Abstract:Objective To explore the ways and methods of medical social work in settling medical dispute.Methods Through literature review and discuss,etc.This paper sums up the existing medical dispute mediation mechanisms,and then explores the approaches and ways of medical social work in mediating medical dispute.Conclusions Among several methods for settling medical dispute,the people's mediation mechanism works best,so medical social workers should draw lessons from it.Besides,by offering patient sociopsychological service,strengthening doctor-patient communica-tion,and intervening in medical dispute timely,medical social workers can mediate medical conflict in professional ways.

Abstract:Objective To investigate the cognition and attitude on medical dispute and its management among medical staff and patients,and to provide references for efficient prevention and management of medical dispute.Methods Totally 810 medical staff and 835 outpatients were recruited from 7 first-class tertiary hospitals in Beijing and surveyed with a self-designed questionnaire between January and February 2015.Results Among both medical staff and the outpatients,more than 70％ of the participants accepted that main reasons for medical dispute include the gap between therapeutic efficacy and the patients' expectation,difference in the understanding on therapeutic efficacy between medical staff and patients,and insufficient communication between medical staff and patients.Perfecting relevant laws/regulations and balancing medical service resources allocation were the two major preventive measures for medical dispute suggested by 97.8％ and 97.3％ of the medical staff;while promoting medical personnel to provide good medical service and improving skills of communication with patients were the two suggested by 92.7％ and 92.s％ of the outpatients surveyed.The medical staff considered third-party mediation and legal arbitration but the outpatients considered administrative intermediation and bilateral negotiation as the prime choices among the four routes for the management of medical dispute.Condusion The gap in medical information access between medical staff and patients and imbalanced allocation of medical resources are important causes of medical disputes.Efforts should be made in exploring patterns for efficient third-party mediation,standardized mechanism for multiparty involved management,and efficient complementation of different management routes for the treatment of medical dispute.

Abstract:Medical dispute is a form of doctor-patient conflict.In recent years,a growing number of conflicts arises from medical disputes all over the country.Both the doctors and patients want to maximize their respective benefits.Currently,there are mainly 3 kinds of solutions to medical disputes:civil litigation,consultation between the medical organization and the patients and administrative arbitration.According to the result of investigation of both doctors' and patients' inclination,the advantages and limitations existing in these 3 kinds of solutions are analyzed,and that hospitals provide social as well as psychological services and strengthen doctor-patient communications on the basis of bringing in medical social work is proposed.In this way,a new medical mechanism for mediating medical dispute can be established.

Abstract:Objective: This study aimed to explore the causes and factors behind medical disputes that occurred across eight hospitals in Shanghai over a three-year period (January 2018 to December 2020), thus providing targeted suggestions for amelioration. Methods: Stratified sampling was employed to collect 561 cases in which medical disputes occurred at two tertiary hospitals, two secondary hospitals, and four primary hospitals in Shanghai. The causes were analyzed using descriptive statistics, while the factors affecting the dispute level (i.e., 1 through 4, with 1 being most severe) were analyzed via one-way ANOVA and logistic regression analyses. RESULTS: Doctors and patients variously contributed to the medical disputes; 86.1% were related to doctors, while 13.9% were related to patients. For doctors, there are seventeen factors that influenced medical disputes. In particular, the insufficient communication (28.82%) is the most prominent factor in the doctors' factors. For patients, there are seven factors that influenced medical disputes. In particular, the misunderstanding of medical behavior (43.48%) is the most prominent factor in the patients' factors. Of all investigated medical disputes, 406 were level 4 (78%), 95 were level 3 (18%), and 19 were level 2 (4%); there were no level 1 disputes. The reasons for different level placements included the disease classification, treatment effect, diagnosis and treatment regulation violations by doctors, and low technical levels. Conclusions: In addition to strengthening training about clinical and communication skills, the hospitals should establish quality control mechanisms for case records and construct rapid, standardized referral mechanisms. The doctors should attach great importance to the quality and urgency of treatment given to critically ill patients, who must be informed about their prognoses in a timely manner to avoid medical disputes and physical deterioration. The patients should actively cooperate with their doctors in the treatment process, moderate any unrealistic expectations that patients may have about the outcomes. During the COVID-19 pandemic particularly, doctors and patients should strengthen empathy and mutual trust more, then defeat disease together.

