Abstract:China’s urban spatial growth is a combination of urban spill over and urban sprawl. From an institutional perspective, this paper analyzes the problems in land-use regulation with special reference to the city of Guangzhou. The evidence suggests that entangling land-use regulations have caused increasing spatial constraints to mega-city’s urban growth in China. All related parties compete for the construction right of collective-owned lands. As a result, not only the transaction costs of the planning and land-use regulations would increase, but also the spatial development of mega-cities would be further distorted. Then it provide some policy suggestions based on the institutional review.
Review on the History of the Equalization of Land Ownership Thought and Its Implication

Abstract:The purpose of the paper is to give some advices to land management in China by reviewing the 100 years history of the development of "equalization of land ownership" thought.Methods of documentation and comparison were employed.The 100 years history shows that the "equalization of land ownership" thought has been well developed not only in China before liberation,but also in Taiwan and Mainland China.Besides,it is becoming more and more important.The following points should be emphasized on land management:(a) to establish a more definite guidance for land management;(b) to develop and improve the "equalization of land ownership" thought,including defining the public land right,reforming the land price system and taxation policy and so on.

Abstract:Land capitalization has played a key role in the rapid urbanization of China since the 1990s. Through the leasing of land, local government has accumulated the revenue to improve the infrastructure construction and the investment environment. Nevertheless, excessively seeking for land profit has led to the weakening of the function of land as welfare. As a result, there have emerged a series of social, economic, and environmental problems such as sprawl of construction land, sharp rise of housing price, and negligence of the welfare of floating population. This paper reviews the evolution of land policies and land market since the establishment of the land use right system, examines the positive and negative effects of land urbanization, defines the stakeholders, and analyzes the operation mechanism in the land urbanization process. It concludes with a prospect on the transformation of land urbanization in the future.
Industrial Land Development in Urban Villages in China: A Property Rights Perspective

Abstract:The rapid urbanization of China during the past decades has led to the emergence and development of urban villages. Existing literature has largely focused on the lack of state regulations in the development of urban villages. This paper comprehensively identifies and investigates the institutional constraints on land development in urban villages in China based on a property rights framework and a comparative study on two representative cases in Shenzhen. The key institutional constraints on the land development in urban villages include 1) land insecurity caused by the possibility of government expropriation, 2) unequal access to credit because of unequal land rights, and 3) absence of state regulations on collective land transactions because of the lack of de jure property rights. These institutional constraints weakened the land-related investment incentives and ability of villagers, and resulted in inferior infrastructure and poorly constructed environment in urban villages.
A Critical Review on China's Urbanization from the Perspective of Development Priority Zoning Strategy

Abstract:The strategy of development priority zoning proposed in the "11th Five-Year Plan" shall provide a new impetus paradigm to the development of urbanization in China.In the field of land use planning or urban planning,whether it gives priority to development or protection,different divisions lead to different land spatial structure and different urban development pattern.On the basis of the review of China's urban policy,the paper examined the existing problems evolving from the development and construction as well as the protection in our country.On one hand,due to the rapid development of urbanization and industrialization in China,the characteristic of the period is reflected as the continuous expansion of land scale.On the other hand,land resources,as well as ecological environment protection are the policy needed to be implemented owing to the relative lack of land resource per capita from the perspective of sustainable development.Thus the contradictions between land development and protection arise in theory;and the disharmony between the general county(city) planning and land use planning appears in the real world.The proposal of development priority zoning not only provides strategic guidance to regional land use patterns as well as urban policy choices in theory but also outlines the integration platform for the general county(city) planning and land use planning in reality.

Abstract:Based on the China National Knowledge Infrastructure (CNKI) and Web of Science (WOS) databases, this article analyzes the deductive context, cooperation network, and research hotspots of land development rights (LDR) research in the Chinese and international literature by using CiteSpace software, and it also explores the implications of this research for the theory and practice of national territory spatial planning (NTSP) in China. The results show that (1) the literature on LDR in Chinese and international journal articles initially appeared in 1995 and 1973, respectively, researches in China experienced three stages: embryonic fluctuating development, rapid growth and stable development, and wave development, while international researches experienced two stages: embryonic fluctuating and a gradually increasing development. (2) Among these scholars and research institutions, there is no obvious difference between Chinese and international scholars, while the Renmin University of China and the State University System of Florida are the research institutions with the largest number of Chinese and international journal articles, respectively. (3) In terms of publishing journals, international journals mainly focus on land policy, cities, and resource fields, while Chinese journals mainly focus on the agricultural economy, civil and commercial law, economic systems, and macroeconomic management fields. (4) The direction and scale of thematic research vary greatly, with Chinese research mainly conducted from the perspectives of rights attribution and benefits distribution, while international research mainly focuses on the operation of the right-to-development system and its impact on the environment. In the future, studies focus on China's need to strengthen the research and institutional practice of LDR at the legal level, value level, and extension level following national conditions, formulate a land value-added benefit distribution system with efficiency and fairness, and strengthen the practice of LDR in China's NTSP based on the differences between urban and rural development.

