Abstract:The term disposal action originates from Wielderholtende Verfugung in German. It means action by agency. It reconfirms law relationship predetermined by previous action but does not yield new legal effect. In China, it first appeared in the Interpretations on the Implementation of Administrative Litigation Law of the People' s Republic of China (Section 1.2). According to this provision, double disposal action which rejects appellation on action by private parities is excluded from litigation. Generally, when an action is done and with final effects, it excludes disposal. It depends on Rechtkraft of action and resjudicata of judicial decision. But under certain conditions, it can restart the procedure. This is the attitude on administrative disposal action by the substance law. Administrative disposal action is excluded from the scope of litigation.
