Defining the Rights of Traditional Knowledge from Legal Perspective

Abstract:Based on comprehensive study on the status quo of defining traditional knowledge rights,legal relations of traditional knowledge rights,the nature of the essence of traditional knowledge rights and their relationship with other rights,it is proposed that as an actual right in the domain of social rights,the traditional knowledge right should refer to the generic terms of the spiritual rights and prosperity rights of the traditional knowledge enjoyed by the traditional social communities who create,develop,preserve and inherit traditional knowledge in their life and production practices.
