Abstract:Family cold violence is a new type of marriage killer,showing spreading trend and has become the primary form of the family violence.The hidden virus brings more harms to individual,marriage,family and harmonious social stability than body violence that people are familiar to.The relief for the family cold violence is reflected from Articles 32 and 46 of Marriage Law,Protection Law of Women's Rights,and Public Security Management Punishment Law.However,in practice,the general legislation is hard to be applied.Therefore this paper puts forward the legal countermeasures against family cold violence: introduction of national legislation,clarifying relief principles;modification of existing procedures,changing the burden of proof;and adding new ways of relief,establishing social security.

Abstract:Based on a literature research and field survey in the pilot counties,this paper finds out that women are much more vulnerable in family violence in China,and gender inequality is the essential reason for that.As there has been no effective way to prevent and terminate the phenomenon,the paper holds that besides promoting the social conception of gender equality,the most urgent tasks are to set up and coordinate the related laws and policies,as well as to promote the coordination of involved departments.In addition,women's social participation has positive effects on preventing and terminating the violence.

Abstract:Introduction:Domestic violence is toxic to society. With approximately one in three women on average falling victim to domestic violence, systematic solutions are needed. To further complicate the issue, mounting research shows that COVID-19 has further exacerbated domestic violence across the world. Situations could be even more pronounced in countries like China, where though domestic violence is prevalent, there is a dearth of research, such as intervention studies, to address the issue. This study investigates key barriers to domestic violence research development in China, with a close focus on salient cultural influences.Methods:A review of the literature on domestic violence in China in PubMed, PsycINFO, and Scopus was conducted to answer the research question. The search was focused on three themes, domestic violence, China, research, and cultural influences.Results:The study findings show that categorizing domestic violence as a "family affair" is a key barrier to domestic violence research development in China-an incremental hindrance that prevents the public and policymakers from understanding the full scale and scope of domestic violence in China. In addition to abusers, witnesses, and victims, even law enforcement in China often dismisses domestic violence crimes as "family affairs" that resides outside the reach and realm of the law. The results indicated that mistreating domestic violence crimes as "family affairs" is a vital manifestation of the deep-rooted cultural influences in China, ranging from traditional Confucian beliefs in social harmony to the assumed social norms of not interfering with other people's businesses.Conclusion:Domestic violence corrupts public health and social stability. Our study found that dismissing domestic violence cases as "family affairs" is an incremental reason why China's domestic violence research is scarce and awareness is low. In light of the government's voiced support for women's rights, we call for the Chinese government to develop effective interventions to timely and effectively address the domestic violence epidemic in China.

Abstract:In the process of legislating against domestic violence in China,it is necessary for lawmakers to consider and identify several basic theoretical issues: the definition of family violence,the boundary and type of family violence,the reasonability and feasibility of public authorities to intervene in family life and the extent of involvement against domestic violence,the nature of the law against family violence,and legislative models.It is the state's responsibility to stop domestic violence in order to protect human rights in private life.Family violence is the serious mistreatment of not only relatives,but also 'related persons',which means that violence by one person to another with a specific close relationship to the other party should also be identified as family violence.Domestic violence prevention acts should be based on need and take into account other legal experiences and models to create a single,comprehensive domestic violence prevention law.

Abstract:The current Marriage Law and provisions related in other laws have prohibited domestic violence.However,there are obvious problems which are as follows under current law.The definition of domestic violence is too narrow;division of functions and responsibility for agencies related is unclear;it focuses on later intervention without practical remedies and sanctions;there is the lack of effective means to protect family member from domestic violence or coming domestic violence probable in the future;there exist difficulty in identification of domestic violence and evidence collection.Successful legislative experience to prevent from domestic violence in industrialized countries and regions should be introduced into mainland China;that is to enact a single national protection from domestic violence law in which it should be entitled to take public power to prevent from domestic violence,expressly define domestic violence,establish the principle with the contents featuring prevention firstly,comprehensive management,education with punishment;it regulates specifically the responsibilities of relevant agencies or institutions;it should create concrete and feasible intervention measures against domestic violence such as protection order.It regulates procedure to prevent from domestic violence.

