Abstract:The article carried out the analysis and systematisation of the criminal law provisions aimed at ensuring transport safety. The author draws attention to the fact that such norms are contained in both the General and the Special parts of the criminal code. The article analyses various concepts of transport security for the possibility or impossibility of their use in criminal law. It is argued that the norms of the Special part of the criminal code can be divided into two groups – regulating crimes in which transport security or its components are included in the main direct object; and regulatory crimes in which transport security or its components are included in an additional direct object (mandatory or optional). The article substantiates the allocation of "related" crimes that indirectly affect transport security. Abstract:The relevance of the study is predetermined by the current situation in the locations of seaports, terminals and port facilities, in view of the need and expediency of ensuring and maintaining a state of protection against acts of unlawful interference. The article reveals the basic concepts, analyzes the factors and threats affecting the level of transport safety, and investigates the system and procedure for the implementation of legal norms regulating the legal relations inherent in the research area. The attention is focused on the problematic aspects of the transport safety implementation, regarding which the ways of improving the legislation of administrative and legal regulation of transport safety in the Russian Federation are proposed. There are gaps in the conceptual apparatus, which negatively affects law enforcement practice. Fixing the term fully reflecting the aspects of maritime transport security will eliminate the problem and the gap in interpretation, and will assist in concretizing the terminology as well. The imperfection of the content of Article 11.6 of the Code of Administrative Offenses of the Russian Federation provides prerequisites for the commission of offenses of both minor severity and those that can be qualified as actions that create a threat of committing an act of unlawful interference on protected objects of transport infrastructure, objects of the fuel and energy complex, which can entail serious consequences.

Abstract:Legal analysis of inland waterway transport security and transport safety is of theoretical and practical importance. The following issues are relevant: uniform interpretation of the terms used in the Russian legislation what concerns ensuring security, in general, and transport industry, in particular; systematizing multiple entities aimed at providing and participating in the protection and defence of river transport facilities and infrastructure; improving preventive mechanism of protection from unlawful interference acts. The growth of accident rate entails the need to refine the current administrative law mechanism. The research goal is an attempt to work out proposals aimed at improving protection effectiveness of river traffic of passengers and hazardous goods. The objectives of the research are to conduct a legal analysis of the legal framework designed to ensure the safety of inland waterways and transport safety on inland water transport; to systematize a variety of definitions used while regulating safety issues. Based on the analysis, the author singled out the following types of inland waterway transport security: navigation security, and security of inland waterways and their infrastructure. The fact there are no legal norms regulating transport security in the Inland Water Transport Code of the Russian Federation testifies to the lack of both comprehensive security and the stipulated legal mechanism that can be used to protect this type of transport from various types of threats, including acts of unlawful interference. In order to boost the security of vessels and river ports, the author suggests to add the transport security passport of a ship to the documented system of measures used to manage ship security; to review the mandatory requirements established to ensure the safety and transport security of vessels in order for such demands not to overlap and not to impose unreasonable burden on business entities; to compare control and supervision activities on inland water transport by objects of protection in terms of navigable hydraulic structures.

Abstract:The article is devoted to the analysis of factors and threats to the economic security of passenger motor transport enterprises. It is shown that ensuring economic security in transport is an essential part of ensuring the economic security of the state. In this regard, it was revealed that the interaction of state and territorial authorities in solving this issue should be aimed at ensuring the sustainable development of the transport complex, providing assistance and support at all stages of the activities of motor transport enterprises. The list of such measures should include ensuring a favorable investment climate in the regions, maintaining a fair competitive environment in the passenger road transport system, developing and implementing long-term financing programs for motor transport enterprises, developing and implementing special credit products for transport business entities. A classification of external and internal threats is presented, the timely prevention of which will contribute to uninterrupted and high-quality work. Economic security in the field of transport depends on many factors. The main ones include such as the state of economic security of the region, the state of transport infrastructure facilities and the state of the vehicle fleet. The study revealed a close correlation between the factors of the external and internal environment of motor transport enterprises that affect the economic safety system: their consideration in the construction of control algorithms and the development of strategies will contribute to improving work efficiency. Within the framework of the article, based on the analysis, a set of measures was proposed to improve the economic security of the motor transport system: the development of transport infrastructure; updating the industry fleet; increasing the level of transport security; increasing the level of interaction between state authorities and transport industry entities.

