On the Legislative Basis and Legal Orientation of Labour Contract Law

Abstract:This article has analysed the Labour Contract Law in terms of its legislative basis and legal orientation.Arguably,those problems such as zero-contract,short-period contract,irregulative contract,etc.,which exist largely in the implementation of the labour contract institutions have severely infringed on the rights and interests of employees while exerting negative impacts upon a harmonious labour relations.According to the status quo of Chinese labour relations,in particular,problems engendered in the implementation of labour contract institution is the practical basis with regard to the legislation of labour contract.However,the theoretical basis lies in the fact that the relationship within the labour contract,which is under the constraint of labour contract regulations,is essentially a subordinative individual labour relationship.The labour contract is a subordinative contract.Thus,this type of relationship reflects both inequality and unbalance.With the fundamental aim of balancing the power between employer and employee,the legislation of Labour Contract Law endeavours to achieve a long-term and stable labour contract relationship.In this manner,the main principles of the Labour Contract Law include:the Labour Law with the sole purpose of labour protection should be the basis for labour contract legislation;and the main idea of the labour contract legislation is also to protect labourers;the social function of this law is to achieve mutual benefits between employer and employee for social justice;public power intervention should be emphasized in the adjustment of labour relations.