Abstract:Violence within the family is increasingly being recognized as a serious societal problem in the United States. Four types of family violence are discussed: violence toward children, siblings, women, and the elderly. This paper explores the development of violent relationships in the family from both biological and psychological perspectives, with the latter encompassing four frameworks--the psychopathological model, the social learning model, the aversively stimulated aggression concept, and systems theory. The authors also examine the risk factors for and the effects of violence as well as the characteristics of the aggressor and the victim. Available intervention strategies for various types of violent behavior are then discussed.

Abstract:There is domestic violence in families of any social class.The damages could be less if domestic violence is found and treated properly as soon as possible.In the UK,the statutes on law against any domestic violence have been made since 1970's.These statutes prevent every member of a family from domestic violence by definition of family members,consideration of domestic violence,protection from harassment and judicial protection.These British statutes pay more attention to prevention as well as punishment on a defendant in order to help victims and offenders to stop domestic violence spread into next generations as to stop domestic violence extend to out of a family.The values,paths and strategies of British statutes against domestic violence as a successful legal experience should be introduced into China,which are very useful reference to make new Chinese law against domestic violence.

Abstract:The domestic violence in ancient society was the masculine guardian's privilege and authority,which was voluntarily solved through the family ritual by the guardian in the family interior.Because the influence of the idea on equality between men and women and human rights in contemporary society is quite deep,people have been aware that domestic violence is not simply a dispute within the family,but a social problem on violations of human right,which is unable to be solved only depending on the morals.Meanwhile,domestic violence is a worldwide commonplace.Therefore,beginning from the prohibition of violence against women in international joint pledges,over 40 countries have already issued the rules and regulations against domestic violence.Although China's "Marriage Law" revised in 2001 explicitly stipulates that "domestic violence is prohibited",the definition has not been given.Then "Interpretation of Several Questions Involving Application of 'Marriage Law'",promulgated by the Supreme People's Court of PRC,gives the definition,but compared with such legal documents as international covenants,there still exist many inherent defects which weaken the anti domestic violence,and go against the protection of victims' rights.It's of great significance to stipulate an operable concept into the law.

Saying from broad sense, domestic violence not only refers to the violent behaviors in marriage, but also the violent behaviors in cohabit and terminated marital relations, such as the violent behaviors in "reality family","homosexual family","divorced family", "quasi-family". Saying from narrow sense, domestic violence refers in particular to all violent and abuse behaviors which are directed against female in the families above-mentioned. This article tries to explore the origin of domestic violence under a new look (religion, social, both sexes conflict, and so on ) ,which has positive significance to enhance women's rights, defend family stability and social harmonious.

Abstract:<span>In China, the definition of domestic violence is usually limited to direct physical and mental harm to family members. About a quarter of Chinese families have been reportedly affected by domestic violence to different degrees, with most victims being women who have lacked effective legal protection for a long time. In response, Chinese feminists advocated the implementation of the Anti-domestic Violence Law (ADVL). Through judicial reforms, the Supreme Court of China has urged local courts at all levels to establish Family Law Divisions so that they can implement the provisions of ADVL better. However, due to compromises made before it was finalized and the restrictions of the Chinese legal system, its effectiveness is still limited, making it difficult for Chinese female victims of domestic violence to obtain sufficient support from the courts. The process Chinese feminists have undertaken to put forward their ideas regarding this Law has only just begun.</span>

Abstract:There has been an increasing awareness of Domestic Violence (DV) in China following the announcement of the First Anti-Domestic Violence Law, in 2015 yet, there has been limited in-depth research concerning DV in China -with most focused on prevalence and risk factors. This study aims to capture female DV victims’ experience of violence in China, and identify the perceived causes and impacts of DV. This qualitative research, conducted from June to September 2019 in Hangzhou, China, consisted of in-depth semi-structured interviews with 30 women who had experience of DV. Social cognitive theory served as the theoretical framework and Interpretive Phenomenological Analysis to analyze the data. The most common types of physical violence reported included hitting, throwing objects at women, choking, kicking, and slapping. Psychological violence consisted of insults and denigration, physical threats, and enforcement of social isolation. Sexual violence consisted of forced sexual behaviors against women’s willingness. All informants suffered physical or psychological impacts from the violence experienced. Perceived causes of DV included the perpetrator’s personality and childhood experience of violence; victims’ self-blame; conflict between couples that include those concerning raising children and household finances; family conflicts, especially with parents-in-law; social factors including rural-to-urban migration for work, social norms and constraints, and legal constraints to separation. 80

