Abstract:Recent legislative efforts to address modern slavery emphasise corporate disclosure as the primary regulatory tool. New modern slavery disclosure laws harden the expectation that business will conduct itself responsibly; however, they are founded on a soft approach to enforcement which is essentially outsourced to the market. This paper questions the effectiveness of this disclosure-based enforcement mechanism, which primarily relies on a narrowly defined concept of ‘the market’ as the basis for its regulatory strategy. Drawing on comparisons with alternative legislative enforcement frameworks to counter foreign bribery and illegal logging, this paper highlights the opportunities and limitations of reliance on market forces for regulation and suggests a path forward for enhancing the modern slavery enforcement approach.

Abstract:This chapter identifies challenges in and opportunities for addressing modern slavery in global supply chains. After briefly reviewing the historical context of how modern slavery and worker exploitation historically intersected with US business, this chapter explains the tools and processes corporations already utilize within their supply chains to maximize return and how those approaches can be leveraged to better counter exploitation, particularly human trafficking, around the world. Acknowledging that there exist many systemic disincentives for multinationals to invest in best practices, this chapter makes the case that incorporating an anti-trafficking lens into existing risk management and data analytics, strategic procurement, total systems cost analysis, CEO leadership, and stewardship by operations executives can effectively leverage the trillions of dollars in global procurement spent to advance freedom. Finally, this chapter recommends concrete steps businesses can take to ensure adoption of existing best practices and better pioneer their own.

Abstract:The purpose of this rapid review is to lay out some of the general approaches used by both business and government to tackle ‘modern slavery’ in international business supply chains, and locate evidence of their effectiveness International institutions have been encouraging large international businesses to tackle modern slavery by offering guidelines on how to investigate the issue in their supply chains (‘due diligence’), but their implementation, and ‘auditing’ is highly variable. National governments are increasingly mandating businesses through legislation to report on what they do. More recently, governments have begun imposing a legal duty of care on parent companies which means they can be held responsible for what their subsidiaries do. Key findings are: There is no consistency in how international companies currently implement the due diligence guidelines; The design of national disclosure legislation is generally judged to be flawed. There is medium compliance in terms of quantity of company reports and low compliance in terms of quality; The design of national disclosure legislation is generally judged to be flawed. Overall, the evidence on forced labour and modern slavery is recognised as being “dangerously thin and riddled with bias” (LeBaron, 2018, p.1). It is difficult to research directly because of its illegality, the involvement of powerful interests, and the potential to further endanger highly vulnerable workers. Nevertheless, there is a very large number of articles and reports written on the issue, particularly from the last five years. The main sources used in this review came from both grey literature and academic literature.
Learning to See Modern Slavery in Supply Chains through Paradoxical Sensemaking

Abstract:Mandatory annual reporting, to improve transparency of working conditions in firms' supply chains, is the favoured approach of UK policymakers for reducing modern slavery risks in supply chains. Despite legislation and extensive guidance, annual corporate statements are disappointing, providing little evidence of substantive action. So far though, there has been little primary research of managers' understanding of the phenomenon, or their perceived agency in tackling modern slavery. In a qualitative study, employing template analysis, data were drawn from multiple sources, including interviews with 32 managers from three large UK firms in a complex, high‐risk sector (construction). Four focus groups were used to establish credibility of the findings. As managers struggle with how to make sense of where to look, how to look, and what to see, they adopt narrowed perspectives and analogies that inhibit immediate, compelling action. Improved awareness of UK labour supply chain issues has distanced managers further from action relating to global materials supply chains. Through analogy with health and safety legislation, which developed over a considerable period, managers justify a wait‐and‐see approach, deferring action. Such convenience framing helps them to avoid issues relating to complexity, control, cost and (in)visibility. This framing needs to be disrupted for meaningful action to result. Drawing on sensemaking theory relating to paradoxical financial and sustainability objectives, the study suggests how extended legislation and governance may drive more substantive responses that transcend the constraints of business‐case logic.

