System Construction of the Company's Emergency Management System:Learn from the American Guide to Industrial and Commercial Emergency Management

Abstract:At the end of the 20 th century, the reform of corporate governance and company law in the United States in response to social emergencies reflected a folk active response. Commercial companies and industry associations cooperated with legislators to jointly promote the formulation of relevant policies, represented by the guidelines for industrial and commercial emergency management formulated by the Federal emergency management agency, it aims to provide a step-by-step method for emergency management planning, response and recovery of companies of all sizes. The method described in the guide is only a suggestion for enterprises, but it begins to show the connection between enterprise emergency management and enterprise compliance regulatory framework. At the same time, it is clearly stated that in order to maintain compliance, the company needs to give priority to specific emergency management matters. Considering that China’s current legislation on the company’s emergency management is still in a state of aphasia, in terms of the path selection of sinicization, the industry association and regulatory authority can incorporate the enterprise’s emergency preparedness and management plan into the enterprise compliance system, keep the emergency mechanism up with the times and take into account the consideration of adaptation cost. The company needs to fulfill the obligation of disclosure of the emergency management plan.
