Abstract:The global expansion of public-private partnerships (PPPs) has generated interest in risk allocation for PPP projects. Many previous researchers have shown that without proper risk allocation, PPP projects cannot be successful. Current research is limited to equilibrium allocation of risk. The objective of this study is to improve this situation by constructing an alternating offer bargaining game model of risk allocation between two players involved in PPP projects, i. e., the public and private sector. Risk allocation can be analyzed as a game to more fully reflect the bargaining process among the parties. Equilibrium risk allocation outcomes were analyzed for the two cases in which the bargaining process was initiated in the first round by the public or private sector, and shows that risk allocation ratio is associated with the sequence of alternating offer, discount factor, and asymmetric degree of information. The probability, severity, and impact of risk factors were considered to prioritize risk allocation. Demonstrating the proposed model using a PPP project case study validated the model as effective and practical. This study contributes to the theoretical foundation for understanding the process of bargaining risk allocation of participants and provides a practical model to aid the participants to achieve fair risk allocation rather than a crude approach with preferences and biases. It promotes participants' rational and cautious behavior. This work also proposes a new risk allocation tool based on bargaining game theory for PPP project researchers to analyze game behaviors in the construction field. Abstract:In public-private partnership (PPP) contracting, a common practice for the hosting government is to fix the contractual clauses before signing a concession agreement with private investors. If there is no negotiation stage in a tendering process, the critical contractual parameters, e.g., the concession period, are usually stipulated by the government at the pre-contractual stage. However, due to the incompleteness of PPP contracts, the practice of presetting contractual parameters often leads to ex-post renegotiation or even project failure. Revenue uncertainty has become one of the most significant sources of PPP contract renegotiation, especially for user-pays PPPs such as highways and tunnels. In order to facilitate renegotiation between project parties in a user-pays PPP project, this paper develops a concession renegotiation framework targeting three critical contractual parameters, i.e., concession period, concession price and government guarantee, to control the revenue risk for project parties. Game-theoretic modelling is the approach used to determine the optimal adjustment values for the critical contractual parameters. The bargaining game model is developed to find the optimal adjustment values for the concession period and government guarantee when a renegotiation process is initiated, while the coalitional game model is employed to discuss renegotiation of the concession price. This study contributes to the theoretical foundation for understanding the renegotiation framework of user-pays PPP projects. Project JG is taken as a numerical example to validate the proposed model. The project parameters are extracted from the historical data for a local highway PPP in Yunnan, China and analysed using the econometrics software MATLAB. The renegotiation outcomes show that to control the revenue risk for private investors, the concession period needs to be extended to 34 years or the concession price adjusted to a number ranging between 4.38 and 5.13 USD. The data analysis outcomes also suggest that to control overly lucrative conditions for private investors, renegotiation of the concession price is a better choice.

Abstract:This paper identifies 38 typical renegotiated PPP projects since 1990s in China based on literature review,and makes the case analysis. Then,analyzes and categorizes the causes and outcomes of these renegotiations. Research shows that revenue risk,government credit risk,law and policy change risk are dominant causes of renegotiations,and renegatiations generally end up with adjustment of contract terms regarding to revenue allocation,or contract termination with the exit of the private partner. Finally,proposes policy recommendations on project front-end analysis,flexible contract terms and renegotiation mechnism,government credit,and government accountability.

Abstract:Income distribution, as a key decision of PPP mode, exerts a significant impact on the successful operation of a project. This paper introduces Stackelberg game model to analyze and compare the optimal effort level and income distribution of participants under two different decision situations including decentralized and centralized decision. Furthermore, using Rubinstein bargaining model, it discusses the profits distribution under centralized decision. The results show that the effort level and overall interests of the project under centralized decision are improved with respect to the situation under decentralized decision. Besides, reasonable profit allocation of the centralized decision could realize“Pareto improvements”.

Abstract:Since 2014, PPP has been developing rapidly in China and widely used in infrastructure construction such as transport, energy, sewage. The characteristics of long time, large investment and high complexity of PPP projects lead to the high incidence of renegotiation. However, experience at home and abroad indicates that most renegotiations are caused by the speculation of firms, in order to obtain subsidies to avoid taking risks and thus bring social welfare losses. Therefore, how to set reasonable renegotiation subsidy to improve project efficiency is an urgent problem in practice. This paper examines the impact of renegotiation subsidies on moral hazard and project efficiency. The problem of moral hazard refers to the fact that firms choose to make low level of efforts in advance (before risks occur) aiming at private profits. The paper firstly analyzes the intrinsic influence mechanism of renegotiation subsidy on the efficiency of PPP project by building a game model based on the incomplete contract theory and game theory, and then discusses the key factors affecting project efficiency, and finally puts forward corresponding policy recommendations. The research results show that: Moral hazard makes risk events more likely to occur, but enterprises can avoid bearing all the losses with the support of renegotiation subsidies, thereby increasing the incidence of moral hazard. Therefore, over subsidy will reduce the ex-ante efficiency, even if the ex-post efficiency still can be achieved. Controlling the renegotiation subsidy to a certain extent can avoid the occurrence of moral hazard, and achieve ex-post efficacy and financial efficiency at the same time. Optimizing policy variables such as private profit B, opportunity cost of re-tendering τ and legitimate profit of firms R-I can lower the requirement of government's negotiating power, making it easier to control the subsidy to the above scope. The research results can provide government with reference about renegotiation in decision making and provide theoretical support for the practice of PPP renegotiation.

