On the Perfection of the Crime of Bribery in China

Abstract:The system of the crime of bribery in China is messy, incomplete, and uncoordinated, which reduces the crime and causes unfair penalty.In terms of crime manner categorization, besides the standard of "subject-behavior", China also divides the crime according to institutions and individuals.However, this standard overlooks the danger of the subject of institution bribery, punishing it significantly lighter than the individual criminals, so this standard should be eliminated.The crime system is incomplete in that the introduction of bribery is not reasonable.In essence, the "asset interests" as the narrow bribery range, together with the elements of interest, lets go of some bribes from punishment.To conclude, the elements of interest should be canceled, and the bribery range should be expanded to "unrighteous benefits", which are of important influence on the punishment of bribery crime in our country.
