Abstract:The rapid development of China's market economy compels the adoption of water rights and associated market mechanisms to optimize the allocation of water resources. The complexity of understanding and practising Chinese water rights is highlighted by the unique contextual characteristics of an authoritarian political regime, rapid socio-economic change and increasing scarcity of water resources. This article proposes a hierarchical framework to describe the particular water-rights structure in China based on natural resources institutional economics. It provides an analysis of emerging water markets and key factors affecting the formation of a modern water-rights system in contemporary China.

Abstract:The reform of water rights and water markets is not only an important content of water resources management reform,but also is one of the hotspots in the field of resource and environment research in China.The construction of China's water rights markets has not yet been completed,the water rights trading also has not been a system,and it lacks the support of water rights trading system and technology.Domestic and foreign researches show that,it is necessary to have a clear boundary of property fights,technology support of measurement and monitoring,improving of the regulatory system and many other conditions for the effective operation of the water rights markets.What's more,the transaction costs,third-party effects,and social culture also have important impact on it.From the existing water rights trading models,most of domestic scholars follow the water rights trading models developed by the foreign scholars,which rarely consider the factors of China's national conditions.Overall,there are three major shortcomings in the domestic water rights markets researches.First,in the study of the regular pattern of the development of the water rights markets,those studies put too much emphasis on the role of the market and the market system itself,but lack understanding of the internal mechanisms of the operation of the water rights markets.Second,those studies put too much emphasis on the international experience in the water markets,but understood little of their problems and lessons.Thinl,in the process of the construction of water rights trading and markets system,those studies put too much emphasis on the ideal free market model,which restricts the considering of the national conditions and knowledge of Chinese characteristics.It is necessary to carry out more in-depth research at present,and systematically explore the impact of China's national conditions on the construction of water rights markets,focus on revealing the characteristics of water rights markets system with Chinese characteristics,and put forward the water rights trading model,trading rules,regulatory regime,and water price policies appropriate to national conditions.Through theoretical integration and knowledge innovation,the understanding of water rights markets system with Chinese characteristics will be improved,which will provide the research support for water resources management system reform and sustainable utilization of water resources.

Some examples are also mentioned for analysis of the mechanism of the water right trade.

Abstract:Water rights trading and water-saving management contracts are important market-oriented means to promote water conservation. This study integrates them together for a joint analysis, and puts forward a new way to optimize market-oriented water-saving services in China. This is to establish a water-saving management contracts-based water rights trading mechanism, that is, to allow trading of water saved under a management contract. We have two main findings. First, water-saving management contracts and water rights trading are highly compatible and interrelated. Second, water rights trading can be integrated into the implementation of water-saving management contracts and thereby promote their application.

Abstract:Abstract Climate change and increasing demand of water aggravate the frequency and intensity of trans-boundary water conflicts, which are evolving into one of the most sensitive economic and social issues in trans-boundary areas. This paper analyzes the inefficiency of traditional regional negotiation models to deal with trans-boundary water conflicts, and argues that Coase's theory of property rights is more suitable for dealing with trans-boundary water conflicts. Based on the Bayesian evolutionary game model with incomplete information of property rights, we put forward the following two ways to promote the smooth progress of water rights trading and, furthermore, resolve water resources conflicts: first, to reduce the transaction costs of the upstream and downstream regions; second, to increase utilization efficiency of water resources in the upper reaches. Finally, taking the water conflict of Dayankeng Hydropower Station as a case simulation, we give answers to the three questions: (1) under what conditions, both sides of the conflicts will choose water rights trading; (2) what is the impact of transaction costs on water rights trading, which provided a new way to solve trans-boundary water conflicts; (3) what is the improvement of welfare effects of water conflict participants because of water rights trading.

Abstract:The situation of our country and water in China determine that it is necessary and the pressure to construct water right system. With the abundant connotation, water right consists of ecologic, environmental, social-economic, state-reserved ones in river basins. The initial allocation of water right should be carried out based on the principles of equity, priority of current conditions, efficiency, water supply ordering, gross control, vulnerable group protection, consistent right and responsibility. Under these principles, state-reserved water right, irrigation water right, water right allocation and gross control, water norm management, and water permission system have been considered.

