Abstract:Многообразие форм осуществления контрольно-надзорной деятельности, в качестве основной по-прежнему выступает проверка. Проводимые проверки могут быть плановыми и внеплановыми, осуществляться в выездной либо документарной форме. Экономико-правовая практика свидетельствует о том, что нередки случаи обхода положений закона, когда отсутствуют основания проведения проверки. Сравнительный анализ позволяет сделать вывод о схожести предметов плановой и внеплановой проверок в части соблюдения обязательных требований и требований, установленных муниципальными правовыми актами. Однако, согласно логике законодателя, предмет внеплановых проверок шире, чем плановых, что обусловлено спецификой их природы. Согласно статистике, доля внеплановых проверок с каждым годом увеличивается. Более того, риск-ориентированный подход в данном случае не применяется, поскольку такие проверки являются реакцией на какие-либо уже свершившиеся события или поступившие жалобы и, чаще всего, не имеют своей целью предупредить наступление вреда в будущем. Такой подход не согласуется с идеей превентивного контроля, имеющего на практике больший эффект. Economic and legal practice shows that there are frequent cases of circumvention of the provisions of the law when there are no grounds for conducting an audit. Comparative analysis allows us to conclude that the subjects of scheduled and unscheduled inspections are similar in terms of compliance with mandatory requirements and requirements established by municipal legal acts. However, according to the logic of the legislator, the subject of unscheduled inspections is broader than planned, due to the specifics of their nature. According to statistics, the share of unscheduled inspections is increasing every year. Moreover, the risk-based approach is not applied in this case, since such checks are a reaction to any already accomplished events or complaints and, more often than not, are not intended to prevent the occurrence of harm in the future. This approach is inconsistent with the idea of preventive control, which in practice has a greater effect.