Abstract:The subject of the study is the norms of international law regulating the activities to ensure safety during the transportation of oil and petroleum products. Special attention is paid to the protection of the marine environment from pollution. The author analyzes the international legal documents regulating the protection of the marine environment during the transportation of oil and petroleum products by sea, the existing mechanisms to prevent the occurrence of possible accidents. Recommendations are given to improve the level of marine environment protection during the extraction and transportation of hydrocarbons. It is shown that liquefied natural gas has a number of environmental, commercial and energy advantages over other types of fossil fuels. Since a common cause of accidents that entail oil and petroleum product spills is the wear and tear of the equipment used in various cycles of production and transportation of both oil and LNG, it is concluded that proper monitoring of the technical condition of the equipment in operation, improvement of the legal framework in this area, as well as compliance with the requirements of legislation in order to identification of objects whose condition poses a threat to the environment. It is noted that a special role in preventing the negative impact on the state of the environment during the transportation of petroleum products belongs to regional agreements on the protection of the marine environment, since in this case the issue has a more substantive character for each region. The article discusses various directions of using artificial intelligence to increase the level of safety of international sea transportation of hydrocarbons.

Abstract:Despite the awareness of the importance of digital transformation of highways as the basis for life safety, social and economic development of the country, the issues of technical, legal and financial regulation of the digitalization of the transport complex at the federal and regional levels, a detailed assessment of the impact of digital technologies in transport on social and economic processes in modern Russian society. In the Russian doctrine in recent years, research has been carried out in general on the formation and development of the digital economy in Russia, in which intelligent transport systems are mentioned pointwise and only in general terms without their comprehensive analysis. Based on the assessment of the current state and trends in the development of info-communication transport infrastructure in Russia, foreign experience, potential problems of the implementation of digital technologies in transport in the socioeconomic and legal dimension were identified, specific proposals were formulated on the legal and financial regulation of issues and minimization of the risks of liability for harm in conditions development of information transport systems. The role of the programs “Digital Economy of the Russian Federation” and “Safe and High-Quality Roads” in the development of intelligent transport systems has been analyzed, and as a result, promising areas for the use of unmanned vehicles to improve the quality of life of people, develop entrepreneurship, high-tech industries, and increase the investment attractiveness of Russia have been identified. and strengthening its position in the international arena. The study used the following methodological principles: objectivity; determinism; historicism; integrity; consistency; structure; functionality; hierarchy; pluralism of explanation and understanding of law; comparative studies. The study uses private methods: legal analytics, legislative techniques, legal comparative studies, expert assessments. As the main results of the study, the features of the legal regulation of new and promising relations arising in the digital economy have been identified. This is a strategic legal planning and legal experiment. Taking into account this conclusion, a system of prerequisites for the development of intelligent transport systems was formulated based on the analysis of national programs. The system of prerequisites includes three levels: technological prerequisites, infrastructural and regulatory.

Abstract:The study aims to analyse problems associated with the legal regulation of the transport system. The study is based on the international and domestic ranking of logistics performance. It also takes into account the economic consequences of world internationalisation to optimise logistics performance (this includes the transportation and legal aspects) under the Transport Development Strategy of the Russian Federation until 2030. The study relies on a systematic approach to systematise legislative, economic and social information and thus create an integral system of transport communication. The review of the legal regulation issues surrounding the transport system showed the following supply chain problems: weak policy coordination and a low level of digitalisation. These problems result in low-quality service and low transparency in legal matters. According to the results of this study, the integration of the world’s best practices into transport communications will improve economic efficiency. The scientific novelty of the study is a practical tool to improve transport system efficiency in the context of globalisation, considering the characteristics of the national economy.

Abstract:Based on scientific sources and practical experience, the article examines the issues of ensuring national security in the field of drug trafficking using IT technologies. The subject of the study is some features of the identification, disclosure and investigation of crimes related to illicit trafficking in narcotics and psychotropic substances carried out using IT technologies and the Internet. The object of the study is the social relations arising in the process of ensuring national security during the fight against drug crime on the territory of the Russian Federation. The author examines in detail such aspects of the topic as the specifics of the detection and disclosure of crimes committed in the field of drug trafficking, as well as the fixation and seizure of digital traces of crime. Special attention is paid to the use of modern technologies in countering drug trafficking using IT technologies. The main conclusions of the study are: ensuring national security in the field of drug trafficking using IT technologies is impossible without qualified employees of the relevant departments of the Ministry of Internal Affairs of Russia and providing them with modern technical means of detecting, fixing and removing digital evidentiary information; the need to identify and disseminate positive experience in combating illicit trafficking of narcotics and psychotropic substances; development and implementation of effective methods and algorithms of actions of law enforcement officers in various operational and investigative situations in practical activities to combat drug trafficking; improvement of the regulatory framework governing the organization of national security in the field of trafficking in narcotics and psychotropic substances.