Abstract:In order to supply water for growing industrial needs in Ordos City, Hangjin Irrigation District on the south bank of the Yellow River, Inner Mongolia has traded some of its irrigation water to downstream factories. The trading is termed "irrigation water-saving supported by industrial investment, with saved water traded to industry". At the same lime, Hangjin Irrigation District has conducted a comprehensive reform of irrigation water management focused on water rights. This paper describes the current status of water management in the district, outlines some of the problems water trading has produced, and presents a framework. for further water rights reform focused on rights allocation, the granting of volumetrically-capped water certificates and tickets, water use planning and monitoring, and the responsibilities of water user associations in ensuring that individual farmers receive fair allocations. The paper then summarizes key recommendations Of relevance to Hangjin and other irrigation districts in China.

Abstract:With rapid industrialization and urbanization, scarce water resources are more and more being transferred from low-value agricultural use to high-value industrial and domestic uses in China. Along with water shortages, inefficiencies are apparent in Chinese agricultural water utilization. The causes of these inefficiencies include attenuated property rights, artificially low water prices, lack of farmer participation in irrigation districts management and fragmented government management. It is concluded, against the background of a transitional economy, that the lack of economic incentives in the allocation of water is the principal reason why shortage and waste coexists in Chinese irrigated agriculture. The challenge now facing decision makers is how to resolve the conflict between increasing food demand and decreasing water supply without undermining the growth of cities and the industrial sector. Owing to failures in both markets and government in water allocation, it is argued that it is necessary to establish a quasi-market for water.

Abstract:Intensifying competition for water induces the growth of water markets in several countries for sharing water between rural communities and cities. While there is a growing recognition that adoption of market mechanisms in environmental governance relies on the state and different institutional arrangements, much less is known about how the interconnections among the state, market-tools, and the community work in practice. In China's distinctive political system, the central government has adopted a 'Two-Hands' approach () to water governance - a combination of strong central regulation and infrastructure development on the one hand, and adoption of market principles on the other to improve water reallocation. A recent study has explored the policy evolution underpinning this transition. However, no studies have systematically examined the implementation of the Two-Hands approach to reveal the underlying institutional hybrid patterns in environmental governance. This study fills this research gap by employing a Fuzzy Set Qualitative Comparative Analysis (fsQCA) to analyze how the interplay of the central government, market, and local governance shapes water rights trading patterns. A total of 29 water-scarce cities using water rights trading with 385 transactions were investigated for the period between 2000 and 2019 by combining evidence from fsQCA and qualitative case-studies. The implications drawn from interpreting the results are as follows: (1) the central government shapes the development of the market and its transactions but this is expressed in multiple ways through pilot projects and the national water exchange platform; (2) establishing water markets and investing in water infrastructure are mutually reinforcing, rather than mutually exclusive; and (3) local governments employ different property rights arrangements to adapt water markets in China's centralized politically institutional context.

In the absence of well-defined property rights, disputes over water use have become more frequent, options for the procurement of environmental water rights in China is a pending issue in the process of sustainable development. Due to the public characteristics of environmental goods, the operation of a simple market or the control by government may not allocate water resources efficiently, the government should play a role via public and private programs enhance the environment through the direct acquisition of environment amenities. The estimation of values for preserving environmental assets is more challenging.

Abstract:On the basis of the property right theories from some famous economists, the problems about the definition of the water right have been thought about to analyse the current situation of definition of water right in China. There are still certain drawbacks in the definition of water right and in the definition of water resources′ use right. In order to complete the water right definition under the market economy of China, some suggestions are: to strengthen the collection of the water resources fee, promote the true realizing of water resources ownership, define clearly the use right of the water resources with the market mechanism, promote the rational water resources allocation, set up the price form mechanism of water resources, legalize alienation right of water resources, set up alienation system of water resources tentatively.

Abstract:Due to the difference in the economic and social development level of each area of the water transfer project, there will be a lack of water resources in some areas, while water resources in some other areas have a surplus, resulting in the imbalance of water resources. However, the transaction willingness of both parties is not strong, and the seller has the psychology of "reluctant to sell". The buyer hopes to make free water allocation through the government. The paper analyzes the feasibility and influence of solving the imbalance of water resources in water transfer projects through the market mechanism by the evolutionary game approach. The water right transaction between Zhengzhou and Nanyang in the middle route of the South-to-North Water Transfer Project is taken as a case for simulation. The study shows t: the lower the marginal return of the water resources in the water-rich area is, the higher the water-scarce area is, the easier to promote water rights trading; the higher the environmental and social benefits for both parties are, the easier the water rights trading; the lower the transaction cost of both parties is, the easier the water rights trading.

