite constellations’ impact on astronomy and explores solutions to ensure that the development of both are coordinated and harmful interference is minimized. The research analyses former and recent international collaboration efforts to protect astronomy. The authors examine the international legal framework, evaluating the opportunity to consider astronomical observations as space activities, even when ground-based, and present the regulatory consequences of this interpretation, proposing the provision of information to the UN of the aforementioned activities through the mechanism of Article XI Outer Space Treaty (OST) and the protection of such activities through the consultation mechanisms of Article IX OST. Through the combined use of these articles and in compliance with the rules provided for by international space law, it should be possible to protect astronomy by coordinating with legitimate satellite constellations operations. The Space Sustainability Paradox

Abstract:The recent growth of the space sector, spurred by a surge in private actors, has led to a sharp increase in our ability to address societal challenges through space data. However, this has exacerbated an already critical situation in space: the proliferation of space debris and a critical expansion of space traffic which is leading to high levels of orbital congestion. In parallel, increased levels of spacecraft production and orbital launches are also heightening the environmental footprint of the sector. This might lead to a paradoxical situation whereby the use of space to support the Sustainable Development Goals (SDGs) becomes unsustainable from the perspective of both the Earth and space environment. This situation can be described as the space sustainability paradox. This paper presents this concept for the first time and argues that existing policies and remediation actions are not a long-term sustainable solution for tackling this issue and may actually intensify the problem. This places an added importance upon addressing space sustainability in a more coherent, strategic and responsible manner, potentially based on the doughnut economic model of social and planetary boundaries. Doing so may prevent the sector from falling victim to a tragedy of the commons type of scenario and avoid negative trends from becoming the norm. As a result, this would ensure that outer space can continue to be used by future generations to address societal challenges, without priming severe and enduring damage to the Earth and space environment.

Abstract:Outer space holds a special place in the geographical imagination of techno-utopianism. At a time of climate crisis, the mining of celestial bodies, including asteroids, is cast as a possible “tech-driven” response to the need for “green transition” mineral resources in a context of rising geopolitical tensions and concerns over terrestrial extraction. Although still a long way from commercial-scale implementation, outer space mining no longer appears as far-fetched science fiction within the context of a booming “New Space” industry and privatization of celestial commons. Drawing from a growing body of research and critiques of responsible mineral sourcing, we explore some of the legal, political, ethical, and environmental dimensions of outer space mining, and compare them with land-based and deep-sea terrestrial mining. We then point to key areas for further geographical and social sciences enquiries into outer space extractive frontiers, including the uneven distribution of space mining wealth, the impacts on terrestrial mining communities in the Global South, and the reconceptualization of the mining enclave.

Abstract:Celestial bodies had always been part of the process of volatile natural phenomena. The problem of collusion and encroaching path of each other, and interference of comets and dust has been as a forming part of space debris. Things have become riskier with the humans’ entry. This has generated a genuine apprehension of damage to the adverse environment of outer space. In this connection, the UNCOPUOS has been working on the agenda of sustainable space. In 2010, the Scientific and Technical Subcommittee of the UNCOPUOS created a Working Group on the Long-Term Sustainability of Outer Space Activities to develop a consolidated set of voluntary, non-binding guidelines for the States, international organisations, and private entities to ensure sustainable space. In this connection, the present paper discusses various aspects of sustainable space including possible applicability of SDGs to outer space. The part one of the paper introduces the concept of sustainable development. It also highlights the global environmental protection regime and underneath politics. Part two of the paper canvases the role of space (technologies) in achieving the SDGs. Part three of the paper explores to answer the question “whether SDGs includes Space in it or not?” If not, how the idea of “sustainable space” can be achieved? There, the authors explain the need for sustainable space and discussion happening around. In part four, authors conclude by arguing for evolving regime for sustainable space and resist from committing the same mistake that we did to the earth environment.
China, Japan, and the Governance of Space: prospects for competition and cooperation

Abstract:Abstract China and Japan are among the world’s top space powers, with significant technical competence in both conventional and ‘newspace’ capabilities. Since the early 1990s, each country has also taken a keen interest in shaping the governance of outer space activities. But they have done so in remarkably different ways, calling into question Asian states’ supposed preferences for soft and informal institutions. Japan has led the Asia-Pacific Regional Space Agency Forum, involving both state and nonstate participants, which is guided by a set of principles. China has opted for a high-profile formal intergovernmental design, the Asia-Pacific Space Cooperation Organization, with a Convention and all the trappings of a formal organizational structure. This article assesses the activities of China and Japan in the new space race, discusses how and why the design of their space governance differs, and reflects on prospects for competition and cooperation.

