Abstract:The development of Internet banks puts forward the new challenges to our present laws. Market access and quitting of Internet banks, the protection to the right of privacy of Internet banks' customers, the conflict of Internet banks and legal system of commercial instrument, supervision about Internet banks, legal effect of electronic signature and the legal responsibility of Internet banks. The safety of Internet banks can be guaranteed by passing the legislation of electronic signature law, strengthening supervision, regulating the behavior of Internet banks and enhancing the practical standard of Internet banks.

Abstract:The U.S. government's online information transmission management system includes three parts: the management of harmful information, the coordination of E-commerce order, and the construction of web safety system. Both China and the United States are countries with huge numbers of internet users, and the U.S. government's experiences in managing the online information system provide us with many useful references. These include: 1) establish a better internet and web law-making system based on the development of the internet; 2) government should invest more on internet security research to maintain the safety of internet information transmission; 3) government should integrate social resources to improve internet users' literacy, especially to educate adolescents about internet security knowledge through Chinese educational system.

Abstract:Constructing a green and harmonious cyberspace in a network content ecosystem is a beautiful vision for millions of netizens. This study, by establishing a self-compiled corpus of judicial discourse from digital platform typical cases in China and using a combination of corpus-based approach and case analysis method, represents the development status of the Chinese network content ecosystem in order to develop a model for understanding and evaluating a network content ecosystem. Based on the analysis results of Chinese judicial discourse, an evaluation model, namely the People, Object, Technology, Organization, Government, Environment Framework (POTOGE), is derived after examining and evaluating four conceptual frameworks of the People, Process and Technology Framework (PPT), the Technology, Organization and Environment Framework (TOE), the Real Access/Real Impact Framework (RA/RI) and the People, Technology, Organization and Environment Framework (PTOE). To some extent, the POTOGE evaluation model presents a holistic and comprehensive perspective for understanding and evaluating a network content ecosystem and its key components, which can provide a reference for testing standards to ensure the sustainable development of current and future network content ecosystems. Meanwhile, the insights obtained from this study may help deepen our understanding of the judicial discourse and its thinking in the network content ecosystem. The analysis results of typical cases on digital platform can provide a reference for the formulation of future relevant laws and regulations and improve the legal protection and prevention awareness of society.

Abstract:Legal issues with regard to the Internet are either public or private issues.Copyright in cyberspace is seldom described or concerned in civil rules or regulations.The improvement and development of the copyrights will be in close association with the development of information technology.WCT and WPPT would support the protection of copyrights in cyberspace and the defendant cannot avoid copyright protection measures.Imputation Principles between the ISP and ICP are different and the responsibility of ISP can be exempted if ISP does not infringe users' interests intentionally.The P2P technology has aroused many troubles which should be regulated appropriately by way of developing the existing legal system and theories.

Abstract:There are frequent banning behaviors in the field of Internet platforms in China, which harm the interests of other operators, harm market innovation, and damage the rights and interests of consumers. The market self-healing function in traditional economics does not have a realistic basis and cannot play its practical effect. The regulation of the banning behavior not only will not produce economic damage, but also is conducive to reduce the damage of rights and interests in the competitive market, so it is urgent to regulate this behavior through the anti-monopoly law.The exsiting anti-monopoly law has the dilemma of insufficient explanation and limited application to the regulation of the banning behavior. It is feasible and necessary to introduce the ex ante supervision mode of the comparative law, namely the platform gatekeeper theory, which can effectively suppress the banning behavior of the platform. Therefore, the gatekeeper theory should be perfected from the aspects of gatekeeper's definition standard, gatekeeper's obligation and gatekeeper's platform's defense.This paper provides implications for improving the regulation of banning behaviors in China.

Abstract:Based on the case of cigarettes,this paper introduces the problem of illegal cigarettes trading on the internet,explores the theoretical dilemma of its regulation,and points out the key points for practice on policy,external coordination and internal organization.We find that focusing on the characteristics of the illegal internet trading,the government needs to conduct some adaptive changes,search for possible regulatory path in the limited space and keep the balance between the free development of internet and the effective regulation of internet trading.