Abstract:The article analyses new elements used and planned to be used in security systems at railway transport facilities and proves the possibility and necessity of adapting them to all modes of transportation. Basing on the analysis, the authors propose prerequisites for creation of an integrated information transport system providing end-to-end access to information about passengers, seers-off and welcomers at all the modes of transport and throughout the country. It is also suggested that the end-to-end integrated information transport system include such elements as the unique genomic information of every passenger, welcomer or seer-off. The authors also consider feasibility of implementing a risk-oriented management system to provide automated solution of tasks of identifying, analyzing and forecasting probability of negative consequences of risky managerial solutions in the case of non-compliance or violation of safety precautions.

Abstract:Abstract In the context of economic development, considerable attention is paid to environmental safety. Ensuring environmental safety is one of the most important components of any practical activity, including at transport enterprises. In the Russian Federation, as in most countries with developing economies, environmental protection belongs to the administrative methods of regulation. The main function of the country is environmental supervision. The main task in ensuring environmental safety requirements is the formation and constant development of the environmental protection system at transport enterprises. The article presents the main directions of the impact of transport on the environment and considers the causes of its pollution. The necessity of a systematic approach in solving management tasks for environmental protection and increasing the economic efficiency of transport companies has been substantiated. It is proposed to consider the systemic relationship of production processes, elements, their components, and environmental components in the formation of management decisions at transport enterprises. The authors pay special attention to measures for the legal protection of the environment in the activities of transport companies, the reduction and prevention of negative environmental management.

Abstract:The problem of ensuring the safety of navigation remains acute in maritime transport, which is one of the key issues in international trade. To implement the safety of navigation, the world community is taking steps to unify international standards, enshrine international law in national legislation, as well as strengthen the requirements for technical means of navigation. Despite the constant development of methods, techniques and technical means of safety, several thousand ships crash at sea every year, so this article is intended to highlight some aspects of international legal regulation of shipping safety. This problem has long crossed the boundaries of national and international. The main object of maritime safety, of course, is the ship as the main participant in maritime transport. The factors that pose a threat to a ship are different. This includes both weather conditions and the human factor, and the technical characteristics of the vessel. The issue of maritime safety is of a fundamental nature, and the key difficulty for its optimal solution is to distinguish between the very concept of "maritime safety" and ensuring shipping as such, ie its functional efficiency. Shipping, in the modern world, has occupied a huge niche in trade, economy, and in the transportation and service of passengers. That is, this process serves to meet the cultural, economic, scientific, recreational and other needs of mankind. Therefore, maritime safety must be ensured by both economic and legal aspects. And also for this it is necessary to create appropriate conditions for the transportation of various cargoes, for the comfort of passengers, to ensure the deployment and the necessary functioning of the navigation system, which will allow ships to follow the most profitable route with maximum safety. Given the above, this article analyzes a set of international legal standards, maritime customs and maritime practices designed to ensure the safety of navigation.

Abstract:Intelligent transportation systems will play a key role in the smart cities of the future. In particular, railway transportation is gaining attention as a promising solution to cope with the mobility challenges in large urban areas. Thanks to the miniaturisation of sensors and the deployment of fast data networks, the railway industry is being augmented with contextual, real-time information that opens the door to novel and personalised services. Despite the benefits of this digitalisation, the high complexity of railway transportation entails a number of challenges, particularly from security and privacy perspectives. Since railway assets are attractive targets for terrorism, coping with strong security and privacy requirements such as cryptography and privacy-preserving methods is of utmost importance. This article provides a thorough systematic literature review on information security and privacy within railway transportation systems, following the well-known methodology proposed by vom Brocke et al. We sketch out the most relevant studies and outline the main focuses, challenges and solutions described in the literature, considering technical, societal, regulatory and ethical approaches. Additionally, we discuss the remaining open issues and suggest several research lines that will gain relevance in the years to come.

