Abstract:Public cases with major social impact in recent years reflect issues in China's authentication system.Lack of public credibility in authentication opinions,lack of right to know and right to act of on the part of clients,and reluctant attitude of public security and judicial authorities towards court appearance of authentication appraisers,all these issues are hindering the perfection of China's authentication system.We should take the opportunity of amendments to Law of Criminal Procedure,with the guidance of proper legal principle,in an effort to perfect relevant system concerning authentication opinions used as scientific evidence.

Abstract:With the arrival of the Internet Age and the increasing power of the media,online live broadcasts become a new landscape in the criminal trial.Online live broadcasts provide us with important data for analyzing China's criminal trial mode when the transparency of China's criminal trial is not adequate.The questionnaire survey shows that most people involved in the survey affirmed online live broadcasts as a new way of procedure disclosure.At the same time,many people pointed out some defects of online trials,such as too simple cases,too many factors of formalism.We can attempt to improve online criminal trial by normalizing the initial procedure,selection standards and specific rules of online live broadcasts.The survey explores some key ways of reforming China's current criminal trial mode from some profile,which include promoting the equal adversaries between the procurator and the accused,keeping witnesses being testified on court,protecting the rights of the accused.

Abstract:The expert assessor, which has been set up by the new Criminal Procedure Law, has great inlfuence on improving the quality of expert opinion, revolving the hearing process and the evidence system. However, the expert assessor has little effect since it is implemented because the relevant provisions in the new Criminal Procedure Law are ambiguous. The survey of legal professionals shows that they have quite big disagreements on the litigation status and opinions of the expert assessor. Therefore, in order to consummate the expert assessor system, we should deifnite the independent status of the expert assessor and guarantee the expert assessor can take part in the hearing process. Only in this way can the institutional design reach the ideal status.

Abstract:The 1996 Criminal Procedure Law aimed to bring major changes to China’s criminal trial procedure by adding more adversarial components into trials and providing more protection to criminal defendants. Nevertheless, its effectiveness has been questioned continuously by scholars. Based on students’ evaluations of online criminal trials, this study was designed to explore public opinions on China’s criminal trial procedure. In addition, comparisons between mainland students and Hong Kong students, and between law students and non-law students were explored to examine potential differences between two legal systems and between students with different educational background and training. Data showed that the majority of students were satisfied with the three-phase trial procedure and the performance of major players in court. Nevertheless, they also identified a number of problems, all dovetailed with previous scholarly studies. Despite some nuanced differences, cross-group comparisons between the mainland sample and the Hong Kong sample and between law students and non-law students produced largely similar results.

Abstract:In recent years, a growing number of judicial cases have stepped into public view for various reasons, and re- ceived extensive attention and then developed as ＂public eases＂. We can find, from the common features of regularity from an- alyses of these ＂public cases＂, that most of them are unjust framed-up cases, identity of the defendant appears in the polariza- tion, and inquisition by torture is widespread, for which network has become a major media. The appearance of ＂public cases＂ challenge the public opinion related to procuratorate, public demands, presumption of guilt, and false concept of the ＂murder must be solved＂. The excessive cooperation and insufficient constraints of public security, procuratorate, and court etc. these are the deep-seated reasons in solving the present problems of the public opinion related to proeuratorate. This paper provided useful thinking in establishing effective coping mechanisms involved in public opinion related to procuratorate through the analy- sis of the ＂public cases＂ and its causes.

Abstract:The purpose of ordering a witness to appear in court is to protect the defendant's right to confront the witness in court.Therefore,the act of ordering a criminal witness to appear in court is essentially a question of protecting this right.The Criminal Procedure Law of the People's Republic of China(PRC)and its judicial interpretation do not specifically give the defendant the right to confront the witness in court.In practice,the percentage of court appearances by witnesses is only around 25%.Criminal trials where there is no direct confrontation between the witness and the defendant generally involve active use of substantive law and reflect the imprecise operation of conviction and sentencing and the unitary nature of the sources of judicial legitimacy.To reverse this situation,it is necessary to establish a system of confrontation between the witness and the defendant and corresponding guarantee mechanisms so as to achieve greater precision in convictions and fairer sentencing and prevent wrongful convictions,as well as diversifying the sources of legitimacy of court verdicts.This would bring about an overall rise in the authority of the courts and would promote the construction of China's legal system.

Abstract:The role of witnesses in uncovering the truth of a case is very important, and witness appearances in court hold significant meaning in civil litigation. However, witnesses often hesitate to appear due to a lack of time or the court being located far away. Additionally, fear of retaliation from the parties involved leads many witnesses to refuse to testify in court. This results in a low rate of witness appearances, which is recognized as a serious issue in Chinese civil litigation. The advancement of internet technology offers a solution to this problem. By allowing witnesses to testify online, it saves time and costs associated with testifying, and reduces direct contact between witnesses and parties, effectively protecting the safety of witnesses. Therefore, this method of online testimony provides a potential solution to increase witness court appearance rates. However, the current online testimony method has issues such as unclear nature, difficulty in accurately verifying witness identity, and challenges in ensuring the credibility of the testimony. To resolve these issues, it is first necessary to legally clarify the online testimony method as a form of court appearance testimony. Additionally, measures to strengthen the verification of witness identity should be implemented. For example, legislative measures to clearly define penalties for identity theft of witnesses, reinforcing judges' obligations to verify identities, and directly connecting online litigation platforms with systems of third-party agencies like police and administrative authorities to facilitate thorough identity verification. Such measures will prevent identity theft and accurately confirm the identity of witnesses, thus protecting the legitimate rights and interests of parties and enhancing the fairness and efficiency of litigation. Furthermore, to strengthen the credibility of testimony, the following measures can be considered: 1. Establish an online oath system for witnesses, ensuring they understand the legal consequences of false testimony. 2. Emphasize the importance of adhering to court order, ensuring that witnesses follow the same rules online as they would in an offline court. 3. Adhere to the principle of isolated examination, preventing witnesses from being influenced by other witnesses or participants. 4. Utilize the cross-examination method from common law systems to enhance the credibility of testimonies. In conclusion, the method of online testimony can be a useful tool to increase witness court appearance rates, but effective utilization requires legal, technical, and institutional improvements.

