Abstract:English Abstract: Disputes on the right to development represent the conflict between the Global North and the Global South regarding their divergent understandings of the notion of human rights. The attempt to conceive development as a human right departed from State-centric discussions which consider development as a developing State’s right against the North. Since the adoption of the Declaration on the Right to Development, scholars have developed the theory of the human right to development in order to solidify these rights for not only States, but also for individuals and groups. After 30 years of deadlock, frustrated by perpetual poverty and underdevelopment and backed by emerging States’ attempts to change the current international legal order, the Non-Aligned Movement prepared a draft Convention on the Right to Development. Its zero draft was written by scholars but very much reflects the State’s point of view. This thesis aims to examine how and what the Global South wants to change in current international law, before commenting on its legal appropriateness. This is complemented by an in-depth political analysis, to know its background. In summation, the thesis will demonstrate how the zero draft attempts to establish new international norms without having the consensus of the international community or sub-State groups. For this purpose, Part I introduces the context of this study and explains its significance. Part II reviews the historical background which gave birth to the zero draft, to show the tension between State’s right to development and human right to development. Part III examines how the zero draft attempts to change international law without consent of the international community, especially of Western donor States. In particular, the principle of the States’ Duty to Cooperate (Chapter A) and the Duty of Everyone to Respect Human Rights (Chapter B) are being imposed through its legal formula and implementation mechanisms, albeit they did not exist hitherto. Part IV reveals the zero draft’s regressive attitudes towards the rights of the most marginalized sub-State groups. It underscores the importance of participation and group protection in realizing the human right to development (Chapter A), before illustrating the deficiency of the zero draft’s provisions compared with the current legal protection regime (Chapter B). Finally, it acknowledges the pitfalls of the right to regulate as potentially ending up as a State’s right to development (Chapter C). Part V concludes that the Convention on the Right to Development exaggerates too much the States’ aspects of the right, while not paying enough attention to its peoples. It considers alarming that the right to development can be hijacked by States. French Abstract: Le débat sur le droit au développement reflète le conflit entre le Nord et le Sud concernant leurs conceptions divergentes de la notion de droits de l'homme. La tentative de concevoir le développement comme un droit de l'homme est née des discussions centrées sur l'État qui présentaient le développement comme un droit de l'État du Sud contre le Nord. Depuis l'adoption de la Déclaration sur le Droit au Développement, les chercheurs ont développé la théorie du droit de l'homme au développement afin d'y intégrer le droit non seulement des États, mais aussi des individus et des groupes. Après 30 ans d'impasse, frustré par la pauvreté et le sous-développement perpétuels et soutenu par les États émergents qui tentent de changer l'ordre juridique international actuel, le mouvement des non-alignés a préparé un projet de Convention sur le Droit au Développement. Son avant-projet a été rédigé par des universitaires, mais reflète bien le point de vue des États. Ce mémoire vise à examiner comment et ce que le Sud veut changer dans le droit international actuel, ainsi qu’à commenter sa pertinence juridique. Il contient une analyse politique qui permet de mieux cerner le contexte dans lequel il s’inscrit. En conclusion, ce papier démontre que l’avant-projet tente d'établir une nouvelle norme internationale sans avoir le consensus de la société internationale ou des groupes sous-étatiques. Dans cet objectif, la Partie I présente le contexte de cette étude et explique sa signification. La Partie II passe en revue le contexte historique qui a donné naissance à l’avant-projet, pour montrer la tension entre le droit de l'État au développement et le droit de l'Homme au développement. La Partie III examine comment l’avant-projet tente de modifier le droit international sans le consentement de la société internationale, en particulier des États donateurs occidentaux. Précisément, le principe du devoir de coopérer des États (Chapitre A) et le devoir de chacun de respecter les droits de l'homme (Chapitre B) sont imposés par sa formulation juridique et ses mécanismes de mise en œuvre, alors qu'ils n'existaient pas jusqu'à présent. La Partie IV révèle les attitudes régressives de l’avant-projet envers les droits des groupes sous-étatiques les plus marginalisés. Elle souligne l'importance de la participation et de la protection des groupes dans la mise en œuvre du droit de l’homme au développement (Chapitre A), et illustre la déficience des dispositions de l’avant-projet par rapport au régime de protection juridique actuel (Chapitre B). Enfin, elle met en évidence le piège que constitue le droit de réglementer qui risque d'être le droit au développement d'un État (Chapitre C). La Partie V vise à nous alerter que la Convention exagère les aspects Étatiques du droit sans accorder suffisamment d'attention aux peuples et que le droit au développement est détourné par les États.
