Abstract:The development of Internet banks puts forward the new challenges to our present laws. Market access and quitting of Internet banks, the protection to the right of privacy of Internet banks' customers, the conflict of Internet banks and legal system of commercial instrument, supervision about Internet banks, legal effect of electronic signature and the legal responsibility of Internet banks. Abstract:The Electronic Commerce Law of the People's Republic of China does not solve all tax problems, and also exposes many difficulties during its implementation. This paper analyzes the problems existing in my country's e-commerce tax collection and management: the demarcation of tax objects is blurred, and the tax system is facing severe tests; traditional tax law enforcement is difficult to cope with the development of e-commerce, and law enforcement methods need to be innovative; High; platform operators fail to play a supervisory role, and tax authorities cannot obtain transaction information in a timely manner; e-commerce business process supervision is not in place, and the management mechanism needs to be improved. The following suggestions are put forward: first, improve laws and regulations to form a multi-level legal system; improve The online trading market supervision system regulates the responsibilities of third-party platforms, and avoids tax evasion and tax evasion through the agency mechanism. Abstract:Abstract This paper focuses on the innovative application of civil and commercial law in the context of e-commerce in the Internet era, and explores how e-commerce affects the application and innovation of civil and commercial law, aiming to provide theoretical support and practical guidance for the legal environment in the era of e-commerce. A combination of theoretical Analysis and Poisson regression model is used to analyse the impact of e-commerce on civil and commercial law, and a robust regression model based on mean drift penalty is constructed for quantitative Analysis. It is found that the development of e-commerce positively impacts the effectiveness of civil and commercial law. The data show that for every unit increase in the level of e-commerce development, the efficacy of civil and commercial law increases by 0.318 points (p<0.01). In addition, regional analyses show that e-commerce has the most significant impact on civil and commercial law in the central region, followed by the west and the east, and the impact is not substantial in the northeast. The time-lag effect analysis shows a weak lag effect on the impact of e-commerce development on the effectiveness of civil and commercial law. The conclusion indicates that in the context of the rapid growth of e-commerce, it is necessary to innovate the application of civil and commercial law to adapt to the new business environment, protect the legitimate rights and interests of both parties to the transaction, and promote the healthy development of e-commerce.

Abstract:This paper surveys the legal and regulatory environment surrounding copyright protection technologies, focusing on China in particular. The paper begins with a discussion of some of the interactions between law and technology in copyright protection, which has led to the creation of international treaties to protect the technologies that protect copyrights. A comparison of the various national responses to these conventions is presented, followed by a discussion of the structure and development of the relatively advanced Chinese system for copyright protection technology. The last section outlines some of the unique challenges that have arisen in China for copyright protection technologies and the businesses that depend upon them.

Abstract:Digital technologies have transformed our lives with unimaginable speed and scale, delivering immense opportunities and daunting challenges and leading to the birth of the digital economy. China and the United States (US) are two leading countries in the digital economy in both size and growth rate. This study employs both quantitative and qualitative methods to investigate the similarities and differences between the US and Chinese legislation from a sociosemiotic perspective. By comparing the high frequency words in the two purpose-built corpora, it can be noted that as digital economy, a social sign, has the characteristics of spatiality and temporality. The US federal legislation related to digital economy focuses more on security and protection and has more specific regulations in individual industries, while Chinese legislation is more concerned with the strategy and guideline of development of industries and technologies in digital economy. In the meantime, information infrastructure and information and communication technologies are identified as the foundation and core elements shared in the two countries' digital economies. Such a corpus-based sociosemiotic exploration of digital economy can shed light on relevant studies in the discourse analysis of legal texts.

