Abstract:The purpose of this paper is to reveal the market-oriented reform of administration in agricultural land conversion quota through the case of Zhejiang Province.Method of documentation and case study were employed.The results indicate that,in process of agricultural land conversion,local governments act as the primary land developers,while the central government distributes land development rights with the incremental construction land quota system,which fits the land public ownership and the actual conditions of China in the transformation era.However,the rigidity of this system could also bring about many problems.The cases of Zhejiang and other provinces provide a possible way to reform the planning system of allocation in incremental construction land quotas,that is,to link the construction land quota with the amount of cultivated land needed to be maintained,while at the same time,to build a market to regulate incremental construction land quota.It is concluded that quota transference of construction land is a possible way to effectively coordinate the most strict land administration system and market mechanism.

Abstract:This paper analyzes current land grant system in transition development from three perspectives including local financial system,role of land policy in macro-control and property law framework.The results indicate that land grant system has three functions including financial revenue,macro-control and property right,which are embedded in the framework of land public-ownership.Despite of the negative effects of land grant system,we should continue to insist on the institutional framework that municipal or county governments are responsible for state-owned land grant.Under this premise,we should strengthen its role as the foundation of land usufruct rights system with Chinese characteristic,improve and refine their financial and regulatory functions.

Abstract:It is an irresistible trend for industrial and commercial capital to flow to the countryside.Commercial capital into agriculture is a "double-edged sword",which has made the community react strongly.At present the policy has only stipulated several principles,thus lacking rigidity and enforcement.We hold a strong belief that rental of commercial enterprises and usage of farmers' "Family Contracted Land" should be adjusted and regulated through the sound land leasing legal system and the usage of strong legal weapons,and only in this way can we make the prospect of "there're laws to abide by,there're laws to comply with,law breakers must be dealt with" come true.This paper is based on the following points:analysis of the current policy and related comprehensive system,analysis and operation mechanism of legal norms of rental,the existing problems of law.Finally,six aspects of the legal countermeasures and suggestions have been put forward as follows to regulate the rental and usage of family contracted land on the part of the commercial enterprises:clearly define the qualifications of the agriculture-related entities and the conditions for the entry threshold,set up examination and approval system,improve the legal restraint mechanism of "Non-food" and "Non agriculture",lift the mechanism of the leasing contract and reinforce special legislation.
The Implication of Germany’s Land Tax System and Its Reform Proposals：From the Perspective of Land Revenue Sharing

Abstract:The purpose of this paper is to refer to experience from Germany’s land tax system and its reform proposals in order to find a suitable way to improve China’s land leasing system and to achieve land revenue sharing. Methods of academic analysis and comparative analysis are employed. The results show that the key to facilitating land revenue sharing by means of land tax is setting up the impartial tax burden distribution among owners of real estate property in different location as well as among the beneficiaries and non-beneficiaries of the improvement of infrastructure and public service. The paper concludes that China should establish land tax system, improve its comprehensiveness and ensure fairness of land tax burden distribution when designing land tax rules in order to facilitate land revenue sharing.

Abstract:Although urban land leasing is supposedly a local government matter, local leaderships' proactive pursual of economic growth for their career advancements can sometimes be at odds with national policies. Yet, how land conveyance decisions are made in midst of the implementation of national policies and land financing has been a rather overlooked aspect in the studies of China's land market. Hence, this paper explores this issue through a study of land conveyance decisions in Beijing and Shanghai's residential and commercial land markets from 2007 to 2018, and their subsequent land price effects. Deploying endogenous treatment effect models, it is revealed that land conveyance decisions in Beijing were highly subject to national policies and the status of its City Party Secretary, but not in Shanghai. Also, the use of Guapai resulted in higher residential and commercial land prices in Shanghai, but lower prices for Beijing's commercial land parcels. The findings indicate that Beijing, due to its closer proximity to the Central Government, appears to have stringently followed the national policy directions, whereas land officials in Shanghai seem to have had a higher degree of autonomy in their decisions. Additionally, the contrasting price effect of Guapai on land prices for residential and commercial land parcels enabled Beijing's government to compensate for the latent losses in land revenue when leasing residential land parcels, due to Nation #10, by leasing commercial parcels at higher prices via tender.

Under the restriction, the free transfer of housing ownership will be influenced. Abstract:Based on existing researches,this paper reflects on the historical significance of the land reform in China.Due to all kinds of reasons,the degree of land convergence and the rate of land tenancy before the land reform were both far below what was estimated by the leaders of CCP.So the importance of land reform to the improvement of productive relations and productivity tended to be exaggerated.As far as the CCP was concerned,what really counted was the reconstruction of the relationships between the state and the rural society as a result of the land reform,which contributed to the state’s efficient control and governance of the rural society.

