CHARACTER AND PATH CHOICE OF FISHING LIMITATION SYSTEM IN CHINA

Abstract:This paper tries to clarify the nature of China's ″limited quota fishing system (bulao xian'e zhidu)″, and to work out a conceptual model for its implementation. In its first section, the nature of the limited quota fishing system is analyzed in accordance with the essence underlying the Article 22. The analysis shows that China's limited quota fishing system is in principle compatible with the ITQs system that has been widely employed in fisheries-advanced countries in the last two decades. Next, the root clause of fisheries problems is explored, which make it clear that overcapitalization and over fishing would be hardly tackled without well-defined and effectively-enforced property rights to fisheries resources. Following from this, the theoretical context from which the ITQs are formalized is examined (Section 3) and the rationale and institutional advantages of ITQs system is explained (Section 4).