Abstract:Tradable water volumes is one of the basic elements of water-rights trading. In China, water-rights transactions mostly occur in water-deficient areas. However, the water-rich areas are also facing serious water-shortage problems. It is necessary to stimulate the water-rights trading power in abundant water areas to improve water-resource predicament. This paper studied the concept and calculation method of tradable water volumes of industry. First, based on the property rights theory, we analyzed the concept of tradable water volumes, and put forward the preliminary determination of water-rights trading subjects. Then, we defined the tradable water volumes of industry as the difference between the initial water-rights allocation and the water demand of industry. We used the proportion method to calculate the initial water-rights allocation of industry under different runoff frequencies, and grey model (1,1) to predict the water demand of industry. Finally, we applied the calculation method to Changsha city which is in a water-rich area of China. The calculation results contribute to water-resource management in Changsha city. This paper will provide a theoretical basis for researching the tradable water volumes, and promote the development of water-rights trading in China’s water-rich areas.

Abstract:Water markets aim to achieve water conservation and efficient allocation through market transactions. However, the presence of water rebounds may counteract this effect. Water markets and water rebounds have a complex interaction that has not been adequately explored in current studies. This study fills this research gap by developing an analytical framework connecting water markets and water rebounds and scrutinizing the causal linkage between them and the potential mechanisms involved within the context of China's water rights trading (WRT) policy. The findings have the potential to significantly impact water management strategies. We argue that water markets and water rebound mitigation—which is frequently linked with the capacity of water markets to improve water quality—are causally related. Furthermore, deploying water markets may also slow technological progress, resulting in reduced water efficiency and hence, an indirect mitigation of water rebounds. Lastly, the impact of water markets on water rebounds varies according to water availability and socioeconomic levels.

Abstract:This article describes the growth and importance of irrigation in China in terms of the expansion of surface water irrigation led by the state, and the more recent acceleration of groundwater irrigation led by individual farmers. Key management challenges and policy priorities are outlined, highlighting the importance of water conservation and integrated water resources management under the 2002 Water Law. The article then describes the basis for rights definition and allocation planning under the Law, and recent experience with implementation in surface water and groundwater contexts.A key conclusion is that the development of a modern water rights system in China is vital for mediating between the claims of competing uses, particularly at the agricultural-industrial-urban interfaces, and for meeting water conservation and reallocation objectives. At the same time, farmers within irrigation districts and in emerging groundwater economies need clearly defined rights to encourage investment in the farm economy and to provide security of supply. Implementing new systems in a country the size of China is a major challenge, however, particularly across large rural aquifers where groundwater development is increasingly opportunistic and farmer-led.

Abstract:Water-rights trade has proved to be an effective method for coping with water shortages through the transfer of water resources between users. The water allocation system is classified into two categories based on information transparency and water rights transaction goals: administered system (AS) and market-based system (MS). A multi-agent and multi-objective optimal allocation model, built on a complex adaptive system, was introduced to direct the distribution of water resources under an AS in the Shiyang River Basin; it was compared with a market-based water rights transaction model using the bulletin-board approach. Ideal economic agent equations played a dominant role in both models. The government and different water users were conceptualized as agents with different behaviors and goals in water allocation. The impact of water-saving cost on optimal water allocation was also considered. The results showed that an agent's water-saving behavior was incentivized by high transaction prices in the water market. Under the MS, the highest bid in the quotation set had a dominant influence on how trade was conducted. A higher transaction price will, thus, result in a better benefit ratio, and a lower one will result in inactivity in terms of water rights trade. This will significantly impact the economic benefit to the basin.

Abstract:Water inequality could exacerbate global water scarcity due to the finite nature of water resources. Water markets aimed at overcoming failures in public water distribution systems may offer potential solutions to water inequality. However, existing studies failed to explain how water markets and water inequality are related. This study constructs a water inequality-water market conceptual framework to fill this gap. It examines the influence of water markets on water inequality in the context of China's Water Rights Trading Pilot. This study argues that water markets based on economic rationality can mitigate water inequality compared to command-and-control water policies. In addition, the mitigating effect of water markets on water inequality relies on changing the industrial structure, promoting technological innovation in irrigation, and improving recycled water use. Finally, the influence of water markets on water inequality tends to be heterogeneous depending on differences in economic development, precipitation, and water demand.