Abstract:Effective supervision is one of the important ways to ensure the smooth implementation of Public-Private Partnership (PPP) projects. To understand the characteristics of the decision-making behavior of the public and private sectors in the supervision of PPP projects and the influencing mechanisms of some factors, we combine prospect theory and mental accounting theory into the evolutionary game analysis. First, we use prospect theory to reflect the behavioral characteristics of game players when making decisions and classify the value function into a valence account and a cost account according to the mental accounting theory. Accordingly, we construct a payoff matrix based on prospect theory and mental accounting theory, and the system’s equilibrium state is analyzed. Then, based on numerical simulations, the influence of different parameters on the behavior of the public and private sectors is analyzed, and management suggestions for practical reference are put forward based on the simulation results. The results show that the greater the perceived cost of active behavior for the public and private sectors, the less likely they will take active behavior. Secondly, there is insufficient incentive for the private sector to fulfill contracts when the penalties for its opportunistic behavior are minor. Thirdly, increasing the cost reference points and decreasing the valence reference points will promote the public and private sectors to adopt active behavior. Fourth, the public sector and the private sector are more inclined to take active behavior when they need to bear more significant risk losses. This study provides new ideas for the analysis of the game players’ decision-making behaviors in the supervision of PPP projects and delivers a decision-making reference for reasonable supervision.

Abstract:In recent years, the demand for infrastructure has been largely driven by the economic development of many countries. PPP has proved to be an efficient way to draw private capital into public utility construction, where ownership allocation becomes one of the most important clauses to both the government and the private investor. In this paper, we establish mathematical models to analyze the equity allocation problem of PPP projects through a comparison of the models with and without the effects of the theory of "contracts as reference points." We then derive some important conclusions from the optimal solution of the investment ratio.

Abstract:As public-private partnership (PPP) to address a significant funding shortage for transportation gains momentum in the United States, public agencies are also under pressure to demonstrate value for money and to deliver more for less on PPP deals. One critical challenge is how to optimize the concession length and amount of public subsidies so that a successful partnership can be established without undue sacrifice of the public interest. This paper presents an option game model for optimizing the concession length and public subsidy on a PPP project. The model integrates the flexibility of project expansion into the life-cycle analysis of project value, in addition to considering key factors, including subsidies, toll rate, and traffic uncertainty. The First Coast Outer Beltway project is used as an example to illustrate the process and merit of the option game model. In particular, by analyzing the trade-off between concession length and public subsidy, the paper provides new insights and implications for better PPP deal design.

Abstract:The public–private partnership (PPP) mode entails a variety of risks because the government, private enterprises, financial institutions, and other participants have different interests. To prevent private enterprise violations, dynamic government regulation of PPP risk‐sharing is necessary. Game theory is used here to examine the game behavior of government regulators, private enterprises, intermediary agencies, and the public in the stage of tracking management after the initial risk‐sharing of the project. Primarily, this study analyzes whether private enterprises provide fully compliant reporting and whether government departments check the information by investigating the behavioral motivations behind strategic choices. The primary contribution of this study was to construct a game model of government due diligence inspection under the condition of public participation in regulation. The results of simulations revealed the behavioral characteristics and stability of the participants of PPP in terms of decision‐making. Furthermore, a sensitivity analysis between the state variables and several auxiliary variables was used to reveal the internal relationships of the participants' strategic choices. This paper offers new insights into reducing violation behavior, protecting the public interest from harm, reducing government departments' regulatory costs, and promoting effective regulation with public participation.

An Evolutionary Game Analysis of User-Pay Public–private Partnership Projects

Abstract:Purpose With the growing demand for infrastructure and public services in recent years, PPP-UP have attracted a great deal of attention. However, while the user focuses on the payment for use and the private sector is concerned with its return on investment, the public sector pays more attention to the efficient utilization of public funds. In order to analyze the willingness of each stakeholder to join PPP-UP, an evolutionary game model involving the three parties is constructed. Design/methodology/approach An evolutionary game model is established that considers the users and the public and private sectors in user-pay public-private-partnership projects (PPP-UP). Eight scenarios of equilibriums and the game's evolutionary stable strategies are analyzed, and the corresponding stability conditions are then obtained. A situation where all three players are willing to cooperate in theory is also examined. The key influencing parameters that affect cooperation behaviors are further discussed. Findings First, the results illustrate that by properly adjusting the influencing factors, the cooperation status among the three parties can be changed along with certain evolutionary trends. Second, it is hard to modify unsatisfactory evolutionary stability by small changes in both the price compensation of and the construction and operation compensation. Third, it is necessary to involve the users in the decision-making process in PPP-UP and take their demands regarding benefits and payments into account. Originality/value In this paper, we focus on PPP-UP to research interactions among the public and private sectors and the users. Based on the analysis of the evolutionary game, to facilitate the successful implementation and development of a project, several conditions are needed to ensure tripartite cooperation. Several recommendations are then proposed for decision-makers in PPP-UP.

