Abstract:Utilization of the marine natural resources without protecting the marine environment may disseminate hazardous effects on the marine life. Under the United Nations Convention on law of the Sea (UNCLOS), state parties bear general obligation to protect and preserve the marine environment. Responsibility of protecting the marine environment has also been imposed by a number of international environmental and human rights conventions, mandated by the United Nations. Therefore, states are collectively responsible to safeguard the marine environment. Inclusion of environmental protection provisions, into the Joint Development Agreements (JDAs), was previously being neglected by the states, but as to the up-to-date practice, various states have been showing their commitments to protect and preserve the marine environment by including environmental protection provisions into the Joint Development Agreements. However, some states are still reluctant to include environmental protection provisions into their JDAs. This paper tries to examine the efforts made by different state parties regarding the protection and preservation of marine environment under the scope of joint development agreements. Moreover, this paper draws the attention of costal sates towards the best practices set by various countries in their joint development cooperation mechanisms aimed at protecting aquatic environment in disputed waters. Abstract:Several disturbing issues pose a threat to the marine environment and its wellbeing, among them marine environmental pollution and degradation of marine biodiversity. Most troubling is that these issues are overwhelmingly caused by human activities which are sometimes transboundary, and their consequences will become more severe and complicated if not properly curbed. Thus, these activities require comprehensive policies, laws, and principles to manage them effectively. Linked to these solutions is the need for responsibilities, cooperation and commitments at local, national, regional and international levels. Contemporary Marine Environmental Law and Policy presents a thorough appraisal of the main issues, actors and institutions engaged in the legal aspects of marine environmental conservation. Abstract:The law on marine environmental protection is a branch of the law on environmental protection and is the basis for the conduct of marine environmental protection. Since its promulgation in 1982, China's Marine Environmental Protection Law has undergone two revisions and three amendments, forming a legal system based on the Constitution, with the Environmental Protection Law as the overarching principle, the Marine Environmental Protection Law as the core, and various laws on the protection of marine elements as the gripping force. The revision of the Marine Environmental Protection Law in 2023 was based on the 2018 supervision and inspection of the enforcement inspection team of the Standing Committee of the National People's Congress, the implementation of the construction of a strong maritime country, and the adaptation to the reform of the ocean governance system. Compared with the previous Marine Environmental Protection Law, the improvements of the newly revised law are mainly reflected in the following: optimizing the institutional mechanism, reflecting the Land and Sea Coordination, strengthening supervision and management, strengthening marine litter pollution prevention and control, enhancing the protection of marine biodiversity, strengthening the regulation of estuaries, and strict liability.

Abstract:The marine economy has become an increasingly important contributor to the global economy due to advancements in science and technology and humans' growing ability to manipulate nature. As a country with a vast marine territory, China has the important responsibility of utilizing marine resources rationally and promoting sustainable development of the marine economy. Since the introduction of the Marine Environmental Protection Law of the People's Republic of China (MEPL) in 1982, China has made significant progress in strengthening the legal framework for marine environmental protection. MEPL has undergone several revisions to improve its legal content under the guidance of national policies. On October 24, 2023, the Standing Committee of the National People's Congress revised and adopted MEPL again. This paper analyzes the changes in the contents of the new law and the legal background at home and abroad while integrating the domestic and international legal backgrounds. This paper provides an in-depth analysis of the changes made in the new law, summarizes the revision ideas, and examines the new law in the context of domestic and international laws. The aim is to provide a clear understanding of the spirit and purpose of the legislation.

Abstract:Abstract International marine environmental law has found its primary sources in international legal principles and conventions. At the regional level, some organisations prefer soft laws as their main instruments for regional marine environmental protection. This article proposes that coastal states could use soft law instruments in the South China Sea ( scs ) region to protect the marine environment through robust institutional processes, addressing environmental degradation concerns against a tense geopolitical backdrop. Based on discussions of regional practices, this article proposes that scs coastal states could strengthen their regional cooperation efforts using the existing soft-law structures by strengthening implementation cooperation through specific and targeted measures.

