Abstract:Movements have gained momentum within the restitution debate with the aim of taking cultural objects back to Africa. The discussions are vivid. For instance, the Savoy Report stated that Europe's museums keep an overwhelmingly large share of Africa's collections, leaving the countries of origin with almost nothing (Sarr and Savoy <a class="link link-ref link-reveal xref-bibr" href="">2018</a>). Indeed, most—if not all—large museums in Europe and North America bear African collections with colonial legacies. Either their specimens originated directly from former colonies or they were obtained in the context of questionable international procedures put in place at the time. As a consequence, the content, interpretation, and representation of indigenous cultural entities in museums are contentious issues of discussion (Ashley <a class="link link-ref link-reveal xref-bibr" href="">2009</a>). Undoubtedly, Africa has become a prime region for discussing colonial legacies. It is a debate about moral and power pressure (Shyllon <a class="link link-ref link-reveal xref-bibr" href="">2017</a>).

Abstract:This article assesses the extent to which the Africa Museum (AM) decolonised itself according to Sarr and Savoy's criteria for restitution applied to DR Congo's cultural heritage. Rather than casting permanent restitution as a single objective, this paper argues that the long-term process consubstantial to the decolonising momentum can break an often-misleading taxonomy down and discern its components as fields of investigation as well as pragmatic steps to rethink the modalities of restitution. The AM's restructuring of exhibition rooms and epistemes, inventorying, digitisation and provenance studies partly resonate with intermediary restitution practices such as restoration of ethos, recognition of guilt, reparation of broken narratives and reappropriation of knowledge. Nevertheless, the findings of this research show that these initiatives can only be considered as preconditions for restitution – not permanent alternatives designed as retentionist devices – if they are accompanied with a proactive museum diplomacy towards the Musée National de la République Démocratique du Congo (MNRDC).

Abstract:African art though dynamic has changed in form, function, and meaning over time. However, the concept of Indigenous African art has remained static. This paper aims at examining the complex relationship between African art and colonial encounter while interrogating the commodification and restitution of African artifacts which has become a topical issue. This is because pre-colonial sacred objects have an aura of untainted timeless past reflecting the way of life of the African people. The colonial encounter with Africa witnessed a rush for African traditional religious artifacts and antiquities which left indelible marks of hostilities and cultural clashes among the African people. Many African artifacts looted from their countries of origin during colonialism and are now housed in museums and private collections around the world. While most studies on Linus Asong’s the Crown of Thorns focus on feminist analysis, the paper is read from the perspective of New Historicists’ exegesis that interrogates the commodification and restitution of African sacred objects stolen from Africa during colonialism. The findings show that, although the issue of the commodification and restitution of African artifacts is a complex and controversial one, there is a growing recognition of the importance of acknowledging and rectifying the historical injustices associated with their commodification.

Abstract:The debate on the return and restitution of cultural property is by no means a new one. In recent years, however, the debate – stimulated by French President Emmanuel Macron’s speech in 2017 – extended to include the question of how to deal with collections from colonial contexts. Whereas international law provides a legal framework for how to deal with war-time looting (the 1954 Hague Convention) and the present-day trafficking in cultural property (the 1970 UNESCO Convention), no such legal regime exists for cultural objects removed during colonial times. Nevertheless, as this article illustrates – with a focus on recent examples in Germany – current developments indicate a movement towards new political and ethical schemes on how to deal with collections from colonial contexts and, in a broader sense, how to come to terms with the colonial past. In Germany, this includes the return of cultural objects and human remains to Namibia as well as the transfer of ownership of all Benin Bronzes held by German institutions to Nigeria.

Abstract:This chapter traces how, in the context of Western colonial knowledge cultures and regimes of value, certain objects from African material cultures were reinvented as art, and considers the impact of these changes on the development of museum and heritage cultures in postcolonial Africa, in which museums were seen both as subjects of, and tools for, cultural decolonization. African cultural institutions were confronted with the legacies of colonial regimes of value, but also with the physical legacies of colonial cultural infrastructures, in which large collections of what was now considered national heritage were located in the West. The chapter addresses the rising importance of international heritage and conservation regimes supported by organizations such as UNESCO, and their role in the negotiation of restitution claims.

Abstract:In the late nineteenth century, Western Powers launched military campaigns in sub-Saharan Africa resulting in the colonization of vast territories and the spoliation of cultural property. To justify the conquest, they asserted the supremacy of Western culture and disregarded principles of international law in their dealings with African states, communities, and individuals. This article examines colonialist legal justifications such as the denial of statehood of pre-colonial sub-Saharan African societies, the notion that conquest and spoliation were justifiable, and the belief that African legal systems lacked concepts of property. The article details why these arguments contradict well-established nineteenth-century legal principles, particularly state sovereignty and private property, which together form the conceptual basis for the prohibition of spoliation. The universal nature of those principles allows for the nondiscriminatory application and interpretation of historical law and consequently the protection of African pre-colonial states and private as well as public cultural property.

