Legislative Developments in China in 2015

Abstract:The year 2015 marks the first year to promote the rule of law as elaborated in the Resolution of the Central Committee of the Communist Party of China (CPC) on Certain Major Issues Concerning Comprehensively Advancing the Law-Based Governance of China.1 It was also the first year to implement the 13th ‘Five-Year Plan’, which was adopted by the fifth Plenary Session of the 18th CPC Central Committee. The Plan highlights the rule of law as one of the four comprehensives setting up the main guidelines for mapping out the plan.2 Meanwhile, it calls on party members to use law-based thinking and methods to promote development and to comprehensively raise the party’s ability to govern the country and run the administration according to the Constitution and the laws.3 Focusing on the key task of raising the quality, legislation in 2015 was mainly made in the key areas of national security, people’s well-being, trial reforms, and sustainable development.4 During 2015, the Standing Committee enacted five laws, adopted amendments to 37 laws and one decision on legal issues, and passed eight decisions on legal issues.5