Abstract:The Americans and the Singaporeans have quite different ways to control Internet Pornography.In the U.S.,citizens'freedom of expression is highly respected,and several legislative efforts for restricting Internet pornography were ruled out as unconstitutional.A loose and flexible self-disciplinary pattern of management within professional circles is adopted as the major trend.In Singapore,however,the maintenance of common moral standards are stressed,and strict and effective laws and policies were formulated for coercive Internet pornography censorship.This essay is to compare the purpose,principles,actors,standards and measures for Internet pornography censorship in the two countries,to find out the differences and similarities,and provide information for countries with similar cultural traditions.

Abstract:Internet content governance appeals to the systematic coordination of multiple social actors. In addition to government regulation and platform governance, people's initiatives and participation have become increasingly critical. Based on cognitive dissonance theory, our article investigates the psychological mechanism of people's behavioral intentions to report harmful content online. A cross-sectional survey involving 3,000 Chinese netizens was conducted. The empirical results showed that the perceived necessity of Internet content governance was positively related to behavioral intention to report harmful content online through the mediation of aversion to harmful Internet content and that information-seeking motive negatively moderated the relationship between perceived necessity and aversion. This moderated mediation model provides theoretical and practical implications for understanding and playing the role of netizens in Internet content governance.

Abstract:In the context of new media, the management of internet public opinion in colleges and universities becomes a special issue. This paper, based on the era of new media, analyzes common problems in managing internet public opinion in colleges and universities. The problems include the need to strengthen the ethics and morality of internet use for college and university students, the lack of humanization in educational guidance, and the absence of a robust mechanism for managing public opinion. Additionally, it summarizes the causes of these problems and proposes measures such as introducing ethics and responsibility courses for online media use, improving service awareness and management level, and improving the control and management mechanism for internet public opinion, aiming to provide insights and assistance for managing online public opinion in colleges and universities.

Abstract:With the rapid expansion of internet platforms in recent years and the escalating fierce competition among major players, the prevalence of mutual blocking behaviors between platforms has increased. Some super internet platforms' actions of blocking API interfaces and links of other platforms violate the core principle of "interconnectivity" on the internet. Such behavior damages market competition, impacts the user experience of a vast number of users, and raises concerns about monopolistic practices. However, traditional approaches to determining market dominance and related market elements have shown inadequacies. To address these issues, this paper proposes the introduction of the "essential facilities" and "gatekeeper" principles, combining specific case analyses of platform blocking behaviors. This approach aims to ensure that internet platforms adhere to fair competition principles, maintain market competition order, and safeguard user rights.

Abstract:Child pornography poses significant risks to children's well-being and safety, with the proliferation of digital platforms exacerbating its accessibility and prevalence. This paper conducts a comparative analysis of child pornography laws in the United States and China, highlighting key differences in definitions, enforcement measures, and protection of children's rights. While the US legal system has made strides in addressing child pornography through stringent penalties and protective measures, China's legal framework exhibits deficiencies, relying on outdated regulations and lacking specific provisions for combating this crime effectively. Recommendations for revising Chinese criminal law include clarifying the concept of child pornography, strengthening legal protections for children's rights, expanding regulations to cover possession and virtual child pornography, and enhancing victim protection measures in criminal proceedings. Aligning with international standards and enhancing enforcement mechanisms can improve China's ability to combat child pornography, safeguard children's rights, and create a safer online environment. Adapting legal frameworks to address evolving digital threats is crucial in ensuring the protection and well-being of vulnerable individuals, particularly children, in today's digital age.

Today, cyber violence is happening more and more. Therefore, this article will study the causes of cyber violence and the countermeasures for cyber violence. This study provides an insightful and comprehensive study of cyber violence and broadens the research on cyber violence. Finally, it is found that the causes of cyber violence are: First of all, The virtuality and anonymity of the Internet. Secondly, some information media and netizens disseminate information irrationally. Thirdly, the relevant laws and regulations are not perfect. Fourthly, the supervision of Internet platforms is not in place. Fifthly, Internet users are getting younger. The countermeasures for cyber violence are: Firstly, improve the regulatory policies and laws for cyber violence. Secondly, the Internet platform should improve the regulatory strategy. Thirdly, improve the network public opinion supervision and platform reporting system. Fourthly, strengthen the early warning of public opinion and the guiding role of mainstream media. Fifthly, improve the rule of law and moral cultivation of Internet users.
