Abstract:AbstractWe identify three types of attack on the intellectual property contained in software and three corresponding technical defenses. A defense against reverse engineering is obfuscation, a process that renders software unintelligible but still functional. A defense against software piracy is watermarking, a process that makes it possible to determine the origin of software. A defense against tampering is tamper-proofing, so that unauthorized modifications to software (for example, to remove a watermark) will result in nonfunctional code. We briefly survey the available technology for each type of defense.

Abstract:In this article,combining with scale economy and network externali- ties of software markets,and considering the four kinds of typical market structure of software industry,authors expand traditional monopoly-model,bertrand-model and hotelling-models to study the functionary mechanism of software market struc- ture and software protection.It is indicated by the research that under the influence of the factors such as scale economy,the network externalities and the IP law pro- tection etc,software firms in different markets not only enhance traditional com- petitive means,for example,price competition,product differentiated competi- tion etc,but also adopt different levels of source-code protection to reduce the in- novative cost and raise the product quality,at the same time the Optimal IP Law Protection changes.

Abstract:Recently digital watermarking has emerged as a candidate solution for reusable IP core protection. The key idea of IP watermarking is try to use IP cores as cover media, and hide some digital information (watermarks) in their circuit designs, for intellectual property authentication and infringements tracing. In this paper, we present the basic research framework and survey the recent advancement on IP watermarking techniques. Several typical IP watermarking schemes are evaluated and compared. The technical difficulties are discussed, and future directions are outlined.

Abstract:The common patent management software with simple function, few internet resources and high cost cannot satisfy the domestic enterprise requirement. To fulfill Haier Group's demand, anew method using a platform by integrating patents and knowledge resource on network was proposed to perfect the patent management based on three different models of enterprise patent management: centralized, distributed, matrix. For making the decisions of technology protection strategies, experts should evaluate patents growth economic income of the technological achievement based on the content of the integrated web resources, so enterprise can choose strategies from patent application, technology publicity and technology protection according to different evaluations. Web crawling technology, algorithm of owning patent management and patent applying strategies recommending were analyzed as the key techniques, and a software platform was developed. This platform is being put into practice, which improves the strategy of technology ownership and promotes; the patent management in domestic enterprises.

Abstract:The software protection is the key technology for the shareware and it can delay and prevent the software reverse and cracking. There are many methods such as junk code, anti-debug, virtual machine, deformation, packers, encryption and verification. The software registration is the most important step of protection and it can be implemented by many forms such as network registration, license key or file, dongle. This paper introduces and compares these protection methods. Some architectures of protection based on encryption and verification are provided and they are realized by RSA encryption and many verification methods which include self verification and key data verification. The method use the exe file and DLL file to protect each other and use the license file to check and provide software function. The method uses the RSA in the license key file to register and it can make it difficult to create the key generator for the cracker.

Nowadays, there exist various problems in the protection and management of intellectual property, which lead to numerous losses. Therefore, it is advisable to improve the legal system about the administrative protection of intellectual property rights in hi-tech enterprises, as well as strengthen the intellectual property management system, establish an effective and rigorous system of intellectual property protection. Meanwhile, we should, by employing scientific strategic measures of directing staff to make the most of intellectual property, attaching great importance to patent documents, enhancing innovative ability, implementing patent strategy, as well as forming technology alliance, to protect hi-tech intellectual property rights and make full use of them.

Abstract:In this paper we first analyze the importance of intellectual property (IP) to the integrated circuit IP industry at the industry and firm level. Using detailed data of United States Patent & Trademark Office's (USPTO) database; we find that some countries which own advanced IC technology all have large quantity of IPs, especially invention patents. And successful IC firms in the world mostly benefit massively from IP. In the second section, we trace the history of the world IC industry IP protection, which indicates that the IP and its protection are becoming more and more crucial to the IC industry. Nevertheless, there are fewer independent IPs in China IC industry comparing with some advanced countries; with the development of China IC firms, some overseas firms begin to attack them by patent litigation. China IC industry is now confronted with a troublesome predicament and improvement of the IP is one of the most vital strategic actions for China IC industry. Based on this situation, we propose to establish "Preproduction alliance" for strengthening radical innovation and developing independent IPs of the whole country. Corresponding to different kinds of attacks from oversea firms, we expatiate on several measures to be free or infringements and countermeasures to cope with litigations, which is of great significance for IC firms.

Abstract:We analyze the influence of the rampant piracy activities in Chi- na on the efficiency of patent protection.We conclude that although patent protection was prolonged since 1993,the incentive to input resources to R&D and apply a patent in China didn't increase but decrease,it is because increasing the length of patent protection gives the imitator a greater incentive to pirate the patent,the paten- tee then will be harmed more.Imposing same patent lengths and in- fringing costs on all the industries will be contrary to the principles of optimal patent design.With both patent length and breadth as in- struments,the optimal patent policy consists of imposing more pira- cy cost on those industries with high piracy potential and vice versa by constructing kinds of statutes and regulations.We also comment on the issue about the protection of software protection in China and hold the opinion that it is necessary to provide additional protection for this industry.In some cases,it is a necessity to sue the end user of software.In addition,this paper makes some analysis about seven kinds of commodities which belong to three different types of indus- tries with different piracy characters.

