Abstract:With the enlargement of the European Union (EU) and the economic expansion of China, bilateral trade between the EU Member States and China has experienced noticeable growth. With the increasing number of EU small and medium enterprises entering the Chinese market, their inexperience in trademark protection may hamper their business development in China. Despite China's effort to strengthen its legal framework and enforcement power for trademark protection, its record remains less than fully satisfactory in the opinion of much of the international community. In this article, we present some common forms of trademark infringement in China and discuss some of the complexities of legal and institutional conditions and linguistic factors. We also provide recommendations to tackle these issues.

Abstract:As in most civil law countries, registration is the only way to acquire trademark rights in China, and the protection of unregistered marks remains a marginal issue. However, companies always have considerable interests in the protection of their unregistered commercial signs. Problems with trademark piracy and passing off regarding unregistered trademarks in China have drawn attention throughout the world. Besides the absence of spontaneous market order, defects in the current trademark and competition law systems are the main reasons for this problem. The bona fide principle, as incorporated in the PRC Trademark Law, is applicable only to piracy of those trademarks that have been used in China and are known to the relevant public. The action of passing off in the PRC Anti-Unfair Competition Law does not cover unregistered trademarks as it stands, and they can only benefit from this protection by being disguised as a product name, packing or decoration. The protection of well-known trademarks is nearly unavailable because the fame requirement is too high. The last revision of the PRC Trademark Law improved the current regime by enlarging the scope of application of the bona fide principle in trademark law. However, we still need to give a clear status to unregistered trademarks in anti-unfair competition law, and Chinese courts should lower the fame requirement in the recognition of well-known trademarks.

Abstract:Traditionally, trademarks convey source information to consumers through the use of words, letters, or numerals. The types of signs that are nowadays considered as being capable of constituting a trademark have expanded beyond words or figurative devices. Although non-traditional trademarks have received wide acceptance in many jurisdictions, the hurdle for obtaining registration appears to be higher than for traditional marks. Two issues have figured predominantly in the debate over protection for non-traditional marks: distinctiveness and functionality. Applications for non-traditional trademarks in China have given rise to a number of judicial decisions. The jurisprudence in China has taken a cautious approach in making decisions on a case-by-case basis, depending on the kind of mark in question. After a brief introduction to non-traditional marks, section 2 interprets the trademark definition in the China Trademark Law and reviews the extent to which non-traditional marks might be protected under the existing laws. Sections 3, 4, and 5 present a comprehensive and systematic analysis of the functionality and distinctiveness issues for three-dimensional marks, colour marks, and sound marks. Finally, the Conclusion highlights the main problems in the protection of non-traditional trademarks and proffers solutions for analysing distinctiveness and functionality issues for non-traditional marks.

Trademark Trolls In China: Reasons And Solutions Of The Serious Market Disturbing Problem

Abstract:In recent years, trademark trolls have become a serious problem that disturbs the Chinese market. Though trademark trolls are concomitant with the trademark registration system, their overspreading in China is due to particular social and legal factors: the proactive trademark protection policies which value trademark certificates over the goodwill of trademarks that have developed over time; damages, in recent years, to trademark infringements which have increased drastically in an unjustified manner; and, trademark infringement dispute settlement procedures before administrative and e-commerce platforms that are inequitably favorable to trademark holders. The Chinese legislature and courts, cognizant of the seriousness of the problem, have started to take measures against trademark trolls. The 2013 Chinese Trademark Law permits prior legitimate users of a trademark to continue its use within the initial scope even if the trademark has been registered later by a third party. Further, the 2018 Chinese E-Commerce Law doubled the amount of damages granted to the victim in cases of bad faith complaints on e-commerce platforms. The Chinese courts have qualified the existence of trademark trolls as an abuse of rights or unfair competition, an understanding which may give rise to liability against trademark troll entities. In addition, a declaratory judgement of non-infringement is available if the victim simply needs to get rid of the uncertainty or risk in the face of threats from trademark trolls. Finally, the victim can also file an opposition or invalidation action in cases of trademark squatting by trademark troll entities.

Abstract:The paper attempts to investigate the issue of the protection of non-traditional trademarks in the People’s Republic of China that is ranked first in the number of registered trademarks in the world. The author analyzes the national legislation on the registration of trademarks that permits the registration of such types of non-traditional trademarks as sound, color combination and a three-dimensional designation, as well as judicial practice on appealing decisions of the National Trademark Office of China to refuse registration of three-dimensional, color and sound trademarks. The author determines the criteria for the protection of non-traditional trademarks, analyzes their application to each type of such marks. The paper highlights the main problems of registration of non-traditional trademarks in China. A conclusion is drawn about the need to improve legal, including international, regulation to stabilize and simplify the protection of non-traditional trademarks in the world.

Abstract:Chinese trademark law has established the cross-category protection system of well-known trademarks based on the confusion theory. The system, however, has many problems in practice and does not fulfill completely the needs for protecting well-known trademarks. Consequently, when hearing trademark cases, some judges have abandoned the confusion theory instead of using the dilution theory in judging well-known trademarks. Through analysis on 100 judgments concerning well-known trademark cases, it can be seen that the influence of the dilution theory on the ruling of trademark cases is increasing. Certain conditions should first be satisfied when introducing the dilution theory to rule trademark cases: Firstly, the contents of the dilution theory shall be grasped as correctly as possible to avoid plausible understanding; secondly, the application of the dilution theory shall adopt the existing institutional criteria as much as possible by full use of the leeway of interpretation provided by the existing system.

