Abstract:The Constitution of China has established the mode that the supreme organization of state power supervises the implementation of constitution. Being proved in practice, the system design has become inoperative. It is not that the imperfection of constitutional supervision procedure, but that the model is against the nature of constitution supervision. Constitution supervision is the brake of the Only the judicialized supervision can take on the important task. The constitution supervision with the characteristic of judicature can be consistent with supremacy of parliament and majority democracy. Constitution is law, and then the supreme law. The legal nature of constitution also means that constitution can be and should be applied by the judicialized organizations.