Abstract:It is quite common that the minors are victims of family violence cases.The experience will have some negative impact on the minors in psychology,self-identification and behavior.Even if parents use violence for educational purposes,minors will still have a negative sentiment.It is difficult to concern the positive message that the parents really want to convey.A public authority should be more active to provide practical relief and help to protect the minors from domestic violence,to improve the living environment for minors,to build multi-levels of benign interaction mechanisms including families,schools and communities,to guide and train minors from physiology, psychology,recognition knowledge and behavior habits in order to protect their physical and mental health development.

Abstract:When it comes to the subject of domestic violence,the definition should be neither too narrow nor too broad,but consistent with the logic of legal system and with public understanding and acceptance.Domes-tic violence refers to abuse occurring in a domestic setting or an intimate relationship,such as marriage and cohabitation,and it also takes place in heterosexual and same -sex family relationships.Victims should be entitled to effective protection by Anti -Domestic Violence Law for the sake of preventing domestic violence in all aspects,offering family members a safe living environment and individual development space and achieving domestic justice.

Abstract:It was emphasized that violence in the family has catastrophic consequences for both adults and children. Domestic violence, sometimes called intimate partner violence or family violence, can be psychological, physical and/or sexual abuse by one partner against another. Different forms of domestic violence are analyzed. It is emphasized that violence violates the constitutional rights and freedoms of a person and a citizen and can cause moral harm or significant harm to his physical or mental health, as well as threatens the safety and microclimate in the family. It is emphasized that there are regulatory and legislative acts regulating family relations and designed to prevent this shameful phenomenon at the international level and at the national, Ukrainian level. The essence of the concept of «domestic violence» in modern Ukrainian legislation and the interpretation of domestic and foreign scientists is analyzed. It is emphasized that the existing definitions of the concept of domestic violence need to be expanded in order to more specifically identify this illegal phenomenon with the aim of further actions by the relevant authorities and society as a whole to prevent domestic violence. The authors note that the essence of the concept of «domestic violence» consists of two components, the first of which indicates that the events take place at home, and the second – that there is a negative impact, that is, there is a fact of violence of one family member (or several) in relation to another a family member (or several). The proposed own interpretation of the concept of «domestic violence». It is emphasized that the offender is influenced by various objective and subjective factors, and therefore it is necessary to study them and minimize their negative impact on the individual. According to the authors, a clear definition of the essence of a specific concept will contribute to the development of more effective, specific means of combating domestic violence in all its manifestations
The Interplay of Social Norms and Legal Systems: Unraveling the Complexity of Domestic Violence in China and Paving the Path for Change

Abstract:This research investigates the perpetuation of domestic violence (DV) in China by analyzing how social norms and institutional practices collectively contribute to the challenges faced by individuals experiencing DV. Despite the implementation of China's Anti-Domestic Violence Law in 2016, its effectiveness in protecting DV survivors' rights has been subject to scrutiny among researchers. This research aims to understand whether law enforcement and judicial responses post-legislation effectively align with policy objectives to mitigate DV issues. It hypothesizes a dissonance between the DV legislation and social norms emphasizing family and social harmony and non-interference in family affairs. Focusing on specific DV cases and incorporating the meta-analysis of secondary empirical data, archived governmental reports, periodicals, interviews, Confucian writings, and prior scholarly insights, this study examines how social norms and institutional practices in governmental agencies impact the framing and responses to DV cases. Findings suggest that entrenched social and gender norms shaped by Confucianism and traditional Chinese cultural values legitimize and reinforce institutional norms regarding how police and judges should downplay DV cases, leading to indifference and ineffective DV interventions. This research highlights the importance of adopting a social norms approach to effectively address this problem and the need for a transformative shift in social attitudes toward DV. It contributes to a nuanced understanding of DV and policy implementation in China, potentially serving as a significant step towards devising practical strategies to improve the protection of DV survivors at the local level.