Abstract:The increasing cost of integrated circuit (IC) fabrication has driven most companies to "go fabless" over time. The corresponding outsourcing trend gave rise to various attack vectors, e.g., illegal overproduction of ICs, piracy of the design intellectual property (IP), or insertion of hardware Trojans (HTs). These attacks are possibly conducted by untrusted entities residing all over the supply chain, ranging from untrusted foundries, test facilities, even to end-users. To overcome this multitude of threats, various techniques have been proposed over the past decade. In this paper, we review the landscape of IP protection techniques, which can be classified into logic locking, layout camouflaging, and split manufacturing. We discuss the history of these techniques, followed by state-of-the-art advancements, relevant limitations, and scope for future work.

In order to prevent software from piracy and unauthorized modification, various techniques have been developed. Among them is software watermarking which protects software through embedding some secret information into software as an identifier of the ownership of copyright for this software. Abstract:Purpose The blockchain technology provides a way to record transactions that is designed to be highly secure, transparent, trustable, traceable, auditable and tamper-proof. And, the internet of things (IoT) technology provides the ability to transfer data over a network without requiring human-to-human or human-to-computer interaction, which is able to link computing devices and digitized machines, things, objects, animals and people that are provided with digital unique identifiers (UIDs). This paper aims to explore the combined application of blockchain and IoT-based technologies, especially on the intellectual property protection area. Design/methodology/approach In this paper, the authors propose a high-level architecture design of blockchain and IoT-based intellectual property protection system, which can help to process three types of intellectual property: (1) patents, copyrights, trademarks etc.; (2) industrial design, trade dress, craft works, trade secrets etc.; and (3) plant variety rights, geographical indications, etc. Findings Using blockchain peer-to-peer network and IoT devices, the proposed method can help people to establish a trusted, self-organized, open and ecological intellectual property protection system. Originality/value To the best of the authors’ knowledge, this is the first work that applied blockchain and IoT technologies on traditional intellectual property protection and trade ecosystem.

Abstract:With the continuous development and innovation of science and technology in the current era, at this point, artificial intelligence has been able to generate all kinds of "works" like human beings, which has produced many new intellectual property legal issues in the field of artificial intelligence, which also put forward new legal challenges for its protection. What kind of protection should be given to artificial intelligence products, its copyright, the ownership of the rights of products is the issue of this paper. At present, the author believes that two preconditions should be made clear: first, the "works" of artificial intelligence products are regarded as copyright-protected works from its legal qualitative understanding; Second, the copyright of AI products should be owned by AI investors and users. On this basis, relevant legal protection mechanisms should be established to reduce legal disputes caused by artificial intelligence products.

Abstract:Using the price and output of computer software as a comparing standard when intellectual property rights are effectively protected,we analyze the enterprise and government behaviors and their consequence in China's intellectual property rights protection.We come to the conclusion that the behavior of violating intellectual property rights not only reduces the output of China's software,raises its price,but also reduces China's software developer's profit in China's market.This is just the main reason why developed countries and our country have friction in the problem of intellectual property right about trade.Thinking about short static interest,zero rate of investigation is the best choice when the government pursues to maximize social welfare.The optimum rate of the pirate investigation of the government is the rate in which they investigate the infringement of the intellectual property rights while the marginal revenue equals to marginal cost.Therefore,it is impossible to stop the pirate phenomenon completely,but it can be controlled to a certain extent and level.

Abstract:Advanced industrial countries are affected by technology theft. German industry annually loses more than 50 billion euros. The main causes are industrial espionage and fraudulent copying patents and industrial products. Many Asian countries are profiteering saving up to 65% of production costs. Most affected are small medium enterprises, who do not have sufficient economic power to assert themselves against some powerful countries. International organizations, such as Interpol and World Customs Organization - WCO - work together to combat international economic crime. Several methods of protection can be achieved by registering patents or specific technical methods for recognition of product originality. They have developed more suitable protection, like Hologram, magnetic stripe, barcode, CE marking, digital watermarks, DNA or Nano-technologies, security labels, radio frequency identification, micro color codes, matrix code, cryptographic encodings. The automotive industry has developed the method "Manufactures against Product Piracy". A sticker on the package features original products and it uses a Data Matrix verifiable barcode. The code can be recorded with a smartphone camera. The smartphone is connected via Internet to a database, where the identification numbers of the original parts are stored.

Abstract:Software digital rights management is a pressing need for the software development industry which remains, as no practical solutions have been acclamaimed succesful by the industry. We introduce a novel software-protection method, fully implemented with today's technologies, that provides traitor tracing and license enforcement and requires no additional hardware nor inter-connectivity. Our work benefits from the use of secure triggers, a cryptographic primitive that is secure assuming the existence of an ind-cpa secure block cipher. Using our framework, developers may insert license checks and fingerprints, and obfuscate the code using secure triggers. As a result, this rises the cost that software analysis tools have detect and modify protection mechanisms. Thus rising the complexity of cracking this system.