Abstract:This paper provides a historical analysis of the peak and demise of the international view on cultural heritage. In the 1980s, cultural internationalism emerged as a conservative reaction against the adoption of the 1970 UNESCO Convention, which organises the restitution and return of stolen cultural properties. Internationalist and cosmopolitan scholars who have claimed that cultural heritage 'belongs to humanity', generally condemned restitution, and pushed back against the ratification of the Convention. The international view on cultural property became traditionally dominant in milieus such as universal museums, antiquity markets and some academic disciplines. However, over the past half-decade, the growing importance of research on provenance has challenged cultural internationalism in two areas. Firstly, research on provenance focused on art and archaeological crime has shown that artefacts allegedly excavated in the past are often the proceeds of recent looting, especially in conflict zones. Secondly, recent studies on historical provenance have revealed that many objects were collected using colonial violence. As a result, developments in criminology, postcolonial history, and indigenous peoples' rights have generally led to the retreat of cosmopolitan narratives on cultural property. Ultimately, this paper highlights that cosmopolitanism in cultural heritage has historically hinged on the imperialist past.

Abstract:Despite an abundance of international instruments devoted to the restitution of illegally exported cultural artifacts, they usually exhaust their usefulness regarding artifacts looted during the Colonial Era. These requests are indeed confronted with various obstacles, whether it is the limited scope of the conventions, their non-retroactive nature, or the expiration of periods of limitation. In the absence of applicable international standards, plaintiffs must then refer to national laws and courts of justice in the States concerned in the dispute. However, due to the complexity of situations and the diversity of legal systems, legal proceedings are often unpredictable and unsatisfactory. In these circumstances, many restitutions today are the result of alternative processes (voluntary restitution, mediation, or arbitration) which allow the participants to invoke moral, ethical, or deontological principles and lead to equitable solutions adapted to each situation.
Sepulcherised Objects and Their Decolonial Futures in African Museums: The “Robert Edward Codrington Collection” at the Zimbabwe Natural History Museum

Abstract:This essay builds on the emerging (museum) decolonizing perspectives to (i) explore the biographical details and modes of curation and classification to which “ethnographic” 1 objects collected during the colonial era have been exposed; to (ii) foreground the complexities of inherited colonial museum processes embedded in African urban contexts; and, to (iii) consider alternative modes of engagement with ethnographic objects and local Indigenous communities to challenge the embedded regimes of care and the marginalization rendered to Indigenous epistemologies. One of the biggest questions facing museums in the world today is how to deal with the hordes of objects collected from various Indigenous communities and placed in museums far away from the communities who made and used them. Using the case of an “ethnographic” collection in a former colonial museum, we call for a paradigm shift in museum practices, and challenge the present state of affairs of museum curatorship. We then briefly suggest possible ways in which such museums can confront their imperial histories and unsettle their inherited regimes of care and representation. We call for museums to enter into conversations with communities, listening to them and effecting curatorial activities that re-center local ways of knowing, while embracing the complexities associated with such engagements.

Abstract:The relevance of the topic raised in this article is justified by the importance of the issue of restitution of cultural property after the Second World War and the interest it arouses in society at the current stage of development. During the time that has passed since the defeat of Nazi Germany, many former owners of works of art, from whom the Nazis requisitioned their collections, have regained their artifacts. The process of restitution continues up to the present. The idea of restitution arose from the idea of protecting cultural property from encroachment. And if shortly after the war, the families of former owners of works of art tried to return their art property from private collectors, now lawsuits are usually directed against museums. One of the well-known restitution cases in recent years is the lawsuit against the New York Museum of Modern Art, which is an attempt to return family values by the descendants of the German artist Georg Grosz and collector Alfred Flechtheim. Dispute resolution has not yet been brought to its logical conclusion. The purpose of the article is to establish the problems of returning the lost cultural property that was illegally acquired by the Nazis during the Second World War and sold to museums, as well as to private collectors. Today, many of these works of art are owned by American collectors or museums. The descendants of repressed cultural figures who suffered from the Nazi regime demand the restoration of their rights, through the restitution of art artefacts or compensation for lost works of art.
Return and restitution of cultural property in the wake of the 1970 Convention

