Abstract:The nature of the constitutionalism is to restrict the government power to ensure the individual fundamental rights.The fundamental rights are carried out and protected by the constitution and laws.Among the ways to restrict and deprive the individual fundamental rights,the criminal punishment is the most serious and violent one.So on one hand,it is needed to build up the safeguard mechanism such as the presumption of the innocence,making it the basis of the advocacy system;on the other hand,it's necessary to prescribe the way in which the right to defense will be carried out in the criminal procedure law,insure the implement of the right.In the modern constitutional states,the advocacy system in the constitutional law and the criminal procedure law share the salutary interaction.The perfection of the advocacy system in our country needs not only the support from the criminal procedure law but also the improvement of the constitutionalism.
