Abstract:Emojis are an increasingly important way we express ourselves. Though emojis may be cute and fun, their usage can lead to misunderstandings with significant legal stakes—such as whether someone should be obligated by contract, liable for sexual harassment, or sent to jail. Our legal system has substantial experience interpreting new forms of content, so it should be equipped to handle emojis. Nevertheless, some special attributes of emojis create extra interpretative challenges. This Article identifies those attributes and proposes how courts should handle them. One particularly troublesome interpretative challenge arises from the different ways platforms depict emojis that are nominally standardized through the Unicode Consortium. These differences can unexpectedly create misunderstandings. The diversity of emoji depictions isn’t technologically required, nor does it necessarily benefit users. Instead, it likely reflects platforms’ concerns about intellectual property protection for emojis, which forces them to introduce unnecessary variations that create avoidable confusion. Thus, intellectual property may be hindering our ability to communicate with each other. The Article will discuss how to limit this unwanted consequence.

Abstract:Abstract Over the last decade, emoji and emoticons have made the leap from text messaging and social media to legal filings, court opinions, and law review articles. However, emoji and emoticons’ growth in popularity has tested the capability of online legal research systems to properly display and retrieve them in search results, posing challenges for future researchers of primary and secondary sources. This article examines current display practices on several of the most popular online legal research services (including Westlaw Edge, Lexis Advance, Bloomberg Law, Fastcase, HeinOnline, and Gale OneFile LegalTrac) and suggests effective workarounds for researchers.

The Emoji Factor: Humanizing the Emerging Law of Digital Speech

Abstract:Emoji are widely perceived as a whimsical, humorous or affectionate adjunct to online communications. We are discovering, however, that they are much more: they hold a complex socio-cultural history and perform a role in social media analogous to non-verbal behaviour in offline speech. This paper suggests emoji are the seminal workings of a nuanced, rebus-type language, one serving to inject emotion, creativity, ambiguity – in other words ‘humanity’ - into computer mediated communications. That perspective challenges doctrinal and procedural requirements of our legal systems, particularly as they relate to such requisites for establishing guilt or fault as intent, foreseeability, consensus, and liability when things go awry. This paper asks: are we prepared as a society to expand constitutional protections to the casual, unmediated ‘low value’ speech of emoji? It identifies four interpretative challenges posed by emoji for the judiciary or other conflict resolution specialists, characterizing them as technical, contextual, graphic, and personal. Through a qualitative review of a sampling of cases from American and European jurisdictions, we examine emoji in criminal, tort and contract law contexts and find they are progressively recognized, not as joke or ornament, but as the first step in non-verbal digital literacy with potential evidentiary legitimacy to humanize and give contour to interpersonal communications. The paper proposes a separate space in which to shape law reform using low speech theory to identify how we envision their legal status and constitutional protection.

Abstract:Emojis have been appearing more and more frequently in court cases since at least 2015, used as evidence for or against intent to commit a crime or as signs of a defendant's consciousness of guilt. They have also become part of an ever-expanding visual lexicon of aggression used by individuals and gangs for making threats or planning criminal activities. This essay surveys relevant cases and studies since 2015 that concern this aspect of emoji communication—an aspect that was hardly anticipated by the congeners of these picture words, who introduced them as communicative tools to foster benign interactions in the global village, not as weapons of violence and criminality. The main conclusions that can be extrapolated from the present review are as follows: (a) emojis can, in fact, no longer be viewed merely as signs designed to engender congenial communication, as was intended by their inventors; (b) they can no longer be excluded as evidence in courtrooms, given their penetration into everyday digital communications; and (c) they require special attention by both legal and criminal investigative practices and institutions. The last point implies the need for a field that can be called simply "emoji forensics."
Deciphering Emoji Variation in Courts: a Social Semiotic Perspective