Abstract:Over the past decades illicit trafficking in cultural property has, unfortunately, grown into a problem of epidemic proportions, comparable with the international trade in drugs, with which it shares certain characteristics. Whether or not we succeed in protecting cultural property better in the future depends on wide‐reaching changes in attitudes. A palpable expression of this gradual but certain change in attitude is the adoption of professional codes of ethics by many museums and fine art dealers that reflect a heightened awareness of the implications and problems connected with this illicit traffic. Illicit trafficking in cultural property is an international affair, and only international cooperation, particularly through the adoption of and adherence to international conventions, will allow a higher measure of control in this area. To curb illicit traffic in cultural property more countries must ratify the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property, as well as the UNIDROIT Convention of 1995 and other relevant multilateral and bilateral agreements. However, unless these conventions are supported by adequate national legislation and a comprehensive programme for the protection and preservation of cultural heritage, international conventions can have only limited effect. Following the period of decolonization in the 1970s, UNESCO member states recognized that the lack of retrospective application of existing international instruments resulted in many ‘victim’ states that had no legal recourse to claim the return or restitution of illicitly appropriated cultural property.

Abstract:Durante o período colonial, milhares de artefatos culturais foram levados do continente africano pelos europeus. Nos últimos anos, a restituição de bens culturais tem chamado atenção de teóricos, governos, órgãos internacionais e regulamentações jurídicas. Contudo, há pouca informação sobre a forma como essa realidade se apresenta e é discutida. Este ensaio é uma proposta de investigação sobre a restituição dos bens culturais retirados no contexto do colonialismo, considerando a relação de países europeus com países africanos. Trata-se de analisar a constituição do regime internacional de proteção e restituição do patrimônio cultural, seus princípios, limites e possibilidades, tendo em vista alguns casos de processos restitutivos realizados a partir da década de 1990 e suas narrativas. Em meio aos debates acerca da descolonização das relações entre ex-metrópoles e ex-colônias e os efeitos ainda presentes do colonialismo, este trabalho põe em marcha uma proposta teórico-metodológica que aposta no papel da memória e sua potência no que toca ao direito humano à cultura e à identidade. Small-scale art organizations as participatory platforms for decolonizing practices and sensibilities

Abstract:The debate on restitution and other decolonizing practices of museums has been getting a lot of attention both in the public debate and in cultural studies. This essay shifts the focus to small-scale institutions and art spaces and their specific decolonizing practices and sensibilities. Unlike anthropological as well as art museums, which are dealing primarily with the politics of collecting, exhibition-making, provenance research, and restitution, smaller institutions and art spaces do not start out from the need to decentre collections and decolonize material objects. Instead, they work with artists, researchers, activists, and audiences to raise sensibilities, while discussing and experiencing how to relate to the history and current situation of a specific place in the context of a global colonial situation. Based on these practices of smaller organizations and their capacity to offer a platform for civic interests and participation, they suggest a dissent, a space of conflict, that, at a distance from the narrative of Western modernity, might reclaim futurity.

The Legal Frameworks of Protecting Archaeology in Africa

Abstract:Archaeological heritage is fragile and nonrenewable. In Africa, it is vulnerable to developmental projects in construction, mining, and agriculture as well as intentional and unintentional vandalism through everyday use and tourism. Looting, illegal trade of antiquities, and terrorism have also emerged as other significant threats to archaeological heritage in Africa. Looting and vandalism of sites and objects result from lax monitoring mechanisms and a general lack of awareness of archaeological matters among the public. Although most African countries have the legal protection of archaeological heritage, the effectiveness of these has been under question. African heritage legislations have been criticized for the lack of predevelopment assessments that would ensure the protection of recorded and unrecorded archaeological heritage. They have also been censured for protecting just the physical aspects of archaeological heritage, leaving out the intangible aspects that actually give the heritage value, especially among African communities. Another challenge was the exclusion of local communities and customary management systems in the protection of archaeological heritage. Provisions for counteracting looting and illegal trade in antiquities, coming especially from archaeological sites, were also considered weak and requiring improvements. The response to the debate on the effectiveness of the legal protection of heritage has been varied across the continent. Some African countries have responded by writing new laws, amending old ones, or providing other supporting legal provisions such as national cultural policies or regulations. Countries that have instituted new legal provisions include Namibia, Botswana, Kenya, Mali, Egypt, Mauritania, and the Republic of the Congo. Those who reworked their protective mechanisms have attempted to address many of the issues raised. Countries such as Namibia, Botswana, and Mali have included clearly defined provisions for predevelopment assessments. Others such as Liberia included archaeological heritage in their environmental protection laws. Although fewer countries have had legislation to protect intangible aspects, supporting legal provisions such as national cultural policies have helped in this regard. However, very little has been done on the inclusion of customary laws and systems of archaeological protection. Going forward, African nations have to quickly consider emerging issues such as digital manipulation, heritage-based product development, increased need for intervention conservation, and sustainable economic utilization of heritage for the development of individuals, communities, and nations. The legislative process in Africa has to be expedited to quickly and efficiently deal with these issues before they cause harm to the archaeological heritage.
The Nigerian National Museums and the challenges of national unity and development