Abstract:At present, the increasing trend of medical disputes has become a serious problem in the work of medical institutions, and directly affects the social stability and orderly development of the institutions. We searched the literature on medical disputes and crisis management in China and Australia within PubMed (2010-2019), China Knowledge Network (CNKI, 2010-2019), and Wanfang Data Knowledge Service Platform (2010-2019). There are several drawbacks in the management of hospital medical disputes in China: 1) the knowledge of crisis is unilateral and not systematic; 2) there are too much stereotype thoughts in crisis management; 3) the crisis attribution is too simple; the crisis impact assessment is insufficient. It is worth learning from Australia’s system, including the legal system, relevant non-governmental organizations, and doctor-patient communication. In view of the malpractice existing in China's medical dispute management, Australia's legal system for handling disputes, doctor-patient communication and other aspects are worthy of our reference. In particular, the construction of third-party supervision and mediation institutions and the prevention of doctor-patient disputes should be optimized.

Abstract:Object Taking a all resolved medical dispute case of a comprehensive hospital in 2009-2011as the research object,this paper discusses medical dispute solution mechanism and transformation of the medical disputes identification;Results From 2009to 2011,there were 106cases of medical disputes settlement.Hospital mediation had 26cases,accounting for 24.5%.The third party mediation had 21cases,accounting for 19.8%.The judgment and mediation by the court had 59cases,accounting for 55.7%.Conclusion The hospital should give full play to the third party to resolve medical disputes ability,and pay attention to the identification of medical disputes.

Abstract:In recent years, medical disputes occured frequently and there were not sufficient original meth -ods to settle the disputes.With the promulgation of the laws and regulations of the people ’s mediation, the applica-tion of the method to deal with medical disputes was being carried out extensively throughout the country .In our hospital, we carried out the people’s mediation since 2011.The data showed that the number of dispute settlement through judicial mediation way was descending after the implementation of the people ’s mediation, effectively reduc-ing the intensity of patient -doctor conflicts.The people’s mediation method has become the most important way to solve the disputes in our hospital last year .The four years of practice proved that it was professional , independent, efficient, harmonious, fair and convenient to settle medical disputes by people ’s mediation.

Abstract:Background: Medical disputes, which are prevalent in China, are a growing global public health problem. The Chinese government has proposed third-party mediation (TPM) to resolve this issue. However, the characteristics, efficiency, and influencing factors of TPM in resolving medical disputes in public hospitals in China have yet to be determined. Methods: We conducted a systematic study using TPM records from medical disputes in Gansu Province in China from 2014 to 2019. A χ2 test was used to compare differences between groups, and binary logistic analysis was performed to determine the factors influencing the choice of TPM for resolving medical disputes. Results: We analyzed 5,948 TPM records of medical disputes in Gansu Province in China. The number of medical disputes and the amount of compensation awarded in public hospitals in the Gansu Province increased annually from 2014 to 2019, with most of the disputes occurring in secondary and tertiary hospitals. Approximately 89.01% of the medical disputes were handled by TPM; the average compensation amount with TPM was Chinese Yuan (CNY) 48,688.73, significantly less than that awarded via court judgment and judicial mediation. TPM was more likely to succeed in settling medical disputes in the < CNY10,000 compensation group than in the no-compensation group (odds ratio [OR] = 3.14, 95% confidence interval [CI] 1.53-6.45). However, as the compensation amount increased, the likelihood of choosing TPM decreased significantly. Moreover, TPM was less likely to be chosen when medical disputes did not involve death (OR = 0.49, 95% CI 0.36-0.45) or when no-fault liability was determined (vs. medical accidents; OR = 0.37, 95% CI 0.20-0.67). Conclusion: Our findings demonstrate that TPM mechanisms play a positive role in efficiently reducing compensation amounts and increasing medical dispute resolution rates which was the main settlement method in resolving medical disputes in public hospitals of Gansu Province in China. TPM could help greatly reduce conflicts between doctors and patients, avoid litigation, and save time and costs for both parties. Moreover, compensation amounts, non-fatal outcomes, and no-fault liability determinations influence the choice of TPM for settling medical disputes.