Abstract:The policeman's testimony in court in two legal systems can be generalized into two modes: prosecuting witness mode and ordinary witness mode,which represent two different lawsuit ideas and value orientation.In China,policemen seldom testify in court,but they present some written materials instead in trial.This is the current practice of "Information and Materials Mode".The cause of this mode relates to the lawsuit structure,trial way,achievement assessment system and state compensation system.The two modes request that the investigators must appear in court,while in laws and in practice,the problem of policemen testifying in court has not been well solved.To carry out the system of policeman testifying in court,we should reform the trial way focus on records and files,set up the upright lawsuit structure centered with judgment,improve trial efficiency and lawyer defence technique and reinforce relief on right of the defendant.

Abstract:Based on The Civil Procedure Law Amendment,this essay discusses several important issues about revising and improving Civil Evidence System.First,the author discusses the basic perspectives of Civil Evidence System adjustment during the modification of Civil Procedure Law,he argues that the modification and adjustment of Civil Evidence System should base on the construction of Evidence System’s structure.Second,the author raises questions about provision of evidence categories especially evidence sequence and presents his own opinion.Third,the author puts forward criticism as well as constructive suggestions about perfection of witness system,he argues that provision of reserving unit witness is inappropriate.Fourth,with regard to Amendment,he proposes different opinion about countermeasures of preventing proof delay and argues that time limit system of evidence should be confirmed.Fifth,he also analyzes the exemption items in civil evidence.Last but not least,he gives demonstration to the fundamental norms of documents command system which is the legal measure effectively coping"partial evidence".

Abstract:The perfect protection of witnesses is the foundation of the rival criminal procedure system. There are reasons for the protection of witnesses, not only because of the contributions they made to the country, but also because of the special risks they suffered, which requires the intervention of the country. The effective witness protection system has not been established under the current legal system, which resulted in the reality that there are no witnesses appearing on trial in many criminal cases. Abstract:Scholars in the field of Chinese criminal procedure law study have long decried the meager legal protection afforded to criminal defendants on trial and the hapless status of Chinese criminal defense attorneys in the courtroom. Unfortunately, very little empirical evidence was available to shed light on how criminal defense was carried out in Chinese courtrooms. Based on observations of 325 actual criminal trials from 55 District People's Courts in J province, this study provides an opportunity to understand the mundane work performed by Chinese criminal defense attorneys. In particular, this study describes how criminal defense attorneys prepare and present their cases (as measured in terms of bail request, overall trial preparation, examination of defendants and witnesses, presentation of evidence, and overall defense strategy), and analyzes the outcomes of their performance. In addition, this study examines the discernible impact of criminal defense work due to types of legal representation utilized (legal aid vs. privately retained attorneys), numbers of attorneys representing the client, and the gender composition of the attorneys.

Abstract:The main significance of witnesses' appearing in court to testify in criminal trials is that this practice guarantees the defendant's right to confrontation. The issue can thus be framed in another way, as the issue of the appearance in court of the necessary witnesses. Here, the defendant's right to confront is the key point. Since neither China's criminal procedural law nor corresponding judicial interpretations have granted the defendant the right to confront, the rate of appearance of the necessary witnesses amounts in practice to only about twenty-five percent. Criminal trials conducted in the absence of the right to confrontation usually conform to the doctrine of positive substantive truth and manifest a lack of care in conviction and sentencing as well as reliance on a single source of legitimacy in reaching judgments. To correct this state of affairs, it is necessary to institute the right to confront and corresponding safeguards.

Abstract:While it is necessary to tackle the problem of wrong sentence from the perspective of procedural law,evidence and judicial reform,substantive law is indeed of the same importance in prevention of wrong sentence.An adequate theoretic framework of criminal substantive law must compose of rationality of methodology and judicial regularity and logic,conduce to settling certain judicial conundrums,and ultimately reach the target of human rights protection.To prevent wrong sentence,we must hold a position of criminal objectivism with which criminal methodology and relevant judicial logic will be cultivated.An inherent consistency and uniformity exists in respect of the basic position of criminal law,criminal methodology and criminal justice logic.As such,the four-element-of-crime theory popular in China is required to be improved so as to establish the central and prior position of the objective elements in the structure of criminology and change the original decision based on subjectivism into decision on objectivism,which will inevitably exert positive impact upon the formation of rational judicial logic.