Abstract:More than 50 million people in the world are estimated to be in a situation of modern slavery, the most extreme form of labour exploitation. Many of them are working in sectors such as mining and agriculture, which produce price-sensitive commodity products and where workers are particularly vulnerable. Against this challenge, we analyse a successful intervention against modern slavery in a place that has been labelled the “ground zero of modern slavery in the US”. The Fair Food Programme was established in the tomato growing industry in Immokalee, Florida, and is based on an innovative joint action between farmers, buyers, and workers. We use an agent-based model built on qualitative field data to explain the success of the programme and to investigate whether the programme could be successfully transferred to other contextual settings. We model several market structures and measure the time it takes for all actors in the system to join the Fair Food Programme after a shock event (such as a case of modern slavery being discovered) triggered a dynamic of joint action. Our model shows that a high heterogeneity in farmer sizes leads to an increase in the time taken for them all to join the Fair Food Programme, while a high heterogeneity in buyer sizes speeds up reaching the tipping point towards joint action. We discuss these results and their implications for the transferability of the Fair Food Programme as a voluntary, incentive-driven approach towards tackling modern slavery, to other locations and contexts.

Abstract:This paper seeks to identify the barriers that prohibit the detection, prevention and remedying of modern slavery incidents in supply chains. A conceptual model is developed that draws on literature on supply chain risk management and barriers to modern slavery. 22 semi-structured stakeholder interviews were conducted to examine common challenges. We distinguish between barriers at different levels – macro, supply chain and organisational – and before and after a modern slavery incident happens – pre-incident and post-incident phases. New barriers emerged in the pre-incident phase, including disparities in terminology, a lack of global law, and limited power in the supply chain; and in the post-incident phase, a lack of remediation frameworks emerged. Modern slavery is notoriously difficult to research as companies fear exposure, and we make a novel contribution by collecting primary data from 22 stakeholders engaged in the management of modern slavery.

Abstract:In this commentary paper, the current state of research on the tightly connected and bi-directional relationships among modern slavery, environmental degradation and climate change is critically assessed and reviewed. An emerging branch of research has begun to conceptualize linkages between slavery and environmental change. Responding to a gap in the extant literature, this paper synthesizes and makes sense of this emerging research base and proposes a future research agenda for exploring the slavery–environment nexus. Through an exploration of 19 key texts which explicitly examine the relationship between slavery and environmental change, spanning across diverse disciplines and spatial scales, we draw out two key arguments that can be adopted in proposing a future research agenda. Firstly, we identify the sectoral emergence of the nexus, forming primarily around four key sectors: (i) Fisheries, (ii) Fields, (iii) Forests and (iv) Factories. The review suggests that a sufficient exploration of slavery–environment linkages needs to transverse these sectoral boundaries. Secondly, the paper highlights the bi-directional interactions among modern slavery, climate change and environmental degradation. Accordingly, we argue for a holistic lens which explores how slavery practices and environmental change are continually shaping one another. Existing research has provided initial understandings of the relationship among modern slavery, environmental destruction and climate change. However, there remains considerable scope for the connections between the three to be further interrogated and unpacked. Based on the review, the paper sets out three key research agendas, highlighting the need to move beyond a spatially and sectorally confined exploration of slavery–environment interactions towards an integrated and sophisticated interrogation of the nexus. Additionally, we propose the future examination of the deep underlying drivers of slavery–environment interactions and to situate these within contemporary capitalist social and economic relations.

Abstract:Is modern slavery in the Thai fishing industry effectively suppressed through multilevel supply chain governance? This paper elaborates on existing theory concerning governance synergies, then analyzes how labor governance, exerted at multiple levels within and across the supply chain, affects modern slavery. Exposing the motivations, capabilities, and methods used by different actors in response to the publicization of slavery in the Thai fishing industry, we aim to understand better how their interactions may deter the abuse of workers' rights. Adopting a phenomenon-based approach and engaging with systemically identified academic and grey literature, we detail several key responses to revelations about modern slavery by a range of actors—private, public, and social—focusing particularly on the role of multinational enterprises as lead firms. We find that, despite significant achievements to date, opportunities still exist for key governance actors, multinational enterprises in particular, to drive further remedial change in the Thai fishing industry. We conclude that misalignments in governance objectives should be redressed through synchronized supply chain governance. This requires states to take advantage of their capability to ensure international norms are given expression in national cultural institutions, thereby aligning and coordinating the disparate efforts of governors in the public sphere, civil society, and the private sector.

