Abstract:Inside information is the core of insider trading.Therefore,establishing the standards of securities inside information is the key to defining the act of insider trading.The standards of confirming inside information should include three major elements:non-publicity,preciseness and materiality.Such standards in our country appear to be impeccable but defective actually:non-publicity is too general;preciseness is still unestablished;materiality is comparatively vague.The reconstructive standards possess the same elements but need to be reified:non-publicity and preciseness from the perspective of a qualitative screening as well as materiality from the perspective of the scope.Non-publicity should adopt the form combined with substance asking for period of market impound;preciseness should emphasize the importance of information source and content;materiality should choose the more practical criteria of ″rational investors″ at present.

Abstract:Regulations on Open Government Information of the People's Republic of China prescribe that "may not disclose government information" involves state secrets,commercial secrets or individual privacy.While state secrets are totally non-discloseable,commercial secrets and individual privacy may be disclosed by administrative agencies with the consent of the rightholders or if administrative agencies believe that non-disclosure might give rise to a major impact on the public interest.Furthermore,state secrets and commercial secrets should be defined according to the Maintenance of State Secrets Law and the Anti Unfair Competition Law,but individual privacy should be defined on a case.Last but not least,to accurately define the aforementioned conceptions helps to implement Regulations on Open Government Information of the People's Republic of China.

Abstract:This article aims to evaluate whether the e-government development in China is ready to adopt contemporary public administration principles. In response to these questions, we propose an evaluation framework that integrates the contemporary public administration principles and current web-quality evaluation theories. The proposed framework evaluates government portal websites in terms of their content, function, and construction, following the theory of website evaluation. The indices for each of these dimensions emphasize interactions, transparency, efficiency and effectiveness, all of which reflect the contemporary public administration principles. The validation analysis shows that the proposed evaluation framework well fits the data. The empirical studies suggest that China has implemented advanced e-government services.

Abstract:Digital reform has become a major policy measure amid the once-in-a-century great changes.Data elements have also become an important driving force for high-quality economic development in the era of digital economy and government data opening is one of the key variables of digital reform. The core content of government data opening is unified with the connotation of innovation-driven development strategy,which is a major policy innovation and practice. The main connotation of government data opening is to realize the dual attribute value of“factors of production”and“factors of governance”of government data. Government data opening enables innovation-driven development through such mechanisms as innovation boundary extension,innovative ecological integration,human capital agglomeration and administrative efficiency improvement. On the basis of clarifying the theoretical explanation,internal logic,actual progress and key sticking points of government data opening and innovation-driven development strategy,this paper discusses the practice path of government data opening enabling innovation-driven development and put forward five suggestions including establishing and improving the institutional guarantees,promoting deep participation of enterprises,universities and research institutes,optimizing policy guidance and assessment mechanism,strengthening coordinated development among regions and improving government data governance capacity,so as to inject new momentum into China’s efforts to achieve high-quality economic development and build a modern socialist country in an all-round way.
Evaluating Government Portal Websites in China.

Abstract:Government portal websites are the core components of e-Government because it is a platform integrating different government resources. This article was devoted to study the government portal websites in China in order to disclose the development status of e-Government in China. In order to do this, two questions are answered: from which aspects should government portal websites be evaluated; how to develop the indexes for different aspects of government portal website evaluation. In our solution, we aligned the evaluation of government portal website with new public administration principles so that government can provide better services to the users because new focuses of public administration bring new strategies for e-Government. The proposed framework emphasizes content, function, and construction of government portals. The validation analysis showed that the proposed evaluation framework is well fitted. 30 major cities’ government portal websites in China are evaluated. The results suggested China has implemented advanced e-Government services such as e-democracy but the performance of those services is not appreciated by the user very well.

Abstract:The Open Government Information Regulation requires government information open to public,the ambivalence of openness and secret keeping reflected in the regulation itself and the inadequacy of judicial protection of individual right to know are huge challenges to the open government information system.Logic contradiction and conflict of legal provisions between open information system and secret - keeping system,together with the weak role of courts in reviewing agency action with respect to government information openness creates both institutional barriers and harsh environment for an open government.This paper analyzes those challenges and calls for reforms of secret - keeping system and a more active role of courts in the context of open government information context.

Abstract:Objective: This paper focused on Being Made Known to The Public upon Applications and Open Health Administrative License Information, analyzed the behavior characteristics of public demand and government action.Methods:A cluster sampling was applied to select all 356 files of applications during 2009-2012, and there was a group interview of 15 staff members working in government organs.Results:Forms of provision according to application were timely and convenient, could satisfy the basic needs of public demand.But some content and language of reply directly quoting original legal text were abstract and obscurity decreased the satisfactory of applicants.Conclusion:The disadvantages of its indefinable languages of the legislation on Open Government Information caused ambiguity .Definitions and scope of Government Information should be more clearly defined by legislative explanation and judicial explanations.When directly quoting original legal text to reply, earthliness languages should be added in order to convenience-for-people.

Abstract:Both service management practitioners and academic researchers have traditionally recognized the major influence that online service quality has on customer online and off-line behavior. Chinese government have recently shown an interest in their Web site service quality, especially, when the amount of Chinese netizen grows faster. The present study has two primary objectives, firstly, to investigate the dimensionality of service quality in a governmental Web site-related context, secondly, to explore the relations between governmental Web service and customer satisfaction. The former objective is undertaken by factor analysis, while the latter by regressive analysis. The results show that the governmental Web service quality has two dimensions, namely, service result quality and service process quality. The former has three factors: tangibility, assurance and reliability, while the latter has two factors: responsiveness and empathy. They both affect customer satisfaction obversely

Abstract:The scope of information disclosure is directly influenced by scope of state secrets.In current framework,due to such factors as legal hierarchy,the relation between special laws and general laws,the new laws and old laws,and difference of accountability,the application of OGI is strictly confined by Law of People’s Republic of China on Guarding State Secrets,which leads to conception secrecy is principle and disclosure of information is exemptionin practice.In United States,the mechanism of objection to classifying secrets and relative judicial review is key factor in successfully implementing FOIA.There still exist many problems and defects in our mechanism of objection to classifying secrets in terms of its institutional framwork and procedure design,which needs to be amended on whole.Through perfection of such mechanism and relative judicial review,the relationship between guarding secrecy and disclosure of information could be radically changed,and conception the openness is principle and guarding secrecy is exemptioncould come into being and be carried out.

Abstract:The openness of governmental information is of crucial importance to a government when facing an emergency or an event that will lead to serious consequence and going to deal with it.If the openness comes true,a government will do better in keeping social order and safeguarding public security,guaranteeing people's right to information,containing effectively the rumor spreading and,eventually molding the public image for itself.Nowadays the governments at different levels in China have made progress to a certain extent in this regard though some problems are still to be solved urgently,such as that some governments are reluctant to play the role of source in information opening,no sufficient supports given from legal system,lack of authorized department to release the information on emergencies,improper information control system for emergencies and,especially,the media often play the part instead of a government spokesman to release news/information on emergencies.To solve those problems,it is necessary to lead the media to guide well the public opinion to which the government shall function as the source of information,and the openness of governmental information shall be enhanced lawfully.