Abstract:Objective To investigate the conditions of consultation settlement for medical disputes in medical institutions of Shanghai,and provide referrences for improvement of medical dispute settlement. Methods Thirty medical institutions of Shanghai were surveyed with self-designed questionnaires,which included the aspects of department setting,staff allocation,number of medical disputes with consultation settlement in 2007 and 2008 and recognition on consultation settlement for medical disputes in medical institutions. Results There were specific departments for management of medical disputes in each institution,with a total of 63 staff in all institutions and full-time staff in 15 institutions(50%).Those with consultation settlement accounted for 88.5% and 90.1% respectively of all the medical disputes in 2007 and 2008.When medical disputes arose,24 institutions(80.0%) were willing to resolve by consultation,25(83.3%) adopted consultation settlement for social stability,21(70.0%) determined the compensation amount by compromise with patients,29(96.7%) concluded contracts with patients by written form,and 21(70.0%) drafted contracts by themselves. ConclusionHarmonious relationship between medical institutions and patients is important,and medical institutions should improve the mechanism in consultation settlement for medical disputes.

Abstract:Objectives:Survey the current situation of doctor-patient dispute consultation settlement in medical institutions of Shanghai,understand the acknowledge and willingness of choosing consultation settlement from both sides and the pros and cons of the settlement and so on.Discover existing deficiency and provide suggestions and measures for further improvement of this mechanism.Offer decision basis for the policy making of health administration department.Methods:Survey 37 medical institutions and 124 patients within four districts of Shanghai with self-designed questionnaire.Results:All 37 institutions have established doctor-patient dispute consultation settlement departments.In 2007 and 2008,the percentage of doctor-patient disputes settled by consultation is 89.5% and 90.1% respectively.Most doctors and patients are inclined to solve disputes by consultation.30 medical institutions indicate that they adopt the consultation settlement due to social stability concern.23 institutions feel that patients raise unreasonable demand in dispute settlement process.62.1% of patients chose to settle dispute with hospitals by consultation,among which 41.1% made the decision for the reason of time-saving and convenience.Patients indicate the main drawbacks of dispute consultation settlement are information asymmetry and the possibility of being blindfolded.Conclusions:The main handing method for doctor-patient disputes is consultation settlement at the present time.Effort should be paid to the construction of doctor-patient dispute consultation settlement system and the improvement of the settlement mechanism.

Abstract:Vibrational spectra of NO ligands adsorbed on cationic gold clusters are obtained using IR multiphoton dissociation spectroscopy. We observe a strong oscillation of the NO stretching frequency with increasing cluster size that reveals a clear odd-even dependence in the strength of the NO bond. For the corresponding CO complexes, no oscillation is found. This behaviour can be understood on the basis of the character and occupation of the frontier orbitals of the complexes.

Abstract:Objective:To investigate the nurses and the doctors' attitude towards doctor-patient dispute. Methods: Totally 353 nurses and 306 doctors from 7 hospitals in Beijing were selected conveniently and surveyed with a self-made questionnaire. Results:The nurses' and the doctors' identiifcation rates on the causes of doctor-patient dispute had signiifcant differences (P<0.05) on 4 items, named unreasonable medical visit process, the medical staffs' service attitudes, medical staffs' sense of responsibility, and the medical staffs' medical skill. But they all agreed that the gap between therapeutic efifcacy and the patients' expectation, overloaded medical staffs, different understandings on therapeutic efifcacy between the medical staffs and the patients, patients' dissatisfaction with the society or the other issues, the communication problem between the medical staffs and the patients were important causes for doctor-patient dispute. In terms of the concerns after doctor-patient dispute, the nurses' and the doctors' identiifcation rates had no signiifcant differences (P>0.05) except item"negative effects on professional title evaluation". The identification rates which were more than 90.0%included disturbance of daily life and work from patients' entanglement, impairing working enthusiasm, negative effects to hospital and departments' performance. In terms of precautions to doctor-patient dispute, the nurses' and the doctors' identiifcation rates had no signiifcant differences (P>0.05) except 2 items, optimization medical visit process and shortening the waiting time, and positive news media orientation to the public. Furthermore, the nurses' and the doctors' identiifcation rates on 7 items were all above 90.0%, such as improvement of the relevant laws and regulations, balance of the medical service resources, optimizing treatment process and shortening the waiting time, positive news media orientation to the public, improving the medical skill, communication skill and service attitudes of medical staff. Conclusion:Comprehensive measures, including guiding the public understand the medical process correctly, and improving relevant legislation further, could be helpful to reduce the occurrence of doctor-patient dispute and resolve them properly.
