Reflection of the Banking Crisis Management in China from a Legal Perspective

Abstract:We can't deny the fact that banks play a key role in our society, while it is impossible to avoid banking crisis even under the strictest supervision. The current legal system in China for banking crisis management is imperfect. It lacks both sufficient means to resort to, and enough protection for individual depositors in case of a crisis. The main practices in foreign developed countries are the lender of last resort (LOLR), the deposit insurance system and Market-withdrawal system. LOLR aims to save the banks which run into payment crisis temporarily. Usually this operation is performed by a country's central bank. The deposit insurance system is designed to divert the risk. Once a bank crisis occurs, the deposit insurance institution will repay the depositors' deposit in certain proportion. In order to make banks adaptable to market competition, we should enact banks market withdrawal legislation.We need to improve our bank crisis management mechanism in following aspects: (a) improving the restructuring mechanism; (b) constructing the emergency measures; (c) improving the merge and bankruptcy system; (d) reforming the lender of last resort system; and (e) establishing the deposit insurance system as soon as possible. We need to enact detail rules to regulate the take-over system, including the definition, precondition, object, terms, limitation and redress of the take-over action. Apart from take-over system, we should form certain short-term contingency plans. Banks tend to merge to improve their competitiveness and some of them can't avoid bankruptcy in market economy, so we should enact relevant laws and regulations. Since abuses of LOLR system will result in disrupting the market competitive system and lead to moral hazard, it is necessary to formulate strict standards in order to apply LOLR system cautiously. The deposit insurance system, which has proven satisfactory in western developed countries for decades, needs to be established in our country as soon as possible.

Abstract:This study focuses on whether China's financial system still needs market-oriented transition after the recent global financial crisis, which suggests financial liberalisation may weaken financial stability. We analyse the structure of the financial system and highlight the fact that the current system is not well configured for dealing with fluctuation. The good economic performance over the crisis is mainly built on the administrative resources deployed that counterbalanced the negative effect of short-term fluctuation. The high cost of this makes market liberalisation reform imperative. We take the German financial model as an example to indicate how financial liberalisation and stability can coexist under certain conditions.

Abstract:We compare China's financial system to those of the developed countries, in particular, the US system dominated by financial markets, and the German system dominated by the banking sector. We examine financial systems' properties, including risk sharing, information provision, funding new and mature industries, financial crisis, corporate governance, and the relation between the financial and legal systems and economic growth. We find that there are many fundamental differences between China's financial system and the US system, and simply adopting the US system is not optimal. Understanding the German system and reform China's banking system should be as important as developing US-style financial markets. Our findings also suggest that China differs from most countries studied in the law, finance, and growth and comparative financial systems literature: Despite its poor legal and financial systems, it has the largest, and one of the fastest growing economies in the world. We find that there are effective, informal financing channels and governance mechanisms to support the growth of various firms in the economy. Therefore, it may be best for China to develop its existing financial system, and to ensure that the informal financing channels and governance mechanisms continue to work along with the development of the legal and financial systems.

Abstract:The 2008 US financial crisis prompts the Japanese to reconsider the US patterns and Koizumi's economic policies.Democratic Party of Japan won the election in this political environment.Mr.Yukio Hatoyama became Japan's prime minister but resigned in 9 months.His successor,Mr.Naoto Kan proposed the third way policy and Asian economic strategy to improve Japanese economy.However,Democratic Party of Japan was defeated in the House of Counsillors election,seriously weakening its administrative capacity.Further introspection and probing will continue:to Japan,China has begun to be more important than the United States in terms of economic recovery.

Abstract:The global financial crisis triggered by American subprime mortgage crisis results from the financial systems,led by Wall Street,of Europe and the United States which violate such three principles of financial industry as being rooted in industry and commerce,strict risk management and control,as well as moderate leverage rate.China's financial industry should prevent such five trends as excessive overlapping policies,increasing enterprises' financing cost,too much privileged consciousness,too high income and weak service consciousness.Crisis-prevention should use such four balances as the gross proportion of loan to GDP 1∶1,gross proportion of securities market value to GDP 1∶1,gross proportion of total real estate value to GDP 1∶1,and gross proportion of national sovereign debt plus social security expenditure to GDP 1∶1.Crisis solution should not only depend on self-circulation of financial industry but rely on scientific and technological progress and tangible economy development.