With the help of game theory analysis, this paper explores the performance of all interest parties relating to land acquisition of large infrastructure project, in which the interest preference of parties concerned, and characteristics of behavior are comprehensively studied. Based on it, two game models are established: the bargaining game under incomplete information between local government and peasantry, the game model based on principal-agent relationship between central government and local government. Interactions among central government, local government and peasantry are illustrated in analysis of the two models. Abstract:: Frequent occurrence of renegotiations and early-terminations in international contracts regarding the provision of public works and services through public private partnerships (PPPs) has raised concerns from various stakeholders in both public and private sectors. Renegotiations and early-terminations of PPP contracts may cause signiﬁcant losses to the parties involved and reduce the perceived strengths and advantages of PPPs against traditional in-sourcing procurement. Through a comparative analysis of international government PPP guidelines and model contracts and multiple case studies of diﬀerent types of PPP projects located worldwide, this study has identiﬁed and analyzed eight categories of risk events that often lead to renegotiation and early-termination in PPP practices, discussed the approaches to contingency management in view of such risk events, in particular the possible compensation methods respectively for the situations of renegotiation and early-termination, and established overall renegotiation and early-termination procedures. To improve PPP practices, public and private partners should build good relationships, prepare clear contract clauses, minimize opportunistic behavior and look for win-win solutions.

Abstract:Despite the consensus that enhanced cooperation among stakeholders is critical to the successful delivery of public-private partnership (PPP) mega-infrastructure projects, there has been a limited utilization of the quantitative approach to explore the cooperation mechanism. Drawing on research and the actual practice of PPP projects in China, a quantitative mathematical model using evolutionary game theory is constructed to explore the internal cooperation mechanism. Numerical simulation is implemented to investigate the impact of the punitive mechanism and allocation mechanism on the enhanced cooperation. The simulation result indicates that reasonable benefit allocation and a strong punitive mechanism are crucial to enhanced cooperation. Action research supported by a case study in Dalian was conducted to verify the scientific practicalities of the simulation method. An enhanced cooperation framework was proposed. The role conversion of the government and the private sectors makes the enhanced cooperation feasible. This evolution model and cooperation framework can facilitate enhanced cooperation in PPP mega-infrastructure projects.

Abstract:Sponge City Public Private Partnership (PPP) project is a significant step to promote the construction of resilient city and sustainable development. Private companies take advantage of information asymmetry and regulatory loopholes to take opportunistic behavior, which affects the project delivery quality and public interests. In order to reveal the decision-making mechanism of the main stakeholders, this paper constructs an evolutionary game model of private companies, citizens and the government from a fresh perspective of perceived value. First, the traditional payoff matrix is modified by combining Prospect Theory and Mental Accounting. Next, this paper analyzes the strategic evolution law and stability conditions of game players by replicated dynamic equation. Finally, Nanganqu project is used for empirical simulation to verify the effectiveness of this model. Results indicate that, (1) due to the complexity of the project and the bounded rationality of the participants, there is no evolutionary stable strategy in this game system. (2) The behavioral decision of participants is affected by perceived incomes and perceived costs. (3) Government punishment and reputation loss can effectively curb the opportunistic behavior. All above studies are expected to improve the management of Sponge City PPP projects, providing theoretical guidance for the government to make scientific decisions.

Abstract:Contractual agreements between public agencies and private companies in the form of public-private partnerships (PPPs) have proven to be beneficial to both the public and private sectors. However, PPPs expose the concessionaire to a number of potential risks over the long concession period and the concessionaire may not be able to recover the large initial investment and obtain a reasonable rate of return if significant difficulties occur in the concession period. Hosting governments normally allow concession renegotiations when certain serious risk scenarios occur. International PPP practices have shown conflicting results from renegotiations, and many renegotiations have raised serious questions about the viability of the PPP approach. To facilitate renegotiations between the public and private sectors, this research has developed a concession renegotiation framework and compensation models for three common compensation measures, namely, toll adjustment, contract extension, and annual subsidy or unitary payment adjustment. The key issue in developing a quantitative compensation model is to estimate future cash flows, in which future traffic demand and operation and maintenance costs are important stochastic variables. Time-series models have been used to forecast these stochastic variables.
