Abstract:The World Trade Organization (WTO) is the legal and institutional foundation of the multilateral trading system. It also provides the principal guidelines determining how member states frame and implement domestic trade legislation and regulations. And it is the platform on which trade relations among countries develop through collective debate, negotiation and adjudication (The WTO... Why it matters 2001). For example, Bangladesh has a per capita income of $ 1,086.8 whereas; the People's Republic of China has a per capita income of $ 7,590.0. Despite the obvious disparity between those two countries' economies, both countries can claim equivalent treatment from each other for the purpose of determining the economic category ("World Bank: GDP Per Capita,"). Joining the WTO (World Trade Organization) in 2001 is a historical event for china. China has gone a long way to redefine itself in the world affairs, in the family of nations and, in the world public order. China ' s current open door policy was adopted since 1978. What China has embarked on under its open policy has not only benefited its 1.35 billion people, but also exerted great impact on the rest of the world. Only against this historical context could one fully appreciate what China is doing, both at home and on the world scene. The new open door policy was not just a replacement of the old one. It differed from the old one in this time as the Chinese government was no longer forced by the western powers to open its doors. China decision to the GATT and later on the WTO was a result of this new policy. China has played an increasingly central role in regional trade specialization (Chongdou, 1986). Tariff reforms have been implemented in China since the 1980s and with its WTO accession, China has committed itself to additional reforms that are far reaching and challenging. The thrust of this paper is to examine China ' s commitments and to determine the implications of the WTO membership on China ' s trade and legal policy. It starts by assessing the negotiation history to access to the GATT and the WTO and ends up by measuring the gap between China ' s commitments for membership and its current practice and moves further with and assessment of the implications.Accession Process in WTO: Integration and Capacity BuildingThe creation of the World Trade Organization (WTO) is one of the biggest and significant events in world trade aftermath of the Second World War (VanGrasstek, 2013). WTO came into force in January 1, 1995, before that the GATT (General Agreements on Tariffs and Trade) recognized as a de facto international trade organization among the contracting parties after it was signed on 30 October 1947 (VanGrasstek, 2013). The journey form GATT to WTO was about 47 years long, where the GATT functioned and provided the mies for much of world trade and presided over periods that saw some of the highest growth rates in international commerce. It seemed well- established, although throughout these years, it was a Provisional Agreement and Organization (Blanche, March 2004). The GATT's general objectives are to ensure that its contracting parties conduct economic relations with a view to raising standards of living, ensuring full employment and a large and steady growing volume of real income and effective demand, developing the full use of the resources of the world and expanding the production and exchange of goods ("Marrakesh Agreement Establishing the World Trade Organization," 1995). The following paragraphs narrate the historical facts of China ' s legacy as one of the original parties of the GATT :China as an Original Contracting Party of GATTThe first round of GATT negotiations was a package of trade rules and 45,000 tariff concession, which affected $ 10 billion of trade, about one fifth of the world ' s total China was one of the original contacting parties of the General Agreement on Tariffs and Trade as the government of China attended the Second Preparatory Conference of the United Nations Conference on Trade and Employment from April to October 1947 which was held by the United Nations Economic and Social Council in Geneva. …