The main aspects of transport accessibility (accessibility of territories, objects of transport infrastructure, vehicles, transportation services) are identified. Qualitative characteristics that should be reflected in the standards of transport service are established. The definition of «accessibility of public urban transport services» is proposed as property of a city’s transport system to allow an unlimited range of individuals to travel and to carry permitted hand luggage and baggage in accordance with the terms of a public transportation contract for a passenger and with the conditions of a transport license issued to a carrier, mandatory legal requirements for the carrier, as well as with standards and rules accepted and declared by the carrier. Abstract:At the present stage of logistics infrastructure development, many different barriers that have a negative impact on the entire process of cargo transportation appear. Since each stage of cargo delivery is part of a single logistics chain of transportation, interruptions at any stage entail nonfulfillment of contractual obligations by the transport company. In the work, the main focus is on the study of the causes of obstacles to the transportation of cargo. As a rule, the reasons under consideration have a technological or legal nature of occurrence. For technological reasons, we understand the negative processes associated with the organization of transportation, namely: the construction of economically unprofitable cargo delivery routes; the wrong choice of transport, as well as the incorrect construction of the logistics chain in general. The legal reasons for the transportation of cargo are related to the commission of various kinds of offenses by people involved in the process of cargo delivery, which entail negative consequences for transport companies. In turn, law-enforcement agencies are obliged to respond to certain offenses committed at all stages of cargo transportation. Therefore, legal barriers associated with the toughening of the procedure for checking goods appear, which affects the timing of their delivery.

Abstract:The article is dedicated to the consideration of factors influencing the state of the situation in Russia in the field of detection and repression of the smuggling of narcotic drugs, psychotropic substances, their precursors, and analogues. In the methodological field it is an analytical research based on documentary, close to legal hermeneutics. Specifically, thearticle analyses Russian legislation, offers options to solve problems in the field of smuggling narcotic drugs, psychotropic substances, their precursors, and analogues. The authors consider the real problems of countering the drug threat, which is currently a serious obstacle to the development of the state. By way of concluding the nature and magnitude of the negative consequences, illicit trafficking in narcotic drugs, psychotropic substances, their precursors, and analogues can be classified as direct threats to national security. Today, the issues of countering the illegal circulation of narcotic drugs, using modern information technologies, improving mechanisms to convert goods obtained from illicit drug trafficking into state revenue are relevant.

Abstract:Considering the criminal law situation in ensuring economic security, the authors pay attention to the need for the state to develop and introduce into the law enforcement activities effective mechanisms to ensure strategic national interests. Based on the analysis of statistical data and the results of various academic studies, a general description of the criminal legal situation in economic security in criminalization and decriminalization, penalization and depenalization is given, and the trend of its development is determined. We pay closer attention to the role of forming a public opinion about implementing criminal policy in ensuring economic security that objectively responds to the existing threats from economic crimes. On the one hand, this shows the insufficiency of the measures taken by the state in assessing the criminal law situation. On the other hand, these data are influenced by social and media factors, as well as the ongoing administrative reform. The authors highlight the features of legal regulation of the law enforcement agencies' activities in the goals and objectives of the criminal policy set for them in ensuring economic security. It is noted that reliable prognostic information makes it possible to implement the wording of high-quality criminal law rules. The content of the criminal legal situation under consideration made it possible to assess the actual state of protection of the country's economic sphere and the quality of counteraction to economic crimes. The analysis of the amendments in the Criminal Code of the Russian Federation over the past decade shows that one trend in modern criminal law reform is a return to the previously known construction of the elements of economic crimes with administrative prejudice. The main vector of criminal policy aimed at increasing the level of economic freedoms, exclusion of the facts of unjustified and illegal prosecution of entrepreneurs in case of nonfulfilment of contractual obligations and the reference of these disputes to the administrative and arbitration spheres has been set. The authors' view on the criminal and legal situation in ensuring economic security gives a full picture of its state and further prospects in resolving the most key issues of the theory and practice of activities in countering economic crimes.

Abstract:The article considers the transport industry, which is of great economic and social importance for the country. The social role of transport determines the specifics of market transformations, as well as the spatial accessibility of territories, the quality, standard of living and mobility of the population, the movement of goods and services, and the country's economic activity in foreign markets. A new trend in the development of the transport services market is the international multimodal container transportation. Increasing the efficiency of multimodal transportation is possible today due to the optimization of the system of interaction between the modes of transport used and the direct transportation of goods, cost reduction, optimization of the operation of cargo terminals, the formation and development of a network of transport corridors, the use of new satellite navigation capabilities, reduction of environmental load and fuel economy. Reviewing Russian and foreign studies in the field of multimodal cargo transportation, the authors considered existing approaches of the term multimodal transportation, highlighted the features of multimodal international transportation, compared various transport modes in the transportation process, investigated methods of improving the efficiency of multimodal transportation and criteria for their evaluation.