Abstract:Although urban land leasing is supposedly a local government matter, local leaderships' proactive pursual of economic growth for their career advancements can sometimes be at odds with national policies. Yet, how land conveyance decisions are made in midst of the implementation of national policies and land financing has been a rather overlooked aspect in the studies of China's land market. Hence, this paper explores this issue through a study of land conveyance decisions in Beijing and Shanghai's residential and commercial land markets from 2007 to 2018, and their subsequent land price effects. Deploying endogenous treatment effect models, it is revealed that land conveyance decisions in Beijing were highly subject to national policies and the status of its City Party Secretary, but not in Shanghai. Also, the use of Guapai resulted in higher residential and commercial land prices in Shanghai, but lower prices for Beijing's commercial land parcels. The findings indicate that Beijing, due to its closer proximity to the Central Government, appears to have stringently followed the national policy directions, whereas land officials in Shanghai seem to have had a higher degree of autonomy in their decisions. Additionally, the contrasting price effect of Guapai on land prices for residential and commercial land parcels enabled Beijing's government to compensate for the latent losses in land revenue when leasing residential land parcels, due to Nation #10, by leasing commercial parcels at higher prices via tender.
Analysis of an Urban Development Boundary Policy in China Based on the IAD Framework

Abstract:Although urban growth control policies are widely adopted to help sustainable development in various countries, including China, few studies have been conducted to investigate the effectiveness and optimization of such policies in Chinese cities. Hangzhou, China, was chosen for this study as the research object, where the local authorities manage the urban sprawl via an urban development boundary policy. The institutional analysis and development (IAD) framework was employed to identify the conflicts between the central government and the local government as well as the developers and homebuyers in the formal/informal stage. The analysis shows that, with the implementation of the policy, problems such as fiscal crises, property inflation, and illegal construction will appear as a result of actors’ interactions. The study also highlights that industrial land transfer inside the boundary should be controlled in a reasonable range and that a land value tax should be introduced during the implementation of the urban development boundary policy.

Abstract:The Constitution in China stipulates that land in the cities is owned by the state and land in the rural is owned by collectives,and it means that land is requisitioned by the state to meet public welfare and the commonweal land demand.But on the other hand,the Constitution stipulates again that the state may requisition land owned by collectives according to law on public interests.The paper pointed out the antinomy in the land requisition of China,and put forward a basic route of urban state-owned land system reform and rural land system reform;discussed the distribution of land increment current in the balance of urban and rural construction land,the relation of urbanization and moderate land scale use as well as farmers' revenue increasing,the same right and same price for urban and rural house base,the sharing of responsibility for foodstuff security,and made some related policy suggestions.
The Institutional Logic of the Evolution of Land Consolidation Policy in China:Analytical Framework and Historical Observation

Abstract:This paper aims to analyze the institutional logic of policy evolution in the land consolidation system, which is characterized with land fiscal revenue redistribution in the process of urbanization under the organizational structure of central and local governments. By reviewing the polices for the land consolidation system under time sequence and practical cases in Zhejiang Province, the research adopts the qualitative research method of content analysis and interviews at different stages due to the different characteristics of the system. The study found that the evolution process of the land consolidation system is affected by the institutional environment and the technical environment from the central policy-making to the local policy-implementation, which is operated under the legitimacy mechanism. The institutional environment not only shapes the initial framework of the system but also makes the system change when the legitimacy is changed by institutional environmental changes. In addition, the system faces the efficiency pressure of the technical environment, which leads to the legitimacy crisis of policy-makers and finally makes the system change. The research results provide theoretical and practical inspirations for promoting the strategy of high-quality development, the rural revitalization and the development of eco-civilization in China.
An Investigation on Influences of Implementing New Code of Land Use Classification on Land Administration in China

Abstract:The overall goal of this paper was to examine potential positive and negative influences of implementing new land use classification system on future land administration in order to provide effective measures to improve land administration under the framework of the new classification. Methods of documentation analysis were employed. The enforcement of the new land use classification would result in a profound influence on cultivated land quality conservation, cadastral management and land ecology protection. The abolishment of an adjustable land type in the old classification system would avoid the occupation of superior quality land and thus be conducive to the complement of inferior quality land. Still, the combination of irrigated paddy fields and rain fed paddy fields to one category of paddy field creates an opportunity to circumvent quality management objectives in the procedure of occupation and complement. The establishment of vacancy land use type would be helpful for inhibiting the phenomenon of allowing land to be used for construction but not really conduct. Classifying residential land only in terms of city and village types would not only ignore the residential land over urban and rural connecting areas, but also ignore the mixed-use land, thereby causing negative effects on defining the use type for certain city land. The abolishment of unutilized land type may limit blind exploitation for land resources to certain degree. However, the continued absence of ecological land type may be detrimental to ecological conservation. In order to minimize these negative influences, land administration should suit the management environment to a variety of local conditions. This could be realized by the enforcement of new classification through three ways, i.e., subdividing new classification, improving the system of land quality evaluation and setting up ecological hearing institution for land development projects. There are two bases for subdividing new classification. One is the administration objects of local government, and the other is unique industrial structure. Like land use classification, the improvement in land quality evaluation also plays a prominent role in land administration, and it could be a critical supplement measure for land use classification. The ecological hearing system for land development project has the potential to combine macroscopic policy background with micro unique situations in order to balance economical benefits, social interests and ecological interests. It was pointed out that land use classification is just the beginning stage for land administration. The establishment of land use type is determined by needs for land administration which is affected by land use classification as well. In summary, the establishment and improvement of new land use classification should fully account for natural and social factors as well as its feasibility.

