Abstract:Chinese higher education has experienced dramatic development since the reform and opening-up in 1978 and especially the great expansion in 1999. The entry to WTO brings a fresh dynamic and opportunity to Chinese higher education. Under the new impetus, the pressing demands of cross-border higher education in China are mainly to expand access, raise funds, improve the quality of human resources and exert national soft power. On joining the WTO, China made efforts to integrate itself into the international community though the development and improvement of legislation, policies, and regulations in higher education that have achieved positive outcomes. However, some current challenges and barriers, including capacity building, administration and management, quality assurance, and qualification recognition still block the further development and need to be removed. The promotion of cross-border higher education in the future not only requires more strategic planning and policy support from central and local governments and higher education institutions, but also depends on a series of institutional transitions and deep reforms to meet the challenges and grasp the opportunities brought by WTO/GATS.

Abstract:In this study, we simulated three potential scenarios of an Australia-China Free Trade Agreement (FTA): removal of border protection on merchandise trade, investment facilitation, and removal of barriers to services trade. The analytical framework is a multi-country, multi-sector computable general equilibrium model, the Monash-Multi-Country (MMC) model. The FTA is found to deepen the two-country's economic partnership developed in the past fifteen or so years. On one hand, it sharpens the competitiveness of the Chinese manufacturing sector by reducing its costs of intermediate inputs. On the other hand, it raises the welfare of Australian consumers through improved terms of trade. In achieving a better utilisation of resources, adjustment of labour between sectors does occur. However, such adjustment is small in scale compared with what is occurring in the two countries amid globalisation without an FTA.

An Assessment of the ChAFTA and Its Implications: A Work-in-Progress Type FTA with Selective Innovations?

Abstract:This paper explores two questions of the recent China-Australia FTA (ChAFTA): what is the approach of the ChAFTA? What are the challenges to the ChAFTA? It argues first that the ChAFTA adopts a problem-solving approach to harvest “low-hanging fruit” (e.g. tariff cuts). Containing WTO-based and WTO-friendly rules, it focuses on trade and investment facilitation through market liberalization and carefully written good governance norms. In spite of its short form investment chapter, the agreement is not as shallow as one may first think. It stimulates development concerning, among other things, regulatory issues (e.g. regulatory transparency and cooperation in financial services, regulatory autonomy in investment), the negative list approach for services and investment, investor-state dispute settlement, and the investment facilitation arrangement. The development appears to be often affected by the position of Australia. Second, the ChAFTA will meet challenges in implementation and future negotiations. The former includes vague rules, soft obligations, the considerable need for wide-ranging cooperation, and the usage rate. The latter is probably the complexity of legal issues, as well as internal (including sensitive issues such as labor mobility and review of investment by Chinese SOEs) and external uncertainties (including the WTO law, the US-China investment treaty negotiations). Finally, the future of the ChAFTA depends on bilateral cooperation in FTA implementation, and the political willingness to develop a rule-based system. The ChAFTA could bring an incremental paradigm shift of China’s FTAs, which will carry vast implications for China’s participation in international economic legal order.

Abstract:The China-Australia Free Trade Agreement (‘ChAFTA’) negotiations begun under the Howard Government in November 2005, and was not concluded until almost a decade later. The ChAFTA creates encouraging prospects for both countries, regarded as a “landmark deal” that will safeguard Australia’s economy in the years to come. Despite that, high yield investments generally attach with it significant risks. The complexity of China’s legal system and often intertwining link between culture and business carries such risks, particularly in relation to cross-border commercial activities. Against the backdrop of the ChAFTA’s aim in fostering closer economic integration, the need for further in-depth engagement at all levels between both countries is crucial. The correlation between cultural eloquence and business success have never been more relevant. The success of businesses unlocking opportunities within Chinese markets will also be directly proportionate to the degree of insights on China. It is argued that extensive gaps between China and Australia’s mutual understanding will prove to be a major source of contractual disputes. Specific provisions of the ChAFTA’s master agreement are not expected to be finalised for another 12 months, at the very least. Anecdotes of prior commercial trading with China since its accession into the World Trade Organisation (WTO) have also been negative in general, where many disputes concern circumstances of contractual breaches. By undertaking a generic examination of the Chinese legal system along with recent reforms unveiled in China, a comparative of contract laws between China and Australia will be assessed within the ChAFTA context. Alternative dispute resolution mechanisms in China will also be examined, where recommendations of best practice guidelines in utilising the ChAFTA will be proposed. Finally, further practical recommendations deemed necessary in enhancing future Sino-Australian relations will be considered.