Abstract:The coastal zone has become one of the areas with the most serious environmental problems and has concentrated conflicts between land development and protection in China. It is the choice of many countries to regulate and balance coastal resource utilization and environmental protection by legal means. However, China has not yet issued comprehensive legislation on coastal zone management at the national level, while some coastal provinces and cities have enacted local legislation. This study first systematically reviews China's coastal zone management legislation at both the national and local levels, paying particular attention to those laws enacted in the past decade and subsequently looks into the core regimes adopted in China's coastal zone management. From the perspective of achievements, the legislative framework of China's coastal zone management legislation is relatively complete, with increasingly diverse legislative subjects and increasingly refined legal provisions, providing a strong normative basis for coastal zone management. Nevertheless, existing legislation also faces challenges such as insufficient systematization, inefficient coordination mechanisms and incomplete legislative content which impact the practical effectiveness of coastal zone management legislation. Based on China's national conditions, this study proposes two suggestions for future improvements. On one hand, in terms of legislative principles, coastal zone legislation should embody a concept of integrated management and establish substantive principles of systematization, protection priority, prevention and precaution, justice and equality while following the principle of non-contradiction in legislative form. On the other hand, in terms of legislative content, the institutional system of China's coastal zone management legislation should be further improved in four aspects, namely, optimizing the coordination mechanisms, introducing incentive mechanisms, strengthening public participation, and improving climate change countermeasures.

Abstract:This article examines marine environmental civil public-interest litigation landscape in China based on a comprehensive empirical study of 216 cases adjudicated from 2015 through 2022. Marine environmental civil public-interest litigation is under robust development in China with the number of cases increasing and high-profile cases emerging. Many cases were built upon related criminal and administrative proceedings and the procuratorate, as a qualified plaintiff, has led in initiating litigation. The liability system is maturing with flexible remedies and a high plaintiff win rate. First-instance judgments were rendered effectively and alternative dispute resolution was used. Besides the notable progress deserving attention, there are still several obstacles yet to be overcome, such as the divergence in the categorization of cases, the application of law and the attitude towards the standing of environmental NGOs. Besides, the number of cases initiated by marine environmental supervision and management departments is relatively small and jurisdictional matters also need to be further clarified. A feasible approach to overcome these obstacles is to come up with a set of systematic and coordinated rules in this field either by releasing specialized judicial interpretations on marine environmental public-interest litigation or by revising the existing Marine Environmental Protection Law when appropriate. By this means, it could potentially optimize the system of marine environmental civil public-interest litigation and enhance its efficacy in protecting the marine environment and resources.

Abstract:The International Maritime Organization (IMO) plays a significant role in global marine environmental governance, providing a forum of regulatory oversight for member states. Member states are the main actors of the IMO and exert considerable influence on the process of lawmaking. Among these member states, China is unique due to its multiple identities. There are various factors influencing interests behind China’s multiple identities, which fully engage the country in various shipping and maritime trade activities. This article examines China’s role in the IMO marine environmental regulatory governance. It identifies the impact of China on global ocean governance and indicates the development and reforms in the global governance system. China enacted the China Ocean Agenda 21 for its strategy of ocean development. Thus, China is the object of study in this examination of empirical research that collects submissions from 2001 to 2020 related to marine environmental governance. The findings reveal that the extent to which China participates in such governance has considerably increased, and although the contribution of China’s submissions is still in development, its role in the IMO is no longer merely that of a follower, and the efforts of the country have had a positive influence on the IMO’s marine environmental regulatory governance, including its legal instruments.

How to effectively measure the criminal law protection of the marine ecological environment and take effective measures Measures to deepen the effects of marine ecological environmental protection have become one of the focus topics of widespread concern in the industry. Based on this, this article first introduces the protection of marine ecological interests in China's criminal law, analyzes the necessity of adjusting the ecological environment in criminal law, and discusses the deficiencies in China's marine legal system and combines relevant practical experience to improve the marine environment. Abstract:Abstract China’s role in the international maritime transport industry is undeniably growing: the country has become the second-largest ship-owning nation, its maritime ports are ranked among the top globally, and its national maritime transport company, COSCO Group, is ranked 4th among major shipping companies. However, its current legal framework is behind the commercial practices of the maritime transport industry and its operators. With both the evolution of China’s position on the global stage and the emergence of new judicial maritime practices, a revision was inevitable, particularly as China aims to build itself into a maritime power. Although the revision of the Maritime Law was included in the 13th National People’s Congress agenda for the period from 2018 to 2023, the revised Law has not yet been promulgated but is expected in near future. While the reform project focuses solely on the Chinese Maritime Law, China’s new ambitions could turn this moment into an opportunity to overhaul and rethink the role of Chinese maritime law in the current global context. Whether by modernizing its maritime law while maintaining its existing structure, or by rethinking its entire approach, China should consider the legal experience of current maritime powers, such as France, which could serve as a valuable source of inspiration for Chinese legislature in the future.