Abstract:This study reviews and forecasts the study of rural residential areas,points out flaws in the existing studies,and predicts the key points in future studies.A comparative study was employed in this essay.Results indicate that existing studies of rural residential areas mainly focus on development trends,potential assessment,models and planning and driving forces and efficiency valuation.In the end,it is concluded that the studies regarding theories,regional difference,system constitution,peasant and government behaviors and interdisciplinary research shall be enhanced.

The Redevelopment of China's Construction Land: Practising Land Property Rights in Cities through Renewals

Abstract:Abstract Existing literature on China's urbanization focuses primarily on the expansion of cities and towns, with little attention being paid to urban renewals. The wasteful use of urban land has conventionally been attributed to the ambiguous definition and ineffective protection of property rights. This study examines recent practices in urban redevelopment in Guangzhou – a site chosen by the central authorities to pilot urban renewals ( sanjiu gaizao ). The research identifies a local practice in which institutional changes are made not in the delineation of land property rights but instead in the redistribution of the benefits to be made from land redevelopment. Current users of the land are offered a share of the land conveyance income previously monopolized by the state as an incentive to encourage them to engage in urban renewal. Land-use intensity and efficiency have increased, along with social exclusion and marginalization. Research findings cast doubt over the perceived notion that the uniform and unambiguous definition of property rights is the prerequisite for improved land-use efficiency and call for a critical evaluation of the current urban renewal policies that completely ignore the interests of the migrant population who outnumber local residents by a large margin.

Abstract:China has long been known for its dual-track urban and rural systems in both land use and human registration system. And the land has shaped the restructuring of Chinese state power and radically impacts state-society relations. In August 2019, the Standing Committee of National People's Congress enacted the new Law of Land Management, which takes a big step towards the urban-rural equalized development in China. We hereby comment on the overhaul of this law cornering the welfare of peasants and discussed the potential challenges the country may face in the revitalizing its countryside. Finally, we call for further institutional innovation in terms of the reform of the rural land system.

Abstract:The Land Administration Domain Model (LADM), an international standard (ISO 19152:2012), provides a conceptual data model for land administration. This study applies the LADM model to a previously unexplored case: the administration of homestead lands (residential lands) in rural China. In China, rural homestead tenures have been altered through several iterations since 1949, variously serving economic development, political governance and social security objectives. An intended contemporary reform of the homestead tenure system is based upon: (1) collective ownership by local communities; (2) qualification rights, a kind of personal servitude to safeguard the social security of individual community members; and (3) use rights, usufructuary interests offering management options to promote economic development. This work shows it is possible to translate this tripartite entitlement reform of rural homesteads into an LADM profile, with rights, persons, and land forming the base components. Four (sub) packages are formed, namely, Party, Administrative, Spatial Unit and Surveying and Representation. The work finds the LADM-based model, applied to the administration of China’s rural homesteads, could facilitate the land tenure reform of rural homesteads, enable interoperability with other aspects of land administration, and could support national responses to those Sustainable Development Goals (SDGs) relating to poverty eradication, rural revitalization and intensive land use.

Abstract:The unification of urban and rural construction land is impending ,and the question how the govern-ment should regulate the market is urgent to answer .This paper systematically reviews the changes of economic , ecological and social values of suburb and exurb land under three modes which are respectively "traditional land ac-quisition","indirect entry in LUTRG"and"direct entry in supposed free market".It is concluded that a completely free land market can't achieve the purpose of reform ,and there is still room to improve the LUTRG policy .The paper suggests to clear the boundary between"the mode of indirect entry"and"the mode of direct entry"based on land use ,to limit the land which can enter the market directly within the urban planning areas ,and to respect rural households' will in and incorporate independent industrial and mining land into the LUTRG policy .

Abstract:China's land finance system has been a key contributor to the country's "economic miracle" over recent decades. While there is much existing research on different components of the land finance system, this paper, based on both an academic literature review and data analysis, provides an integrated understanding of how these parts function in tandem around the pivotal role of profitability in the system. First, we summarize the essentials of China's land finance system by providing a framework to understand the self-reinforcing cycle between local governments' financing and spending activities based on urban land-use rights (LURs). We also quantify the magnitude of profits generated by the cycle and its contribution to China's urban development. Second, we investigate the institutional underpinnings of the system, which empower local governments as the monopoly supplier of urban LURs. We also document the rising temporal trend in land prices in most cities. Both these institutional and market factors facilitate the profitability of land finance. Finally, we shed light on the sustainability of the system. Local governments' strong incentives to maximize the profitability of land finance have resulted in increasing economic and social costs/risks. Meanwhile, the feasibility of the system increasingly is coming into question, as both ongoing institutional reforms and recent urban land market cooling raise potentially fundamental challenges to the profitability of land finance.