Abstract:China gradually pays attentions to the positive effects of Free Trade Areas(FTA). After the construction of ASEAN-China("10+1")FTA, China is negotiating the free trade agreement with Australia. The objective of this study is to examine the economic impacts of FTA between China and Australian. Based on a general equilibrium model of the Global Trade Analysis Project(GTAP), this paper shows the the economy of China and Australia is complementary and both countries will benefit from the FTA agreement. Australia will gain both from agricultural and industry sectors and will gains more from agriculture sector. For China, however, almost all gains are from labor-intensive industry sectors. Based on our analysis, some policy implications are discussed.

Abstract:When multilateral trade negotiations reach the impasse under the WTO frameworks, more and more countries are being fascinated by establishment of bilateral free trade area, as a period of bilateral trade is coming. On the basis of Cournot equilibrium, this thesis demonstrates that through setting up bilateral FTA actively, the power states will acquire much dominance in future's multilateral negotiations. That is to say, the chips in multilateral negotiations of these states will be increased. Based on the trade gravity model, it uses the American data to test and verify the reliability of the model. Finally, a conclusion will be obtained, that the multilateral negotiatons in the future will be a tussle among several interst groups.

Abstract:With the EU having an adventure in PTA negotiations after the serious setback from the Doha Round trade negotiations, China becomes increasingly concerned about the potential trade diversion effects and the possible G2 domination by the EU and the US in terms of rule-making power in world trade. This article offers both a quantitative and qualitative analysis of the potential impact on China from the EU's two major PTA negotiations one with the US and the other with japan. Chinese intellectuals who are paying attention to these two FTAs, however, have very mixed opinions, which can be characterized as positive, negative or what can be termed as 'marginal impact'. On the basis of the analysis of the mixed opinions, the authors make further predictions about the possible responses of the Chinese government towards new PTA strategy of the EU, and suggest that the EU's FTAs need to exhibit sign of greater amicability and accepting of differing opinions and most importantly, they should form building blocks, instead of stumbling blocks,for the multilateral trading system.

Abstract:China’s policy towards regional trade agreements (RTAs) will have a major impact on the international trading system, the debate about regionalism and multilateralism, and the policy of the WTO concerning RTAs. This article analyses China’s RTAs, identifies many reasons underlying them, and proposes a three–fold typology for China’s RTAs: economic integration agreements, standard regional trade agreements with other countries in the Asia–Pacific region, and bilateral free trade agreements with non–Asian countries. It then compares rules of origin, safeguards, and dispute settlement mechanisms in selected RTAs and evaluates them from the standpoint of WTO law. The article concludes, first, that the basic three–fold typology helps us to understand the objectives, organisation, and operation of China’s RTAs and their relations to China’s domestic structures, policy processes, legal and political culture and international and regional policies. Second, China’s RTAs are generally WTO–compatible since they are drafted in the shadow of WTO law, even though WTO law does not always provide a detailed normative template. Finally, China has the challenge and the opportunity of contributing to the development of a new role for the WTO in managing RTAs.

Abstract:The Trans-Pacific Partnership (TPP) is a multilateral free trade agreement (FTA) which aims to liberalize the economies of the Asia—Pacific region. The rapid movement of the TPP agenda, however, has caused China some disquiet. Originally, the agreement was signed among four countries (Brunei, Chile, New Zealand and Singapore) on June 3, 2005, and entered into force on May 28, 2006. In 2008, five additional countries (Australia, Malaysia, Peru, the United States, and Vietnam) began negotiations to join the group. On November 12, 2011, the leaders of these nine TPP partner countries announced the broad outlines of an expanded TPP: it will promote innovation, enhance economic growth and development, and support the creation and retention of jobs among the nine dynamic Asia—Pacific economies. Further negotiations are still underway, with Japan, Canada, and Mexico also having demonstrated a strong interest in joining. China actively promotes the regional economic integration of East Asia, which depends heavily on external neighboring economies. The TPP agenda is considered by many Chinese policymakers and scholars as a force that could rip apart the regional economic integration of East Asia. Moreover, a strong voice in Chinese academic and policy circles maintains that the main reason behind the Obama administration’s support for the TPP agenda is a desire to use it as a tool to economically contain China’s rise.

Abstract:This article examines the strategic and diplomatic aspects of China’s decision to form a Free Trade Area (FTA) with the Association of Southeast Asian Nations (ASEAN) in November 2001. An FTA represents one significant step forward in China’s economic diplomacy toward ASEAN, considering China’s involvement in other venues of regional economic affairs. An in-depth reading of the policy rationale contained in the Joint ASEAN-China Expert Study Group’s report shows that the FTA decision resulted from a largely diplomatic-political imperative on the part of China. Nonetheless, movement toward an FTA came about after studious Chinese efforts over a decade to win over ASEAN’s trust. In proposing the FTA, China pursues two strategic goals: development of its southwestern provinces, and competition with Japan in terms of demonstrating leadership in regional economic affairs.