Abstract:Beaches, as a subset of coastal environments, can generate great economic values. Among various beach management strategies, laws and regulations are one of the most powerful tools, yet they are often overlooked. In China, where all beaches are public or community-owned, this study reviews the existing institutional instruments related to beach management at the national, provincial, and urban levels, including current laws, policies, and the latest 14th Five-Year Plans. Of the 127 laws and regulations identified (comprising 18 national, 53 provincial, and 56 urban ones), many lack clear definitions, adequate protection for beach-dune systems, and efficient enforcement mechanisms. This study analyzes these gaps and challenges, further suggesting improvements, such as, rectifying the legal status deficiency of beach resources, emphasizing the protection of the integrated beach-dune system, refining restricted "lines" demarcation, and improving enforcement ability. Through comprehensive analysis and practical recommendations, this study provides a roadmap for enhancing China's existing legal framework, urging for the enactment of national and local specialized legislation to protect vulnerable beach resources. It further underscores the importance of robust legislative measures in achieving long-term sustainable environment protection and development goals. These findings are expected to contribute to the improvement of beach management not only in China but also provide meaningful insights for global coastal nations and regions.

Abstract:Marine pollution and ecological damage seriously undermine economic and social development and human life and health and threaten the sustainable development of human society. With the rapid development of industrialization and urbanization and the intense exploitation of marine space and marine natural resources, China's marine ecology is facing serious problems such as pollution of marine waters, the decline of marine plant and animal resources, and the impairment of the ecological function of coastal zones. China's marine environmental public interest litigation (MEPIL) has achieved remarkable results in protecting marine natural resources, safeguarding the marine ecosystem, and preventing marine pollution and ecological damage. The paper closely combines the judicial practice of Chinese MEPIL, exploring 339 legal cases brought by administrative organs, public prosecutors, and non-governmental organizations (NGOs) presented on the China Judgment Online from 2018 to 2023. It can be concluded that three modes of MEPIL, namely civil, administrative, and civil public interest litigation incidental to criminal proceedings, have been constructed. Attempts have been made to confirm the standing of the litigation, improve the pre-litigation procedure, and clarify the types of compensation. However, significant obstacles exist in China's MEPIL. Theoretical clarifications and practical distinctions with other types of proceedings should be made. The current standing should be improved regarding procuratorial organs, administrative authorities, and social organizations. Court jurisdiction systems need to be enhanced. Inconsistencies in the legal provisions on whether MEPIL cases must be under the exclusive jurisdiction of the maritime courts have impeded the efficiency of the handling of cases. The corresponding solutions to the aforementioned obstacles are also analyzed. Clarifying the MEPIL's nature and improving the relevant laws, and regulations, are essential measures. In addition, providing the explicit interpretation of the legal provisions, expanding the standing, and improving the jurisdictional and other legal system should be explored.

Abstract:China has emerged as a global economic powerhouse after four decades of unprecedented growth. Such growth has generated many environmental challenges with enormous ecological, socioeconomic, and health consequences in China and beyond. Although the overall quality of air and water is starting to improve, both are still below national and international standards. Water shortages are widespread. Biodiversity continues to decline. China is the world's top CO2emitter, although per capita emissions are much lower than those of developed counties. On the positive side, large national conservation programs have been implemented, including the Natural Forest Conservation Program, the Grain-to-Green Program, Ecosystem Functional Conservation Areas, and Ecological Protection Redlines. More than 2,750 nature reserves have been established and a new national park system is being constructed. Some endangered and threatened species, such as the giant panda, are showing signs of recovery, and forest cover and some ecosystem services have increased. These mixed environmental outcomes result from human-nature interactions within China as well as between China and adjacent and distant countries. These include increasing rapid economic growth, resource consumption, land use change, trade and investment, and conservation and development policies. We suggest systems approaches such as nexus approaches and flow-centered governance to help China achieve ecological civilization and become an environmental leader on a metacoupled planet.

