Compulsory treatment of mentally ill offenders in Hunan 2005-2009

Abstract:Objective:To describe the prevalence and related factors of compulsory treatment among offenders who were diagnosed as mental disorders and appraised as criminal incapacity or diminished criminal responsibility in Hunan Province.Methods:Using a self-developed questionnaire,information about compulsory treatment of all1,808 mentally ill offenders were collected in Hunan Province from 2005 to 2009.Results:Among the 1,808 patients,284(15.7%)received compulsory psychiatric inpatient treatment,while 1,524(84.3%)did not.Multivariate logistic regression showed that those who were male(OR = 2.35,95% CI = 1.51-3.67),diagnosed as psychotic disorders(OR = 3.44,95% CI = 1.55-7.62)or organic mental disorders(OR = 3.55,95%,CI = 1.31-9.64),had committed crimes of homicide(OR = 6.56,95%,CI = 4.05-10.62)or malicious injury(OR = 2.60,95% CI= 1.55-4.35),and were appraised as criminal incapacity(OR = 11.81,95% CI = 5.43-25.67)were more likely to receive compulsory treatment.Conclusion:It suggests that only a small proportion of mentally ill offenders have received compulsory treatment in Hunan province.The judicial system should regulate the procedure of compulsory treatment according to the specifications of the law.