Abstract:Space exploration, with its enormous distances and extreme environments, is a challenge to technology, human habitation, sustainability, and supply chains. On the flip-side, however, it can provide a new vantage point on how to improve human life and planetary prosperity. This objective requires the development of economic and sustainable supply chains and a governance framework to guarantee fundamental human needs and well-being under the limitations of distant and inhospitable environments. This review describes learnings for human habitation in space from remote communities on Earth that have developed and survived over generations. These include a long history of human survival strategies on Tristan da Cunha, Pitcairn Islands, Nauru, and Easter Island. Their supply chain management solutions and their problems can guide the implementation of logistics systems for the efficient use of resources in space, to satisfy vital needs of human survival but also to ensure social and governance in space, e.g., build-up of thriving communities, mobility, and industrial activities. This review demonstrates that there are significant gaps in recent space supply chain studies with respect to the space environment, social and governance. Analysis of established practices and concepts from remote regions on Earth can readily respond to these deficiencies and thus supplement space exploration. This review recommends extending the assessment of supply-chain assets from the near future to long-term strategic. This implies going far beyond current space supply chain reports to include aspects of social responsibility and governance, such as sustainable health systems, product quality management, and local decision-making.

Abstract:The article presents the relevant results of an analysis of the process of regulating private space activities. At the same time, the separate focus is on the development of space law and the main problems that currently exist in space law, including those related to the confrontation between public space law and private space law, for example: regulation of space traffic; determination of ownership of objects obtained as a result of space activities; mining and other aspects of commercialization of space activities. Additionally, a list of the main legal tasks in private space activities that require an early solution is identified, and the steps that have already been taken in this direction are described, namely, new variants of terminology, interpretation, and classification of objects and subjects of space activities, space law, and space legal relations as well as a new theory for determining the legal status of outer space are proposed. In the final analysis, it was concluded that it is necessary to continue research in further formation and improvement of the elements, interpretations, and structure of Space Private Law. To this end, the author proposed an option for further scientific research on the formation of the structure of Space Private Law based on the establishment and definition of the basic principles, concepts, and elements of such law. At the same time, the author identified the main goals, objectives, object, and subject of such research, and also, preliminary, determined the research methodology that is vital to obtain the most effective scientific results. According to the author, the results of the study on the formation of the structure of Space Private Law will be base for future foundations for regulating private space activities and preventing many legal conflicts.

Abstract:Deep under the waters, HMS Challenger discovered the polymetallic nodules during its scientific expeditions in the Kara Sea part of the Arctic Ocean in 1868. Whilst in the vastness of the skies above, the Clementine and Lunar Prospector indicated the existence of water ice at the lunar poles during the period of 1994 to 1999. In 2003, the SMART-1 lunar orbiter of the European Space Agency discovered the key chemical elements of the Moon. Going even further back, in 1988, NASA published a work on Helium-3 blown away by the solar wind onto the Moon, and the possibilities of harvesting it as an alternative energy source for the continuation and advancement of human race. The deep seabed and the outer space, along with their resources, are both internationally governed under the same underlying principle: the Common Heritage of Humankind. Yet, while the former has begun to take shape, the latter still has very little progress. Various factors ranging from laws to politics to economics and undeniably the advances in science and technology have hindered the development of the principle of Common Heritage of Humankind in the outer space regime. Hence, this paper is to argue on how best to reform the principle, and consequently, determining which of its elements that might be spared in order for it to eventually work in balancing the contrasting interests from diverse stake-holders: the developed and the developing countries; the sovereign and the corporations – with their respective weapons of laws or of technology.