Abstract:Driven by both economic and geopolitical imperatives, negotiation of the Australia-China Free Trade Agreement (ACFTA) has been slow and difficult. The negotiation process has reached an impasse since the latest round took place in March 2012. Major reasons for this include difficulties encountered in negotiating on agriculture, services, investment, and government procurement contracts and surrounding populist resistance from both Australian and Chinese domestic constituencies. Following more than eight years of negotiations and establishment of closer trade related ties, there is a lot at stake for both countries in the outcome of these discussions. This paper examines these issues and of the way forward towards a workable negotiation process.

Abstract:In 2020 Australia’s political relations with China plumbed new depths. Trade and other economic ties were also hit with disruption. Contributing to this deterioration, and complicating an accurate assessment of the consequences, has been a raft of misunderstandings. This article demystifies the bilateral trade tensions by exposing the deeper drivers of political friction, providing a critical assessment of the vulnerability of the Australian economy, and placing the current state of Australia’s relations with China in a comparative regional perspective. These discussions provide context for a detailed analysis of the legal issues that Chinese trade measures have created under the rules of the World Trade Organization (WTO) and the China – Australia Free Trade Agreement (ChAFTA). We show that these legal issues have been over-simplified in existing work. Abstract:What are the reasons that form the asymmetric anti-dumping pattern between China and Australia in the recent years? How did China obtain the admission of Australian government for complete market economic position through negotiation process? What lessons can be drawn for China's FTA negotiations with other countries? All these questions deserve our attention and careful analysis.This paper firstly clarified the asymmetric anti-dumping pattern between the two countries,then it conducted analysis from the aspects of business structure and demand of both countries as well as the degree of Australia's anti-dumping measures against Chinese products and the actual results.It also analyzed the trade deficit on the Chinese side and its sources and carried out some economic analysis from the view of industry chain.Thirdly,by introducing a two-country trade model and adopting dynamic game analytic method,the paper analyzed the establishment of market economic position of China and discussed the pre-conditions for Sino-Australia economic negotiation and thus showed the effectiveness of this method.
The Impact of the China–Australia Free Trade Agreement on Australia's Education Exports to China: A Legal and Economic Assessment

Abstract:As a landmark achievement in the development of the China–Australia bilateral economic relations, the China–Australia Free Trade Agreement (“ChAFTA”) achieves a higher level of liberalisation in education services compared with China's commitments under the World Trade Organisation and its other free trade agreements. However, the ChAFTA fails to relax the major regulatory barriers in China, which will remain the key obstacles to Australia's education services exports to China. Through a preliminary study and a regression analysis of the impacts of the ChAFTA on Australia's education exports to China based on available data, we show that the ChAFTA did not play a significant role in promoting the application and approval of Sino‐Australian joint programmes but did contribute to the growth of international student enrolments from China. The effect of the ChAFTA is, at best, secondary to that of domestic regulation and tends to be greater in less regulated areas.

Abstract:FTAs have mushroomed and proliferated at very fast pace in East Asia, especially after the Asian Financial Crisis (AFC) of 1997. The East Asian economies were very disappointed with the International Monetary Fund’s handling of the crisis. In particular, it provided some countries, like Thailand and Indonesia, with poor advice. After the AFC, countries like China, Japan, and South Korea signed FTAs with different countries around the world. The first East Asian FTA talks took place between Japan and South Korea in 1998. Like its neighbors, China also pursued FTAs with neighboring countries. The FTA between China and New Zealand was signed on the 7th of April 2008 and was implemented on the 1st of October 2008. As a result of this FTA, China has become New Zealand’s largest trading partner; New Zealand’s exports to China have quadrupled. As of June 2020, the trade between China and New Zealand exceeded NZ$32 Billion. China and New Zealand signed an upgraded FTA on the 26th of January 2021. The upgraded FTA includes rules relating to e-commerce, competition policy, government procurement, and environment and trade issues. The bilateral trade between China and New Zealand is complimentary rather than competitive; while China mainly exports manufactured products to New Zealand, New Zealand primarily exports agricultural products.