Abstract:Emojis are increasingly being used as digital evidence in courts due to the miscommunication and misinterpretation arising from the high variability of their usage and interpretation. Emojis in courts have been extensively researched in extant studies, but relatively little attention has been paid to the emoji variation phenomena in Chinese courts. Through an empirical qualitative content analysis of the court judgments in China and the United States and some supplementary materials, this study posits that an emoji's meaning in courts can be subject to the following six categories of variations: i. variation across platforms, including devices, operating systems, software programs and clients; ii. temporal variation; iii. variation in court cases under different rules of evidence; iv. variation in individual participants; v. variation across social groups; and vi. linguistic-cultural variation. From a social semiotic perspective, emojis as dynamic signs have great meaning potentials, making their meanings context-dependent and interpreter-dependent. For this reason, it is suggested that legal professionals untangle and weave historical, social, cultural and legal contexts into the interpretation of an emoji's meaning. Moreover, a probe into the contextualized configuration of emojis can offer practical insights into the interpretation of emoji-bearing texts in judicial decision-making as well as the admissibility and investigation of digital evidence in courts.

Abstract:Emoji and emoticons are becoming increasingly prevalent in criminal law cases around the world, although some judicial officers currently have no experience of them or of interpreting them. This article offers an in-depth examination of the area of emoji and emoticons in criminal law. It provides an overview of emoticons and emoji, including their history, their global popularity of use in modern communication, and their particular interpretative difficulties. It canvasses and analyzes international criminal cases involving emoji and emoticons. It provides a valuable table that lists each such case in which emoji and emoticons are present. In reviewing the existing international case law, this article identifies the handful of cases in which judicial officers have attempted to interpret emoji and emoticons in the criminal law context. However, it also demonstrates the absence of clear guidance on methods of interpreting emoji and emoticons. Most importantly, this article aims to assist filling this void by proffering important recommendations regarding interpreting emoji and emoticons in the criminal law context.

Abstract:Emojis, used evidentially as any language is used in communication, have posed new challenges for courts to adopt emojis as evidence beyond the traditional mode of speech and communication and to interpret them appropriately, especially their aggressive side of meaning. To meet these challenges, the present study, based on a comprehensive literature review, starts with case studies with aims to unravel the nature of emojis and develop a sociosemiotic approach to interpret emojis in the context of social media with a focus on the aggressiveness of emojis in social platforms and their consequences (social and legal ones). It is argued that the meaning of emojis could not simply depend on their grammar or general rules but lies in communication within discourse communities.

Abstract:This paper reviews Marcel Danesi’s new book on the use of emoji in particular, and the use of visual language more generally. Danesi offers a number of interesting examples of emoji use, pointing out that their use has risen considerably in a number of contexts. He goes on to question how far emoji use can be extended by examining the structure of the emoji ‘language’. Overall this is an accessible book that presents a number of examples of visual languages and comments on the possibilities and challenges for visual language use against a backdrop of technological change.

Abstract:It is a fact that emojis are a growing phenomenon in the last few years. They have gained their popularity with their typical varieties in the digital era across countries in the world. The emojis are used among people as a way to assist the process of conveying emotions in textual communication that lacks nonlinguistic cues. Emojis were created and developed as visual mixed expressions of sentiments, attitudes, or moods for use in modern communication technologies. Then, in more broad perspective and context, in term usages, they are also generally perceived that they do not only have unique semantic and emotional features, but also are closely related to many areas such as marketing, law, education, health, etc. This paper reviews the nature of emoji, the developmental history of emojis, the functions of emojis in communication, and the usages of emojis in a real-digital world interaction and communication. EmojiNet: Building a Machine Readable Sense Inventory for Emoji

Abstract:Emoji are a contemporary and extremely popular way to enhance electronic communication. Without rigid semantics attached to them, emoji symbols take on different meanings based on the context of a message. Thus, like the word sense disambiguation task in natural language processing, machines also need to disambiguate the meaning or sense of an emoji. In a first step toward achieving this goal, this paper presents EmojiNet, the first machine readable sense inventory for emoji. EmojiNet is a resource enabling systems to link emoji with their context-specific meaning. It is automatically constructed by integrating multiple emoji resources with BabelNet, which is the most comprehensive multilingual sense inventory available to date. The paper discusses its construction, evaluates the automatic resource creation process, and presents a use case where EmojiNet disambiguates emoji usage in tweets. Abstract:This paper presents the release of EmojiNet, the largest machine-readable emoji sense inventory that links Unicode emoji representations to their English meanings extracted from the Web. EmojiNet is a dataset consisting of: (i) 12,904 sense labels over 2,389 emoji, which were extracted from the web and linked to machine-readable sense definitions seen in BabelNet, (ii) context words associated with each emoji sense, which are inferred through word embedding models trained over Google News corpus and a Twitter message corpus for each emoji sense definition, and (iii) recognizing discrepancies in the presentation of emoji on different platforms, specification of the most likely platform-based emoji sense for a selected set of emoji. The dataset is hosted as an open service with a REST API and is available at <a class="link-external link-http" href="http://emojinet.knoesis.org/" rel="external noopener nofollow">this http URL</a>. On the Context-Free Ambiguity of Emoji

