Abstract:With respect of the systematic position of the victim's consent,there is always existing dispute between the "monistic theory" and "dualistic theory".As for the revolutionists who advocate adopting of continent crime system thoroughly,it is necessary to consider the deep impact for criminal theory deriving from the monistic theory.As for the reformists who allege maintaining basic structure of the "four elements" theory,the monistic theory can also offer resources to settle systematic problems.Furthermore,the dispute of systematic position of the victim's consent will contribute to reconsider some fundamental questions such as the concept of legal-interests and etc.