Abstract:当今数字经济逐渐成为了推动中国经济增长的新引擎。然而,数字全球化在为中国经济注入新动能的同时,也给中国带来了数据安全、数字鸿沟、数字平台无序竞争和产权保护机制缺失等一系列问题,凸显了中国对数字经济进行有效监管和系统性治理的能力不足。为此,本研究通过文献和实地调研的研究方法,梳理了中国数字经济基础法律制度的建设情况,并发现了中国数字经济基础法律制度存在着法律权威性不足、法律体系不健全、法律之间的协调性不够、立法模式不明确以及法律概念基础研究不足等问题。为了解决这些问题本研究认为,中国在进行数字经济基础法律制度建构时,应坚持系统、综合的立法思维,强化制度之间的整合,注重伦理与法治的结合研究,不断提升数字经济法律制度的前瞻性、科学性和权威性,从而不断提高中国数字经济的法治化水平,从而支撑数字经济健康、持续发展。
Critical Analysis of Liability of Internet Service Providers for Indirect Patent Infringement

Abstract:With the rapid evolution of e-commerce, existing Chinese laws have struggled to keep pace with complex issues arising from digital transactions involving intellectual property, especially when addressing indirect patent infringement on e-commerce platforms. By conducting a comparative analysis with international laws from Germany, Japan, and the United States, the paper identifies robust legal frameworks that explicitly address indirect infringements in the digital marketplace. The paper proposes several legislative improvements for China, including the clarification of what constitutes indirect infringement, the outlining of explicit duties for e-commerce platforms, and the creation of specialized mechanisms for dispute resolution. On the judicial front, recommendations include enhancing the specialization of courts and judges in intellectual property, developing detailed procedural guidelines, and promoting alternative dispute resolution methods to mitigate the burdens of litigation. By adopting and adapting these recommandations, China can enhance its protection of intellectual property rights and support the dynamic environment of innovation that e-commerce fosters. Strengthening the legal framework in this way is crucial for ensuring fair competition and encouraging technological advancements within China's digital economy.

Abstract:With the high development of Internet technology and the global impacts of Covid-19, a trend of multiple growth is being shown in the business of cross-border e-commerce. The issue of intellectual property rights becomes more obvious in this new mode of trade than in others. China’s "14th Five-Year Plan" marked the beginning to implement the strategy of the intellectual property rights for a powerful country. Through the law-and-economics analysis, this paper analyzes the research reports of China’s Intellectual Property Court and American Chamber of Commerce, and finds it essential for the cross-border e-commerce to attach great importance to the risk control and protection of property rights. After the analysis and research, on the possible risk of intellectual property rights faced by cross-border e-commerce, it is proposed that enterprises must not only pay attention to but also actively identify and conduct risk warning of the legal risks of their own intellectual property rights as well as the causes of them, so as to put forward corresponding risk control measures and construct prevention and protection mechanisms.

Through comparative analysis of international and domestic legal frameworks, alongside a review of infringement cases, this research delineates the primary infringement modalities—trademark squatting and counterfeiting. It emphasizes the need for a multi-faceted approach involving legal reforms, enhanced judicial protection, and proactive risk prevention measures. The findings underscore the critical importance of adapting China's intellectual property laws to the dynamic global e-commerce landscape and fostering a robust trademark protection ecosystem to safeguard and stimulate the country's economic globalization ambitions.

Abstract:As a vital element of core intellectual property for businesses, trademarks play a crucial role in upholding brand image, safeguarding consumer rights, and fostering fair market competition. This paper aims to delve into the challenges encountered in trademark rights protection within e-commerce based on relevant content from trademark law. It further proposes corresponding legal strategies to address these challenges with the goal of promoting sustained and healthy growth within the e-commerce industry. This study uncovers complexities and covert nature associated with trademark infringement activities in e-commerce, as well as widespread cross-border trade infringements and high costs related to evidence collection and rights protection. Corresponding measures to address these issues are then proposed. The research findings underscore the significance of refining laws and regulations, bolstering international cooperation and judicial assistance efforts, intensifying enforcement measures and penalties, as well as establishing robust mechanisms for protecting rights. This paper holds substantial importance in advancing a healthy environment for e-commerce industry development, maintaining equitable competitive market conditions, safeguarding legitimate rights of trademark holders and consumers, and propelling forward intellectual property protection system construction within the realm of e-commerce.