Abstract:The institutional reform of land property rights is confronted with various challenges from all aspects of the economic and social lives in the current stage.The original property reform theory does not agree with the current practical requirement of land use and management.How to fully reflect the political,social,organizational and juristic nature of land property right in the newly-formed concepts of land property reform and its institutional innovation,and further provide a trajectory for future reforms in China,are the main purposes of our theoretical research.It needs to combine together the theories of economics and sociology to analyze related issues.The four-level-social-analysis framework proposed by Williamson provides a good logic to link property right with resource allocation,sociology with economics.Through such a logic,a comprehensive analysis on the nature and the assessment of Chinese land property can be achieved,which can further provide a theoretical basis for the trajectory choice of the current land property reform.The analysis offers scientific references for the new-round of land property reform in China.

Abstract:The Constitution in China stipulates that land in the cities is owned by the state and land in the rural is owned by collectives,and it means that land is requisitioned by the state to meet public welfare and the commonweal land demand.But on the other hand,the Constitution stipulates again that the state may requisition land owned by collectives according to law on public interests.The paper pointed out the antinomy in the land requisition of China,and put forward a basic route of urban state-owned land system reform and rural land system reform;discussed the distribution of land increment current in the balance of urban and rural construction land,the relation of urbanization and moderate land scale use as well as farmers' revenue increasing,the same right and same price for urban and rural house base,the sharing of responsibility for foodstuff security,and made some related policy suggestions.

Abstract:The market must be decisive role in the allocation of land resources, the government should respect the market rule and interests of the land property right subject by formulating scientific and rational planning and equal use control policy and play a supporting role better. In land system, the stipulation of any unit must apply to use the state-owned land for construction purposes, collective land only transferred by taxing for state-owned construction land, the fundamental reason lies in the antinomy of principles between the state ownership of urban land and the commonweal land expropriation in the constitution. In the light of problems of the rural collective land use, we should timely adjust the structure of rural collective construction land, realize the dynamic management of operational construction land, reasonably and effectively configure the land resource. We should build the paid exit mechanism of the house site owned by peasants going into town and settled in the city, to migrant workers conforming to public housing conditions, cannot be forced to abandon the original land use right gratis. We should according to the idea of integration of urban and rural construction land market, allow the rural collective construction land index transfer among farmers (collective). In addition, the current land management law existed obvious discrimination against rural collective land ownership, the terms should be modified.

Abstract:The purpose of the paper is to give some advices to land management in China by reviewing the 100 years history of the development of "equalization of land ownership" thought.Methods of documentation and comparison were employed.The 100 years history shows that the "equalization of land ownership" thought has been well developed not only in China before liberation,but also in Taiwan and Mainland China.Besides,it is becoming more and more important.The following points should be emphasized on land management:(a) to establish a more definite guidance for land management;(b) to develop and improve the "equalization of land ownership" thought,including defining the public land right,reforming the land price system and taxation policy and so on.

Abstract:The graduate approach applied in China for the economic transition poses the risk of continued government influence on the market. The land reform and the following adjustment in China have introduced a seemingly complete market for residential land. However, a widely practiced coalition between the local developmental states and developers might impact residential land leasing in a more hidden way. Taking central Chengdu as the study area, this study takes the enterprise ownership and affiliations as two explanatory factors that impact the land leasing prices and builds an MGWR model to evaluate the premium of political connections for the developers to obtain the land. The result gives a clue to the local protectionism and preference for state-owned enterprises that might exist in land leasing in Chengdu. It is proved in this study that the average purchase price by state-owned enterprises is 8.9% lower than the prices that private enterprises could enjoy, and the average land leasing price by local enterprises is 14.2% lower than that enjoyed by non-local enterprises. The preceding conceptual and empirical discussion in this study advocates for a review and rethinking of the public sector’s intervention in China’s land market. In-depth analyses of the factors that define the land leasing behaviors of the local government are needed.

Abstract:Land capitalization has played a key role in the rapid urbanization of China since the 1990s. Through the leasing of land, local government has accumulated the revenue to improve the infrastructure construction and the investment environment. Nevertheless, excessively seeking for land profit has led to the weakening of the function of land as welfare. As a result, there have emerged a series of social, economic, and environmental problems such as sprawl of construction land, sharp rise of housing price, and negligence of the welfare of floating population. This paper reviews the evolution of land policies and land market since the establishment of the land use right system, examines the positive and negative effects of land urbanization, defines the stakeholders, and analyzes the operation mechanism in the land urbanization process. It concludes with a prospect on the transformation of land urbanization in the future.
