Abstract:The institutional reform of land property rights is confronted with various challenges from all aspects of the economic and social lives in the current stage.The original property reform theory does not agree with the current practical requirement of land use and management.How to fully reflect the political,social,organizational and juristic nature of land property right in the newly-formed concepts of land property reform and its institutional innovation,and further provide a trajectory for future reforms in China,are the main purposes of our theoretical research.It needs to combine together the theories of economics and sociology to analyze related issues.The four-level-social-analysis framework proposed by Williamson provides a good logic to link property right with resource allocation,sociology with economics.Through such a logic,a comprehensive analysis on the nature and the assessment of Chinese land property can be achieved,which can further provide a theoretical basis for the trajectory choice of the current land property reform.The analysis offers scientific references for the new-round of land property reform in China.

Abstract:It is important to develop and open the urban land market after the China′s entry to WTO.After analyzing the current situations of land market in Wenzhou city,the paper suggests that the government should indicate the types of land which are allowed to transact in the open market. The proposed policies are to control the total supplies of urban land,to encourage the users of fomer assigned land to transact land use rights in open market by different ways,and to perfect the taxation of urban land,etc.

Abstract:The contradiction between people and land is a major problem during the development of Chinese agriculture and national economy. Under the general background of China's entry into WTO and agricultural structure readjustment, it is imperative to attain dynamic equilibrium of farmland by land development and cultivated land protection. The scarcity of land, rent theory, harmony between people and land, dynamic equilibrium and system engineering are the guidelines for land development. The inadequacy of reserved land resources requires strengthening of land protection and sustainable use. It is strongly suggested that strict implementation of general land use planning, transformation of cultivated land protection concept, emphasis on sustainable development, clearance and stabilization of land property rights system and better management of land development project be adopted.

Abstract:In the process of adapting to the challenges raised by accession to WTO,China fulfilled several important reforms,including returning to the world system,transforming to market economy,promoting rule-of-law,discarding the closed-door policy,altering traditional litigation notion and other political-legal culture.Meanwhile,China commenced to reflect the nature,function and trend of WTO,recognizing WTO as an international organization aiming at improving world peace,which is constitutional-construed,rule-oriented and judicially governed.WTO is not only the fruit of the world system,but also the sign of its evolution.For a decade,there are series of great changes of WTO and the whole world including China after it attained WTO membership,and China will amend domestic and global strategies accordingly.The new strategies may conclude coherent four parts which are changing from economical accession to legal accession,from opening-up improving reform to reform improving opening-up,from power-oriented policy to justice-oriented policy and from permissive response to positive dominance.

Abstract:During the period of the first 10 years after China＇s accession into the WTO,China made great efforts to reform IP system under the TRIPS Agreement so as to response the challenge of economic globalization,which have three key characters,i.e.,combination of implementation of international obligations and domestic situations,balance between IP holders＇ rights and public interests,development oriented by National IP Strategic for the new century.It is suggested that China shall continue reforms of IP system in order to promote IP competition with the consideration of global trend of development to strengthen the IP enforcement and to harmonize IP system.

Abstract:To increase agricultural production and secure the food supply for its 1.2 billion people, China selected a policy of far-reaching state intervention and the introduction of some market economic principles. For joining the WTO, China is committed to open its domestic markets, cautiously, to international competition. An initial step in doing this has been the reduction of import tariffs on primary agricultural products. This paper reports the results of cost analysis for six important commodities to test the international competitiveness of Chinese agriculture. The results suggest that opening markets reducing protection by joining the WTO will have multi-layered effects on the development in Chinese agriculture. In particular, China's WTO accession will have a braking effect on the production growth at least in the short term. To improve the competitiveness of Chinese agriculture, the government should eliminate the present system-induced disadvantages such as the delivery quota system and the farm structure through a further land reform. This could encourage regionalisation of Chinese agricultural production based on comparative cost advantages. Adoption of new agricultural technologies through strengthening "green box"-measures is of critical importance for increasing agricultural productivity and improving the competitiveness of Chinese agriculture.

Abstract:To increase agricultural production and secure the food supply for more than 1.2 billion people, China selected a policy of far-reaching state intervention and the introduction of some market economic principles. By establishing the tariff rate quota system for several sensitive commodities and reducing their import tariffs, China is prepared for joining the WTO to open its domestic agricultural market to international competition. This paper reports the results of cost and price analyses for six main commodities to test the international competitiveness of Chinese agriculture. It showed that Chinese crop production at present is not international competitive as a whole. The results suggest that opening markets by joining the WTO will have multi-layered impacts on the development in Chinese agriculture. Especially in the short term, China's WTO accession will have a braking effect on the crop production. To improve the competitiveness of agriculture, the study recommends that the Chinese government should eliminate the present system-induced disadvantages such as the delivery quota system and the farmland system. Moreover, a widespread use of new technologies through strengthening "green box"-measures is of critical importance for increasing agricultural productivity in China.

