Quantitative Legal Research Based on China's Adjudication Documents: the End of the Golden Era?

Abstract:This article quantitatively examines the development of quantitative legal research based on court adjudication documents in China. The disclosure of massive adjudication documents after the 2009 open trial reform paved the way for quantitative legal research in China. Recent years have seen a surge in quantitative legal research published in Chinese core social science journals. While making notable progress, existing quantitative research reveals three major deficiencies: selective disclosure, inaccurate data extraction and encoding and endogeneity problems in causal inference. A radical shift in the Chinese government's attitude towards adjudication document disclosure suddenly came in 2021. Nevertheless, quantitative legal research would continue to develop, featuring more efficient data processing and more complex method selection. The disclosure of huge-scale data, resulting from government digitalisation reform and the reform of open government data, tends to create new and stronger momentum for the future development of China's quantitative legal research.