Abstract:Emojis come with prepacked semantics making them great candidates to create new forms of more accessible communications. Yet, little is known about how much of this emojis semantic is agreed upon by humans, outside of textual contexts. Thus, we collected a crowdsourced dataset of one-word emoji descriptions for 1,289 emojis presented to participants with no surrounding text. The emojis and their interpretations were then examined for ambiguity. We find that with 30 annotations per emoji, 16 emojis (1.2%) are completely unambiguous, whereas 55 emojis (4.3%) are so ambiguous that their descriptions are indistinguishable from randomly chosen descriptions. Most of studied emojis are spread out between the two extremes. Furthermore, investigating the ambiguity of different types of emojis, we find that an important factor is the extent to which an emoji has an embedded symbolical meaning drawn from an established code-book of symbols. We conclude by discussing design implications.

Abstract:Emoji faces are ubiquitous and integrated into most people's everyday (nonverbal) vernacular. Yet, we know little about how people interpret these characters in terms of their emotional content. Do people agree that an emoji face represents an individual emotion and that it is unique to a specific emotion? Are such representations similar across electronic platforms? The present study took a theoretical approach to address these questions by investigating shared agreement between emoji–emotion pairings across three electronic platforms (Apple, Android, and Samsung). Two hundred twenty-eight English-speaking adults completed an online survey that involved picking up to three emoji faces (presented from a common set from one of three platforms) for each of 10 emotions. They then indicated the strength of that relationship. We examined whether the intensities that participants gave to emoji–emotion pairings were specific and consistent across platforms. Our results showed limited shared agreement for the majority of emoji–emotion pairings, and significant variation as to which emotion category a "comparable" emoji belonged depending upon the viewed platform. We highlight the need for future emoji perception research to examine how different platform renderings of the same emoji might lead to miscommunication and interpretation discrepancies.

Emojinize: Enriching Any Text with Emoji Translations

Abstract:Emoji have become ubiquitous in written communication, on the Web and beyond. They can emphasize or clarify emotions, add details to conversations, or simply serve decorative purposes. This casual use, however, barely scratches the surface of the expressive power of emoji. To further unleash this power, we present Emojinize, a method for translating arbitrary text phrases into sequences of one or more emoji without requiring human input. By leveraging the power of large language models, Emojinize can choose appropriate emoji by disambiguating based on context (eg, cricket-bat vs bat) and can express complex concepts compositionally by combining multiple emoji (eq, "Emojinize" is translated to input-latin-letters right-arrow grinning-face). In a cloze test--based user study, we show that Emojinize's emoji translations increase the human guessability of masked words by 55%, whereas human-picked emoji translations do so by only 29%. These results suggest that emoji provide a sufficiently rich vocabulary to accurately translate a wide variety of words. Moreover, annotating words and phrases with Emojinize's emoji translations opens the door to numerous downstream applications, including children learning how to read, adults learning foreign languages, and text understanding for people with learning disabilities.

Abstract:Japanese people sometimes use emoji in their daily activities, especially in non-verbal communications such as text messages or posting on their social media. Therefore, the purpose of this research is to find out what kind of emojis that Japanese people of generation X, Y, and Z tend to use in their communication. This research uses library and qualitative method. Authors also conduct a survey on 90 random Japanese people. It is hoped that this research allows us to know the representation of emoji that is used between different generations in Japan.The research shows that emoji used in communication may serve as a medium to maintain harmony between generations to communicate in this digital era. Plenty of Japanese people, especially within families and friends use emoji to emphasize expressions in a sentence as well as making them more friendly. Moreover, another result of why Japanese people use emoji in smartphones is because of its practicality.