Abstract:Taking China as a "responsible,big and developing country," and bearing the international relation concepts such as "power,interest,justice and idea" in mind,while analyzing China's strategies in WTO,one cannot but conclude:(1) China should positively take part in the law-making process within WTO and try hard to serve as an advocator and organizer;(2) as for the statutory framework of WTO,China should appropriately handle the relation between "absolute gains" and "relative gains";(3) in pursuing international "distributive justice," China should take care to ease the tension between "be" and "ought to be";and(4) in view of her unique status in the WTO,China should bridge the relationship of the countries in the Southern Hemisphere and those in the Northern Hemisphere.

Abstract:Compared with land expropriation compensation system in developed countries,China's current land expropriation compensation system has its flaws on small compensation coverage,low standards and single payment way. It is resulted from planned economy period with distinct marks of planned economy,which denies relatively independent economic interests of economic players. While in the condition of market economy,relatively independent economic interests of economic players have already been recognized,land expropriation compensation system has not been improved accordingly,so that the land lost peasants' benefits are neglected and their basic economic rights cannot be protected. Therefore,this paper suggests that under land public ownership system,peasants should be able to exercise their land property rights,and their basic economic rights and interests get fair treatment. By using foreign practices as a source of reference,we should improve China's current land expropriation compensation system and realize the harmonious society.

Abstract:In the recent years, the adjustments on the economic structure and methods of economic development of China, as well as the continuous strengthened regulations on the natural resources, have been of great concerns in the world. The Raw Materials Case of 2009 is the concentrated Sino-foreign battle for natural resources. The WTO dispute settlement body was unfavorable for China, which may lead to more unfavorable effects on the natural resources policy and legitimate trading rights of China. This article takes the Raw Materials Case as the example, analyzing the main points of the Panel Report and the Appellate Body Report, discussing the burden of proof in the WTO dispute settlement mechanism and the characteristics of disputes concerning natural resources, and providing the legitimate standpoints and countermeasures of China in the future.

Abstract:Abstract. The main goal of the paper is to address the policy changes that accompany China's accession to the World Trade Organization (WTO) and evaluate the various impacts of the agreement. To do so, we review the contours of past policies and describe the nature of the promises it has made to the WTO. We show that China's WTO commitments are very much an extension of past policies. Second, we show that most impacts will be relatively minor and in most cases the positive effects will outweigh the negative ones. Various institutions will buffer producers from suffering too much.
On the Problem of Farm Land Rights in Construction of Harmonious Society

Abstract:Within a GDP index oriented economic development model presently in China, the expropriating and converting process to other than agricultural use of the farmland, which would be developed by some company, is dominated by local governments. Though the farmers are compensated for rendering their lands, they can't benefit much from the increased value thereof constantly perceived in long terms. As a result, the wealth of the farmers is irrelevant to GDP index, thus a tug of war between the minority of capital allies and the majority of farmers would finally arise. According to the Constitution and land regulation law, the title of farmlands belongs to the farmers collectively,and the governmental expropriation objectives must be of public interest. What the local government transfers to a company is merely an exploiting right over a span of time rather than the title of farmlands. A huge gap is resulted between the prices of the land before and after its exploiting right is transferred so as to be converted to an other than agricultural one, where farmers could not get any benefit thereof, and consequently the tug of war registered. One solution thereto is to establish and ensure the farmers' collection rights to the rents on the farmland through legal means.

Abstract:The law of WTO is in coexistence with the WTO as an interna-tional organization, including an“umbrel a” structure of large and complex system of many treaties and legal documents as wel as other sources, and also huge number of schedules on goods and service, the protocols of new Members of the WTO. The interpretation of treaties in WTO dispute settlement is the“living” law of WTO. Many “practices” of the WTO law is also an important part. Critical y rethinking 20 years of the WTO, it could be found that there are advantages such as compulsory jurisdiction and plenty of treaty interpretations, but some disadvan-tages should also be taken into account, such as low efficiency of decision-mak-ing, lacking of wel coordination of RTAs and insufficient remedies of WTO dis-pute settlement. Regarding the idea that the WTO law is the model of internation-al law, the paper suggests that it must be analyzed case by case. China should trust the future of WTO and bear in mind that keeping up domestic reform, in-creasing opening-up and improving the overal national strength wil be the key for China to participate in the new international economic legal order.

Abstract:At present,land-use for agricultural purposes has problems and contradictions that are becoming more prominent.Basically,this is because the subject tends to be void in terms of the land-use property right,the procedures becomes blurred,and so on.Therefore,the power at the township level and below must be limited in terms of land-use management;marketization of land-use for agricultural purposes must be advanced;privatization of land-use for agricultural purposes must be tried on a pilot basis,a reasonable compensation mechanism for land requisition must be set up,and so on,so that land-use for agricultural purposes can really be optimalized to fundamentally solve agricultural land-use management problems.
