Abstract:The mixed mode in Philippines' criminal legislation of intellectual property rights is helpful to the stability and adaptability of the Penal code facing frequent changes of the social relations.The system of accusation in the Philippines is relatively complete.In principle,any intentional infringement on intellectual property rights constitutes a crime.There is a provision that only view criminal intent as the subjective element of some individual crimes of infringing on intellectual property rights and the objective factor is not the only option,which is a looser regulation compared with the provision——"profit-oriented" in Chinese copyright crime.There are various behavioral patterns in the Philippines while China has few in the crime of infringing intellectual property rights.Although a criminal threshold is stipulated in both China and the Philippines,it is not scientific to set a plot like" the amount of illegal income" in China's since it has an adverse effect on judicial cognizance.The two countries' penalty settings on the crime of infringing intellectual property give priority to short-term freedom penalty and also set up pecuniary penalty,which do good to punishment and prevention of that kind of crime.Yet in setting of the amount of criminal fine,both China and the Philippines need to reference the way that combines limited criminal fine system and multiple proportion criminal fine system.