Abstract:Abstract The purpose of this article is to problematise a particular social transparency and disclosure regulation in the UK, that transcend national boundaries in order to control (modern) slavery in supply chains operating in the developing world. Drawing on notions from the regulatory and sociology literature, i.e. transparency and normativity, and by interviewing anti-slavery activists and experts, this study explores the limitations of the disclosure and transparency requirements of the UK Modern Slavery Act and, more specifically, how anti-slavery activists experience and interpret the new regulations and the regulators’ implementation of the regulation. This research found limited confidence among anti-slavery activists regarding the Act’s call for transparency in relation to the elimination of slavery from global supply chains. The research also found that the limits of the transparency provisions within the Act appear to hinder the attainment of normativity. This study provides new and unique insights into the critical role that social activists play in exposing the lack of corporate transparency and failures of responsibility to protect workers within global supply chains.

Abstract:‘Modern slavery’ describes various forms of severe relational labour exploitation. In the realm of global value chains and global factories that are led by multinational enterprises, modern slavery encompasses practices such as forced labour and debt bondage. Multinational enterprises organise and orchestrate global value chains into global factories that are highly adaptive to market pressures and changes in the external environment. We employ the global factory framework to conceptualise when and how global value chains become more vulnerable to modern slavery. We argue that combinations of the three global value chain characteristics: complexity, appropriation arrangements, and obligation cascadence, jointly form an environment in which modern slavery can evolve and take root. The degree to which forms of modern slavery become visible and recognisable depends on the particular combination of these characteristics. External factors can moderate the relationship between these factors (e.g. involvement of non-governmental organisations) or exaggerate their effect (e.g. a pandemic).

Abstract:Abstract Transparency lies at the heart of most modern slavery reporting legislation, but while publication of statements is mandatory, conformance with content guidance is voluntary, such that overall, corporate responses have been poor. Existing studies, concentrated in business to consumer rather than inter-organisational contexts, have not undertaken the fine-grained assessments of statements needed to identify which aspects of reporting performance are particularly poor and the underlying reasons that need to be addressed by policy makers. In a novel design, this study utilises the ethical trade initiative assessment framework to evaluate the content of 95 UK government suppliers’ modern slavery statements. The findings suggest that in a modern slavery context, discovery challenges are more important than firms’ attitudes to disclosure. We contribute to the transparency literature through a model contrasting discovery costs and disclosure risks and by identifying the disclosure of unknowns as an additional relevant dimension of disclosure. We then discuss the model in relation to normativity theory to consider options through which the currently low legitimacy of the reporting governance regime can be enhanced and the intended norms established.

Abstract:Modern slavery is used to describe forms of coercive labor exploitation that affect more than 40 million persons globally. Such practices are difficult to identify given they exist in the informal economy, and involve vulnerable individuals. Addressing modern slavery by organizations requires awareness of its context and complexities. While corporations have increasingly sought to manage modern slavery risk in their supply chains, their understanding of what modern slavery is and what should be managed remains limited. We argue a key problem with firms' efforts to manage modern slavery risk is that it is a psychologically distant concept for them. We apply construal level theory to explore how organizations' psychological distance from modern slavery risk affects their management of risk. We interviewed purchasing executives at 41 global organizations in Australia, Finland, and the U.S and identified four approaches to managing modern slavery risk at different levels of psychological distance. We also identified that conflicts between organizations' approaches to risk and what they identify in their operating environment, precedes important construal shifts that help to improve organizational understanding of labor-related risk. We highlight ways that organizations' understanding of modern slavery risk plays a role in their governance of such risk in supply chains.

