Abstract:Procedure division is concerned with a critical issue that which types of the first instance should be stipulated in the current amendments to the Civil Procedure Law. The procedure division scheme should include the following contents: retain the basic category of "summary-normal"; further divide the existing summary procedure into three types of procedure of "small amount", "speedy decision" and "summary"; guided by the "formation of rules", regulate the normal procedure when reducing the scope of application of the collegial system; with regard to the procedure design, on the whole, attention paid to the connection and the integration of mutual relationship between justice and the ADR. The necessity of setting up the small amount procedure and detailed procedure design are discussed. In addition, this article explores the application scope of summary procedure and the connection between normal procedure and appropriately prolonging the time limit for concluding a trial and collegial system based on the category of case types in judicial practice. Furthermore, suggestion of introducing "special appeal" system to promote the superior courts to develop guided cases through direct judgment is put forward.
