Aspects of Regulating Individual’s Bankruptcy Under the Laws of Foreign Countries

Abstract:Purpose: The article is a study of the peculiarities of regulating the legal status of individuals bankruptcy based on the norms in force in various international systems of countries with more developed regulators of this procedure. Design/methodology/approach: The methodological basis of the study is a complex of dialectical, historical and legal, systemic, structural, structural and functional methods that determine how to implement international legal achievements in national legal systems. Findings: Carrying out a review of legal norms valid in different countries of the world, the authors determine the need to develop, with the help of international experience, new approaches to ensure legislative regulation of personal bankruptcy procedures, taking into account the interests of all participants, while examining the experience of international legal regulation. The main features and shortcomings of such procedures were identified based on the specifics of a number of international entities at the state level. The main purpose of using this approach is to take into account achievements in the field of research in different countries of the world. Moreover, in recent years, especially abroad, there has been a steady increase in the category of court cases related specifically to the bankruptcy of individuals, which confirms the high degree of relevance of the topic under study. Originality/value: the lack of financial stability in the countries of the world during the ongoing economic crisis will always cause financial ties aimed at optimizing all relations, including the violation of financial obligations, which entails the need for legal mechanisms to stabilize the financial situation in the country.