Abstract:This paper offers best practice guidance on participatory action research (PAR) methods in modern slavery studies, through sharing the experiences of survivors of modern slavery as active project consultants. By using participatory approaches and engaging in an action learning set model, this paper aims to understand how to meaningfully engage survivors of modern slavery as co-researchers. Inclusion was at the heart of this research study, and thus, this paper was co-produced by survivors of modern slavery. Through their voices, and by engaging in reflexivity, we share the challenges of engaging in meaningful peer research methods, lessons learned as well as the benefits of adopting this approach to provide creative, engaging and empowering opportunities for participation in research and skill development. We share some examples of challenges and successes in our approach to understand what meaningful peer research methods look like, addressing conservative and more liberal views including academic expertise, safeguarding and empowerment. In concluding this paper, we provide some recommendations for best practice, recognising a continual need to reflect and adapt peer research approaches that suits the needs of the peer researchers as well as the subject to be studied. The overwhelming sentiment, is that social science research must look to engage in peer research methods, recognising the expertise of lived experience, and the potential for research to empower others while also creating meaningful change.

Abstract:The effective implementation of the SDGs requires coordinated action among governments, the private sector, civil society, and other stakeholders, along with comprehensive mobilization of financial, technological, and human resources. It is crucial to integrate economic, social, and environmental aspects to achieve the objectives of the 2030 Agenda. This qualitative article, utilizing literature review and document analysis, examines challenges and progress related to SDG 8 fulfillment in the Brazilian context, identifying factors impacting the effective eradication of slave-like labor and proposing potential strategies to achieve these goals. The targets of SDG 8 (Promoting sustained, inclusive, and sustainable economic growth, full and productive employment, and decent work for all) have regressed in Brazil and worldwide. Forced labor, exploitation, and precarious working conditions persist, necessitating the implementation of stricter laws, strengthening of monitoring mechanisms, and a unified commitment from all involved actors for the effective eradication of this abhorrent practice.

Abstract:Environmental, social, and governance (ESG) standards do not permit complicity in modern slavery, human trafficking, or child labor (Principles for Responsible Investment [PRI] 2021, 4). And yet, the breadth and depth of oppressive labor practices in US and global corporate supply chains is, in a word, staggering. Across industry and geographic boundaries, throughout corporate America and the world, modern slavery, human trafficking, and child labor support a myriad of goods and services produced, supplied, and consumed daily. The coffee you drank this morning; the car in your driveway; the shirt, pants, dress, or shoes you’re wearing; the phone in your hand and computer on your desk; the salad you might have had yesterday and the shrimp you may be served tonight; the hotel room prepared for your recent night’s sleep and chocolate on your bedside; the mask you’ve been wearing because of Covid-19—all may have been grown, harvested, mined, sewn, or assembled, in part, by adults and children, some as young as four or five, compelled to work unwillingly under threat of bodily harm, torture, or even death.Modern slavery, human trafficking, and child labor, which we label for this paper “oppressive labor”, is a global societal problem demanding a strong public reaction from responsible investors. Investing in companies harvesting oppressive labor is neither ethically nor morally responsible, contravenes fundamental notions of social justice contained in modern ESG standards, and may result in disappointing financial performance in those companies found to be so engaged. Investors wishing to follow ESG best practices should disinvest from companies whose supply chains are linked to oppressive labor practices. We construct oppression-free portfolios with acceptable tracking errors to four popular indexes.
'One of the greatest injustices of our time': The impact of social representations of modern slavery in the UK—A mixed methods approach

Abstract:This study aimed to examine how social representations of modern slavery and immigration become entangled in newspaper media. 2672 UK newspaper articles were collated from 2013 to 2022 and analysed using Content Analysis (Descendant Hierarchical Classification) and Critical Discourse Analysis (CDA). Two themes and corresponding extracts were identified from the content analysis output and analysed using CDA allowing for the exploration of the role of the hegemonic social representations to understanding how discourses of modern slavery are reproduced through the othering in relation to ethnicity and migration. The two themes that emerged were 'Leading the way in tackling slavery' and 'Making claims.' The themes combined showed how the media and political discourse positioned the UK government as leading the way in tackling modern slavery. Simultaneously, discourses criminalized migrants and constructed them as the source of social harm, and the obstacles to resolving the social injustices were those opposing anti‐immigration legislation. These two contradictory positions have implications in how modern slavery is understood by the public. More worryingly, it could lead to silence from victims due to the threat of being criminalized.