Abstract:The historical significance and the social costs of the sub-prime crisis are examined in three separate but related sections.The sub-prime crisis originated from the financial turmoil in the USA in 2007,and soon turned into a serious world economic crisis.Section 1 treats the specific features of the sub-prime crisis particularly in comparison with the Japanese bubble of the 1980s and the ensuing crisis of the 1990s,and discusses why the crisis became re-coupled this time.A notion of financialization of labour-power as an important new trend is also presented.Section 2 pursues the comparison further by discussing briefly the great depression that followed after 1929,and suggests reasons why the current crisis might not be equally drastic.Finally,section 3 probes into the social costs of the crisis in four aspects. They proved the failure of neo-liberal belief in the rational efficiency of unregulated market principles,and concluded the age of neo-liberalism.

Abstract:The research on the protection theory of financial consumers' rights and interests can not only effectively relieve the pressure brought by the epidemic on economic development, stabilize the volatile financial market, promote the healthy development of the financial industry, but also accumulate the experience of dealing with the crisis of the epidemic and prepare for the unknown future. Abstract:Looking back on the developmental course of Japanese financial system from the Meiji reformation(1868) to the Koizumi's times(the end of the 20th century),this paper discusses the role of the government in financial system.The thoughts of Japanese financial administration were originated from modern economical development after the Meiji reformation(1868).By learning from the western financial system,Japanese government guided the reform of Japanese financial system.In the process of institutional games,the developmental path of Japanese financial system was formed.The mode of propelling the development of financial system by the force of government is the main reason why Japan can't surpass the western countries after it caught up with them.

Income Distribution and Financial Structure:A Comparison between China and Japan

Abstract:Based on a new perspective whether income distribution will influence financial structure,this paper adopts international indexes of financial development and makes a comparison between China(since 1992) and Japan(1971-1989) in period of prosperity and transition,using data from National Income Accounts and Flow of Funds.We have two findings:(1) Japan's National Income Doubling Plan increases household share of national income,thus stimulating Japan's financial marketization and financial development.(2) It is the difference of income structure between China and Japan that leads to the gap of financial development.Consequently,we propose that a reform of income distribution will help improve China's financial structure.

Abstract:The recent earthquake in East Japan has to some extent damaged the infrastructure in the affected area,hence shocking the supply chains of the real economy and manufacturing.However,thanks to its stable and developed financial system,its response to the crisis was quick and proper and the crisis relief funds have been allocated promptly after the disaster hit the nation.Furthermore,in handling the post-crisis yen appreciation,the monetary sector's response was also appropriate,hence maintaining stable capital flows both domestically and overseas.In the short term,the crisis has not had any significant impact on the global capital market.Nonetheless,in the longer term,if Japan is not able to tackle its deep-rooted structural problems,it may face the crisis of fiscal bankruptcy,which may in turn have a profound impact on the global capital market.

Abstract:We can analyze the emergence,expansion,solutions and such important issues of the global financial crisis from the perspective of economic law theory.The emergence of the financial crisis stems from the "market failure" and the "government failure",which reflects the importance of strengthening the economic law adjustment.The expansion of the financial crisis directly related to the special "dual structure" in economic law,such as the domestic economy and foreign economy,the real economy and virtual economy,the internal economy and external economic.The solutions of the financial crisis also required to coincide with the three basic principles of economic law.As to the specific measures,we should set the different types of legal responsibilities according to types of related subjects and use the comprehensive adjustments of the various departments of economic Law.Only these measures were taken,the coordination of economic and social development can be achieved.

Abstract:The Japanese financial system is regarded as a key factor behind Japan's remarkable post-war growth. The main bank arrangements, linking companies with a principal source of funds, and complementary institutional networks were complex and intricate, and underpinned industrial investment and expansion. In the 1950s, the city banks, as the main banks of manufactures, were asked to supply large amounts of funds to their clients, acting as substitutes of the stock market. As their liquidity decreased, post-war reconstruction policies reduced their risk-bearing capabilities. In order to stabilise the system and to sustain the funds needed for strategic industries, the Ministry of Finance and the Bank of Japan began actively to regulate the financial markets, while the Ministry of International Trade and Industry co-ordinated policy with the industrial sector. It was this system of complementary institutions, including the main banks, long-term financial institutions, and government agencies, which enabled Japan's high-speed growth.
