A review of the new provisions for sanctioning mentally disordered offenders in China, in a broader historical context

Abstract:Reforms of the criminal justice system in China in recent years have included the 2012 Code of Criminal Procedure (CCP), which resulted in new disposals for mentally disordered offenders. From a Western perspective, changes in Chinese criminal law are sometimes clichéd as toothless window dressing, but they may represent a genuine step forward in safeguarding human rights. Taking a historical perspective, this paper reveals that in the East, as much as in the West, there is a 'moral tradition' of not punishing mentally disordered offenders who are not considered responsible for their acts. There are clear differences in disposal for those acquitted having been found 'not guilty by reason of insanity'. Whereas Western jurisdictions have offered (criminal) courts the opportunity for commitment in (forensic) mental hospitals from the early 19th Century, in China, disposal has remained, until the recent changes, the responsibility of the administration (mainly the police) or the family of the offender. A few high profile cases brought to light the inadequacy of these arrangements and the general disregard of obvious mental health issues when sentencing offenders. There was lack of clarity regarding who would take responsibility for treatment and issues of future public protection arising from a mental disorder. The 2012 CCP introduces the power of mental health commitment by the judiciary for those found non-responsible for an offense because of a mental disorder. Similar to provisions in Western jurisdictions there remain human rights concerns regarding aspects of 2012 CCP and the role of 'preventive detention' for mentally disordered offenders on indeterminate secure mental health detention. Nevertheless, the shift to judicial decision making in such cases and the possibility of mental health commitment are welcome steps in improving the human rights of this vulnerable population.

The Perfection of Non-penalty Rectification System about Minor Crime in our Country

Abstract:Since the minors are not mature in physiology and intelligence,their outlooks on life and the values not yet formed thoroughly.They should be rectified in the non-penalty measures to their crimes as far as possible.At present our country′s legal rules providing the non-penalty processes for minor crimes are just "Criminal law" 17th article and 37th article.The 37th article looks on "that crimes because they are so slight that they are not deserved the penalties" as" a pocket",all cases within this "pocket" may be given "exemption from punishments ".These two stipulations displayed the altogether eight non-penalty rectification measures.Obviously,this kind of stipulation is too simple and far from the system stratification plane and thus just nominal in practice.In the semantics,the non-penalty rectification system about minor crime should contain four aspects in contents and five aspects in extension.To construct this system needs to determine the basic guiding principles,clear about the applicable objects,formulate exhaustive rectification measures and design normal standards of operation procedure to each of the measures.

Abstract:Community correction is a systematic project, of which the risk assessment mechanism is the base for community correction. Risk assessment on the personnel who serve a prison sentence can improve the quality and effect of community correction, reduce the recidivism rate, and realize a social and scientific community correction. Shanghai is the first city to practice risk assessment mechanism in community correction, has accumulated a lot of experience from this practice and has made great achievements. However, there are still problems in its contents and performances, such as situation intervention in the first assessment, the qualification of the assessing personnel and the draw of assessment sheets. Therefore, we should test the risk assessment mechanism, and perfect the professional training, the assessment sheets, the coordination of assessing departments and the inspectional system of assessment, so as to provide scientific guidance for the performing departments.

Abstract:Legislators have given high attention to the treatment of minors who have committed criminal acts but have not reached the age of criminal responsibility and are unable to receive criminal punishment. In recent years, China has experienced a series of malignant criminal cases caused by juvenile delinquency. Due to insufficient legal provisions, it is also difficult to regulate the criminal behavior of juvenile offenders. In this context, China lowered the age of individual criminal responsibility to 12 years old in 2021 through the Amendment to the Criminal Law(11), revised Article 17 (5) of the Criminal Law, introduced professional corrective education measures applicable to minors who have committed crimes. And revised the Prevention of Juvenile Delinquency Law, determining professional corrective education as a protective disciplinary measure. These legislative amendments not only express China's position that it protects its citizens through special regulations on juvenile delinquents, but also demonstrate the diversity of criminal measures to eliminate the risks of juvenile delinquency and promote their im- provement through professional correctional education measures when criminal punishment is not feasible due to the special nature of juvenile delinquency in the new era. At present, the regulations on specialized corrective education have been determined by the Criminal Law and Prevention of Juvenile Delinquency Law. However, the Criminal Law only provides abstract and principled provisions on professional correctional education through one article, and the specific content is stipulated in the Prevention of Juvenile Delinquency Law, but there are shortcomings in practical application, which need to be explored based on the problems. It is worth mentioning that the applicable rules for special corrective education are not yet perfect, and there are no clear provisions in the applicable conditions regarding the minimum applicable age and “when necessary”. The procedure adopts the model of “evaluation and approval by the special education guidance committee and joint decision by the education administrative department and public security organs”, but there are doubts about the rationality of this procedural provision. In this context, the paper attempts to propose an improvement plan for professional corrective education applicable to juvenile offenders in China's criminal justice system.

Abstract:Juvenile criminal cases of two years in B Court,A City show the practical problem in criminal penalty for juvenile delinquent,which lies in inadequate implementation of criminal judicial policy for juveniles,the insufficiency of lenient penalty and unbalance of sentencing.The main reason is that it lacks the right of determining sentence and severe regulations in substance and institutional barriers in exercising right of sentencing discretion in procedure.Therefore,it is necessary to perfect mechanism of criminal penalty for juvenile delinquent by perfecting criminal substantive regulations and guarantee mechanism in sentencing procedure to provide legal basis and ensure sentencing justice.