Protecting people with communication disability from modern slavery: Supporting Sustainable Development Goals 8 and 16

Abstract:Purpose: The 2030 Agenda for Sustainable Development identifies the need for inclusive societies and justice for people who experience, or are at risk of experiencing, modern slavery. The primary objective of this commentary paper is to consider current research and practice in relation to the protection of people with communication disability from modern slavery. The paper considers the role of SLPs in developing and disseminating accessible information to help achieve decent work and economic growth (SDG 8) and peace, justice, and strong institutions (SDG 16). Result: This paper considers five areas for protecting people with communication disability from modern slavery: (1) accessible information, (2) advocacy, (3) rights-based approaches, (4) improved understanding about access to services, and (5) education. Practice examples are discussed across each of these areas, with a focus on accessible information. Conclusion: This commentary asserts that information about modern slavery must be accessible so that people with communication disability experience inclusion, safety, and justice. SLPs are well placed to implement communication strategies, such as accessible information, to help protect people with communication disability from modern slavery. This commentary paper focuses on SDG 8 and SDG 16 and also addresses SDG 1, SDG 3, SDG 4 and SDG 10.

Abstract:It is an appalling reality that about 50 million people worldwide live under the constraints of modern slavery conditions, such as forced labour, worst form of child labour, debt bondage, servitude and deceptive recruitment and so on. In Australia, the federal government has launched the Modern Slavery Act 2018 (Cth), which sets mandatory criteria for an applicable entity to issue a modern slavery statement. However, there is a clear absence of actionable guidelines for companies to follow, in order to assess and address risks of modern slavery within their value chain. Ambiguous legislative requirements have resulted in poor monitoring that, ultimately, does not effectively help eradicate modern slavery from Australian supply chains. In order to address this gap and provide a practical tool for organisations to combat modern slavery, this article employs a case study to demonstrate how to conduct effective on-site audits to mitigate modern slavery risks through the supply chain. A set of critical factors and potential solutions to remove barriers are discussed.

Abstract:Given increased awareness about modern slavery in supply chain management (SCM), this paper undertakes a systematic literature review (SLR) covering 106 published articles. We first carry out a descriptive analysis, with results showing that modern slavery research is on an upward trajectory but suffers from a lack of primary data and theory application. We then extract themes from the published articles and use them to provide theory elaboration of Gold et al. (2015) model of modern slavery in SCM. Specifically, we introduce business culture and high impact risk factors like pandemics as new institutional factors; highlight external stakeholders like recruitment agents and audit firms as integral to understanding the business context of modern slavery; and add prevention and remediation to detection and response as discrete categories in managing modern slavery risks. We also discuss the gaps in modern slavery research in supply chains. Finally, we propose that reshoring, industry 4.0 and supply chain collaboration represent SCM specialisms that can inform modern slavery research going forward.

Abstract:Even though global supply chains are (usually unintentionally) tied to slave labor, research and practice have largely ignored the issue. This is expected to change as civil society activism and new legislation increase the risk of litigation and reputational damage to supply chain partners. To deal with and combat modern slavery in the supply chain, a theory inspired social supply chain management framework consisting of indicators and countermeasures of modern slavery in the supply chain is developed. The framework is refined in a qualitative expert interview study. The theoretical framework is then evaluated by a multimethod empirical analysis that includes a multicase study based on publicly available supply chain data from 6000 media articles and company websites as well as a quantitative empirical study based on survey data from 280 corporate sustainability experts operating in global supply networks. The results show that economic, political‐legal, social, and environmental factors have a significant impact on contemporary slavery in the supply chain. The study also motivates supply chain partners to use preventative and detective measures to reduce the probability of encountering modern slavery actions in their supply chain. Theoretical and managerial implications are drawn from the findings, pointing to a holistic approach to combatting modern slavery in the supply chain.