Abstract:Nigeria is the most populous country on the African continent with an estimated population of about 250 million people and more than 250 ethnic groups. While Nigeria's population and ethnic diversity have posed an existential threat to the nation, the exigencies of unity have become a national concern. The government has thus mobilized its resources to pursue national unity. The National Commission for Museums and Monuments (NCMM) is one of these resources that is charged with a double task of preserving Nigeria's unity and recovering its lost artifacts. Both projects are driven by national interest, with repercussions for international cultural politics. In this chapter, we show how NCMM has keyed into the national debate of Nigeria's unity on the one hand and the return (restitution) of Nigeria's lost artifacts on the other. Being two primary projects embarked upon by the Commission after its creation, their realization has been fraught with challenges. The efforts have been impeded by inconsistent government policies, opposition politics, ethnic crises, and lack of collective government motivation for virile museology.

Abstract:How is it possible in this moment of museum decolonization, critical examination of museum ethics and practice, calls for repatriations and reparations, and restorative justice, that a brand new museum is embroiled in controversy over the acquisition, study, and display of archaeological artifacts? Museum aversion to addressing complex issues of provenance, documentation, fakes, and archaeological site destruction caused by looting results in distorted displays and inaccurate interpretations of the material record and injustice and bias in the contact zone (sensu Bennett, Boast, Clifford, and Pratt). The exhibition of archaeological artifacts from the 'Holy Land', specifically the Dead Sea Scrolls on display at the Museum of the Bible, offers a compelling case study. The Dead Sea Scrolls as contact zone (writ small) allow for the consideration of curatorial decision-making, visitor engagement, honesty, untold stories, and the potential for redemption at the Museum of the Bible.

Abstract:Abstract Worldwide, community museums can play an important role in regenerating and safeguarding Indigenous living cultures. The aim of this article is to explore and examine the complex socio-cultural context of the Nambya Community Museum (NCM), located in Hwange district, north-western Zimbabwe. Over the past 18 years, a web of multiple stakeholders has struggled to find common ground on what and whose cultural heritage the NCM should represent. As a result, many often conflicting views and attitudes held by different stakeholders have emerged concerning the present or future status and the purpose of the NCM. In this article we deploy multivocality theory, and rely on qualitative data collected during a large-scale archeological and heritage management research project to present and discuss a wide range of conceptual and practical issues confronting the NCM. We situate this case study within current global conversations about the ideal museum of the present and the future.
Possibilities for a postcolonial archaeology in sub-Saharan Africa: indigenous and usable pasts

Abstract:It has long been recognized that archaeology in sub-Saharan Africa, and its public manifestation through the medium of museums, emerged within the context of European colonial rule, and that legacies of colonialism continue to shape archaeological practice across the continent. Following independence there has been steady indigenization, initially in terms of personnel but subsequently also in terms of organizational structure and research agendas. Recent calls for a ‘post-colonial archaeology’ liberated from the constraints imposed by ‘the colonial archive’, have highlighted many of the challenges that remain. Nevertheless, indigenization has also resulted in the production of more nationalistic and/or Afrocentric perspectives. These echo some of the sentiments voiced by the first generation of African political leaders regarding the need to recover a truly ‘African past’, which have also been revived in more recent calls for an African Renaissance as articulated by NEPAD, among others. This paper explores these developments so as to highlight some of the inconsistencies and inherent contradictions of current conceptualizations of postcolonial archaeology in sub-Saharan African contexts.

Abstract:Objects of cultural heritage present a unique and important opportunity for the use of blockchain technology. Specifically, blockchain, a distributed ledger technology, can be used to disincentivize the sale of looted objects and to manage shared stewardship, ownership, and exhibition of these contested artifacts taken though war or colonialism. We offer background on repatriation of antiquities using the Byzantine Fresco Foundation as a core case study; introduce a working model of stakeholders in antiquities markets in both contemporary and historical context; and propose a blockchain solution using four different cases. The paper draws on newly sourced archival documents, game-theory interpretations of stakeholder behavior and application of this new technology in regulatory context. These blockchain applications are especially timely with the publication of the Sarr Savoy Report and the Arts Council England's rewriting of its restitution guidelines for museums and galleries.