Abstract:With the constant advancement of the economy and technology, especially the development of high-tech technology, the traditional trademark can no longer meet the needs of social and enterprise development. From traditional visual trademarks to three-dimensional trademarks, sound marks, and even scent marks, non-traditional trademarks are playing an increasingly important role in transactions. Therefore, the legal protection of non-traditional trademarks is particularly important. By collecting and reading the relevant references and materials, this paper adopts the methods of literature analysis, comparison method, and case analysis to analyze of Legal protection of non-traditional trademarks from a global perspectivetaking scent trademarks as an example. The paper points out the current situation in the protection of non-traditional trademarks, taking scent marks as an example, and puts forward some feasible suggestions, such as: Reference the "staff " representation method, Promoting scientific and technological progress, and Scent branding prompts in the product. It can be concluded that the registration and protection systems of scent trademarks in various countries are not perfect, they can be shown in the strict requirements for registrable trademarks regarding the representation of odor, the distinctiveness of trademark registration, and the functional of marks. Countries should pay more attention to them. The study suggests that it is necessary to improve the scent trademark legislation, which is conducive to better protection of intellectual property rights, encourage innovation of enterprises, and safeguard the interests of enterprises.

Abstract:In the United States and European countries,fair use of trademark includes both 'descriptive fair use' and 'nominative fair use'.Article 17 of the TRIPS Agreement is the source of international law for fair use of trademarks.It does not limit members from providing other kinds of fair use of trademarks besides 'descriptive fair use'.The current Trademark Law in China has its shortcomings on fair use of trademark.'Nominative fair use' cannot be found in laws or regulations.'Descriptive fair use' is only provided in administrative regulation.In that Regulation,'Descriptive fair use' can be used only in registered trademark and trademark for goods.China's Trademark Law should be modified as far as fair use of trademark is concerned.

Abstract:We investigate how firms and markets adapt to trademark protection, an extensively used but underexamined form of IP protection to address asymmetric information, by exploring a historical precedent: China’s trademark law of 1923. Exploiting unique, newly digitized firm-employee and firm-agent datasets from Shanghai in 1872–1941, we show that the trademark law, established as an unanticipated and Western-disapproved response to end foreign privileges in China, shaped firm dynamics and relationships on all sides of trademark conflicts. Western firms with greater dependence on trademark protection grew and raised brand investment, while Japanese businesses, most frequently accused of counterfeiting, contracted despite attempts to build their own brands. The trademark law also fostered relationships with domestic intermediaries, both within and outside the boundaries of Western firms, and the growth of the Chinese intermediary sector. At the market level, the trademark law did not reduce competition or raise brand prices, leading to a coexistence of trademarks and competitive markets and ultimately gains in consumer welfare. A comparison with previous attempts by foreign powers—such as extraterritorial rights and bilateral treaties—shows that the alternative institutions were broadly unsuccessful.

Abstract:In China's judicative practices of the Anti-unfair Competition Law, the theory of a general clause has been commonly accepted by courts in confirming many types of unfair competition, which have a common characteristic, i.e. unfair imitation or utilization of the business achievements of others. The protection of these business achievements is based on reasonable arguments: The business achievements must satisfy three conditions —— being not protected by laws of intellectual properties, having some distinctness and being, to a certain degree, well-known on the market. Imitation or utilization of the business achievements must have special unfair circumstances.

Abstract:Trademark Infringement of Original Equipment Manufacturer (OEM) is an important issue in the China (Shanghai) Pilot Free Trade Zone. Such trademark infringement disputes arising from conflicts between the foreign client with foreign trademark rights and the domestic trademark owner with a similar trademark on the same or similar goods are arguable since the so-called “infringement” barely results in confusing or misleading the relevant people. However, court verdicts on this issue have been inconsistent. Furthermore, the customs department’s approach in determining infringement of OEM has been restricted by the narrow scope of interpretation of the relevant provision in the trademark law. Stemming from the differing approaches taken by the courts and the administrative authority, this article attempts to trace the root of the problems and suggest viable solutions.

Abstract:In Michael Jeffery Jordan v Chinese Trademark Review and Adjudication Board, the Supreme People's Court (SPC) set a precedent for foreign companies and celebrities enforcing their rights of publicity against malicious trademark registration in China. This article introduces the legal grounds of the SPC's deliberations on Jordan's claims and responds to the critiques of most Chinese commentators in the field of civil law. Deeply influenced by German law, mainland China's legal system strictly distinguishes between personality rights and property rights. Comparative analysis with the US, Germany, Japan, and Hong Kong indicates that different legal civilizations have developed different approaches to position the right of publicity logically in their legal systems. The Jordan decision indicates that the ‘right of the name’ is a prior right provided in Article 32 of the Trademark Law of the PRC. This article contends that the ‘right of the name’ as provided in the Chinese Anti-Unfair Competition Law differs from the ‘right of the name’ articulated in Article 110 of the General Principles of Civil Law (2017). The former concerns the commercial interest and property aspects of a celebrity's name, which is fairly similar to the right of publicity, while the latter regards the personality right. The further development of the right of publicity protection relies in mainland China on a consistent judicial practice.

Abstract:The legal origin of the right on registered trademarks shall be viewed from the perspectives of administrative law and civil law. In administrative law, the act of office registration does not confer the exclusive right to trademark applicant, but just partially verifies the validity of the trademark application. According to civil law theories, the juristic act of trademark application is the cause of the right on registered trademarks and registration is a condition affecting the validity of the application. In the trademark registration procedure, examination has no essential significance by nature because it does not verify all the conditions of validity on trademark application; it's the publication of trademark application that constitutes an indispensable formal condition for the creation of trademark right, a right in rem.