Abstract:This article concerns a free trade agreement (FTA) between Australia and China signed on 17 June 2015. It has been acclaimed that this agreement lays the foundation for the next phase of Australia’s economic relationship with China and predicted that it will unlock significant opportunities for Australia as China is Australia’s largest export market for both goods and services, accounting for nearly a third of total exports, and a growing source of foreign investment. However, concerns have been expressed that the Australia-China Free Trade Agreement is likely to have a number of retrogressive effects on the protection and promotion of human rights, including labour standards. This article explores differences between the free trade agreement negotiating precepts and cultures of China and Australia and the status of human rights in those negotiations, with an emphasis on understanding representative Australian attitudes. Although those negotiations are now a faint accompli, they are nevertheless of great interest. The article’s focus on the fate of human rights in the negotiation phase of the Australia-China Free Trade Agreement from the Australian perspective, together with the dynamics and nuances of the negotiation process giving rise to the Agreement, provides timely and significant insight on the implementation process, as well as a lesson-learned for future free-trade negotiations. The article argues that human rights should not be overlooked in the negotiations that lead to a free trade agreement. The article comprises seven parts. Section 1 introduces the subject-matter. Section 2 provides a historical overview of trade relations between Australia and China. Section 3 considers the complexity of negotiations between the two States and their different expectations and approaches. Section 4 outlines Australia’s major international human rights obligations including labour standards. Section 5 highlights specific human rights concerns raised in Australia during the Australia-China Free Trade Agreement negotiations. Section 6 observes other States’ approaches to human rights issues when negotiating their FTAs with China. Section 7 concludes that robust safeguards must be embedded and that a close consideration should be given to the implementation process, including the ex post human rights impact assessment of the Australia- China Free Trade Agreement.

Abstract:This article explores China’s commitments to liberalizing legal services under the recently concluded China – Australia Free Trade Agreement (ChAFTA). While China’s ChAFTA commitments extend beyond its commitments on legal services under the World Trade Organization and under most of China’s other Free Trade Agreements (FTAs), we argue that the degree of liberalization under the ChAFTA has been over-stated. The ChAFTA does not create additional market access for Australian legal practices as it merely recognizes the existing practice in the Chinese market and the same market access granted to Australia has been extended to all other foreign legal practices by initiatives launched in the Shanghai Free Trade Zone. Further, the ChAFTA fails to lift the major regulatory barriers to foreign legal practices in China. Consequently, Australian law firms will continue to compete with other foreign law firms in the same regulatory environment. China is likely to continue to unilaterally liberalize its legal services market via the free trade zones; but such liberalization is likely to be applied to all foreign legal practices. Towards this end, the benefits that the ChAFTA would bring to Australian legal practices are likely to be two-fold: (1) increased business opportunities in cross-border transactions, and (2) strengthened confidence in doing business in China.
Impacts of China-Australia Free Trade Agreement on Australian Agriproducts Trade

Abstract:The China-Australia Free Trade Agreement (ChAFTA) came into effect on the 20th December 2015 to strengthen the relationship between the two countries with a view to expanding their export and import industries. Specifically, ChAFTA includes the elimination or reduction of trade barriers between the countries in the form of tariffs or quotas. Removal of trade barriers will enable Australian industries to explore new markets and investment opportunities. This paper reviews the potential benefits of free trade with China in relation to major agricultural commodities and their possible impacts on the farm sector and regional Australia. The analysis shows ChAFTA will be beneficial to Australia but the impacts will vary across regions. Overall merchandise export trade is dominated by Western Australia which, together with a low proportion of import merchandise trade with China, shows Western Australia will take more advantage of ChAFTA compared to other States and Territories. However, benefits received by specific sectors will vary across the States and Territories. Victoria will benefit more from dairy, Queensland from beef, and New South Wales from summer crops, sheep meat, oilseed crops, and wool, compared to other States and Territories. This paper also analyses the possible impact of ChAFTA on an excluded commodity (wheat) using the Revealed Comparative Advantage (RCA) index. The result shows higher RCA on Australian wheat to trade with China compared to the world and other countries which have free trade agreements with Australia. In addition, South Australia has more RCA on wheat trade with China followed by Victoria, Western Australia, and New South Wales. This implies that, in the context of increasing population growth and growing demand for wheat in China, Australia has a good scope to increase its wheat exports to China. It would be worthwhile to start negotiations for a preferential FTA on wheat with China based on their requirements.

Abstract:The Chinese policy and academic communities have mixed views about the US-led TPP, either viewing it as a strategic attempt at encircling China, or as a positive spur for domestic reform and opening-up. Although the Chinese government adopted an open and flexible attitude towards the TPP, it has moved strategically by accelerating the negotiations of the RCEP and China-Korea FTA, as well as updating its FTA with ASEAN. A more interesting development is China's new initiatives for building two grand silk roads, one to Central Asia, leading on to Europe, and the other to Southeast Asia, leading on to the Indian Ocean. Both represent China's renewed confidence in finding its role in Asia.
