An Analysis on the Environmental Provisions of the U.S.FTA

Abstract:In recent years, the relationship between environmental protec-tion and trade development has attracted widespread attention.The U.S.is a pi-oneer that incorporates environmental provisions into FTA.From NAFTA to the U.S.—Peru Trade Promotion Agreement,al of the U.S.FTAs incorporate envi-ronmental provisions and thus develop a paradigm of environmental provisions under FTAs.Understanding the paradigm and the impact of environmental provi-sions under U.S.FTA and drawing on its experience, China should be cautious when negotiating FTA with environmental issues, so as to balance the relationship between trade and environment, and to safeguard its national interests.