Abstract:The protection pattern of typical marine ecosystems is an overall summary of the regional marine ecosystem protection, indicating the protection status of typical marine ecosystems. The coastal waters of China and ASEAN countries have a highly diverse range of ecosystem types, including mangroves, coral reefs, and seagrass beds. The need to protect these ecosystems is urgent, but establishing marine protected areas often involves conflicts with stakeholders highly dependent on these ecosystems. By constructing an analysis model of the protection pattern and driving mechanisms of typical marine ecosystems, with a focus on the China-ASEAN region, this study aimed to analyze the characteristics of typical marine ecosystems protection patterns in China-ASEAN, evaluate the current protection status of these ecosystems, discuss the driving factors, and derive a regression function to clarify the quantitative relationship between the protection pattern and driving factors of typical marine ecosystems in the China-ASEAN region. The results indicate that there are four main driving factors influencing the protection pattern of typical marine ecosystems in China-ASEAN countries. The most significant driving factor is the Natural Geographic and Resource Factor, followed by Urbanization, Industrial Structure, and Population Size and GDP Factor. Among these, the Natural Geographic and Resource Factor and the Industrial Structure Factor have a positive impact, while the others have a negative impact. In the future, it is crucial to fully consider the diversity and distribution of marine ecosystems to promote joint efforts among China-ASEAN countries in protecting marine ecosystems through international cooperation.

Abstract:Land and sea are closely intertwined in coastal areas; however, the governances thereof are in isolation, which may lead to complex conflicts that threaten coastal sustainability. The development of marine economic functions is inseparable from the land. Further, most maritime activities also extend to land, thus exerting impacts on local social and economic development. As such, China considers land and sea as integral entities and promotes land-sea coordination (LSC) through territorial spatial planning. This is one of the pioneering attempts in the world to compulsorily promote the integration of land and sea at the national level. Therefore, this study combs the policy background of LSC development and summarizes that the key challenges of LSC in the context of the new round of land and space planning are the determination of planning scope, the connection of the evaluation system, and the coordination of management. This study analyzes the local experience from the perspective of practice to deal with these challenges and proposes three directions for optimization for further research. In this way, LSC could be a sound framework to integrate land and sea sections for the optimal allocation of resources and eco-environmental protection.

Abstract:The 1982 United Nations Law of Sea Convention” signed by more than 150 nations went into effective on 16 November 1994, and has brought about great changes in peoples’ sense of oceans. According to some provisions of the Convention, great changes take place in the ranges of jurisdictional sea areas and the ownership of marine resources and rights and interests of maritime nations and also in the resources and rights and interests of the international waters of all the countries in the world. Since the Convention entered into force, the international maritime order has been greatly restructured, and the new concept “sea land” comes into being. Oceans have become the focus of world attention. People get more and more aware that the 21st century is an era of ocean. The authors introduce the aims and contents of the Convention, expound principles adopted by China and the neighboring countries, declare the development of marine economy of China and the developed countries, and describe contents, forms and characteristics of the marine integration management.

Abstract:A holistic approach to ocean governance in mainland China has yet to be fully developed and thus, improved. In terms of marine legislation, mainland China should concentrate on this neglected aspect, to formulate a “Coastal Bill.” Additionally, a comprehensive functional-zoning-based “Oceans Bill” should be suitably drafted, on the basis of the current, “Law on the Administration of the Use of Sea Areas.” In terms of marine administration, the State Oceanic Administration should be transformed into a department, which would be responsible for coordinating the scattered central marine administrative bodies and the relationship between the central and local governments in terms of marine affairs. In terms of marine law enforcement, mainland China could start with the establishing of a coordinating body to improve the communication and cooperation of the marine law enforcement bodies and gradually build up an integrated body, enforcing laws at sea. The most recent development in China is the establishment of the “blue economic areas,” which put together all the maritime sectors within specific areas. A “joint-up” effort is subject to further observation and would be expected in the forthcoming future.