Abstract:The use of pictorial as well as character representations in online communications has become the acceptable norm. As some of these representations, referred to as emoticons, emoji, GIFs, Stickers, memes, pictures and such like are gaining recognition, so is the contention as to their legal consequences. Although, no certain and defined field of law has emerged to analyse or define in a systemic manner and with adequacy the legal implication of each form of such communication, emerging juristic principles have signified the readiness of the courts to treat them as creating legal consequences. Utilising the doctrinal approach, this paper considers the legal issues that may arise in their use within the context of the Nigerian legal system. By assessing judicial pronouncements in other jurisdictions, the paper makes suggestions on how to effectively deal with legal issues that may arise in relation to their use in Nigeria.

Abstract:As emojis become prevalent in personal communications, people are always looking for new, interesting emojis to express emotions, show attitudes, or simply visualize texts. In this study, we collected more than thirty million tweets mentioning the word “emoji” in a one-year period to study emoji requests on Twitter. First, we filtered out bot-generated tweets and extracted emoji requests from the raw tweets using a comprehensive list of linguistic patterns. Then, we examined patterns of new emoji requests by exploring their time, locations, and context. Finally, we summarized users' advocacy behaviors and identified expressions of equity, diversity, and fairness issues due to unreleased but expected emojis, and concluded the significance of new emojis on society. To the best of our knowledge, this paper is the first to conduct a systematic, large-scale study on new emoji requests.

Abstract:We report on an exploratory analysis of Emoji Dick, a project that leverages crowdsourcing to translate Melville's Moby Dick into emoji. This distinctive use of emoji removes textual context, and leads to a varying translation quality. In this paper, we use statistical word alignment and part-of-speech tagging to explore how people use emoji. Despite these simple methods, we observed differences in token and part-of-speech distributions. Experiments also suggest that semantics are preserved in the translation, and repetition is more common in emoji.

Abstract:Most social media platforms are largely based on text, and users often write posts to describe where they are, what they are seeing, and how they are feeling. Because written text lacks the emotional cues of spoken and face-to-face dialogue, ambiguities are common in written language. This problem is exacerbated in the short, informal nature of many social media posts. To bypass this issue, a suite of special characters called "emojis," which are small pictograms, are embedded within the text. Many emojis are small depictions of facial expressions designed to help disambiguate the emotional meaning of the text. However, a new ambiguity arises in the way that emojis are rendered. Every platform (Windows, Mac, and Android, to name a few) renders emojis according to their own style. In fact, it has been shown that some emojis can be rendered so differently that they look "happy" on some platforms, and "sad" on others. In this work, we use real-world data to verify the existence of this problem. We verify that the usage of the same emoji can be significantly different across platforms, with some emojis exhibiting different sentiment polarities on different platforms. We propose a solution to identify the intended emoji based on the platform-specific nature of the emoji used by the author of a social media post. We apply our solution to sentiment analysis, a task that can benefit from the emoji calibration technique we use in this work. We conduct experiments to evaluate the effectiveness of the mapping in this task.

The Lexicon of Emoji? Conventionality Modulates Processing of Emoji

Abstract:Emoji have been ubiquitous in communication for over a decade, yet how they derive meaning remains underexplored. Here, we examine an aspect fundamental to linguistic meaning-making: the degree to which emoji have conventional lexicalized meanings and whether that conventionalization affects processing in real-time. Experiment 1 establishes a range of meaning agreement levels across emoji within a population; Experiment 2 measures accuracy and response times to word-emoji pairings in a match/mismatch task. In this experiment, we found that accuracy and response time both correlated significantly with the level of population-wide meaning agreement from Experiment 1, suggesting that lexical access of single emoji may be comparable to that of words, even out of context. This is consistent with theories of a multimodal lexicon that stores links between meaning, structure, and modality in long-term memory. Altogether, these findings suggest that emoji can allow a range of entrenched, lexicalized representations.
