Abstract:To cope with its rapid development and transformation from a planned economy toward a market-orientated economy, China has over the years strived to formulate a comprehensive and multifaceted competition law.1 Such a law is regarded as a way of regulating a chaotic economy that has experienced years of unruly competition. During the years of opening up of its economy, China has gradually realised that contemplated competition law will protect the process of competition, which will in the long term lead to lower prices, better products, and more choices for consumers, and enhance the overall efficiency of social welfare.2 So far the existing Chinese legal framework falls far short of ensuring an effective system of competition,3 and a comprehensive competition code has yet to be adopted. The call for a comprehensive competition law was reinforced by China’s accession to the World Trade Organisation in November 2001.4 Significant progress has been made in both the drafting of a new competition code and the reconstruction of existing laws and regulations on competition. In 2003, China’s National Development and Reform Commission (SDRC) announced ground-breaking provisional rules banning price-fixing alliances, monopoly profits, and predatory pricing. Abstract:It is an irresistible trend for industrial and commercial capital to flow to the countryside.Commercial capital into agriculture is a "double-edged sword",which has made the community react strongly.At present the policy has only stipulated several principles,thus lacking rigidity and enforcement.We hold a strong belief that rental of commercial enterprises and usage of farmers' "Family Contracted Land" should be adjusted and regulated through the sound land leasing legal system and the usage of strong legal weapons,and only in this way can we make the prospect of "there're laws to abide by,there're laws to comply with,law breakers must be dealt with" come true.This paper is based on the following points:analysis of the current policy and related comprehensive system,analysis and operation mechanism of legal norms of rental,the existing problems of law.Finally,six aspects of the legal countermeasures and suggestions have been put forward as follows to regulate the rental and usage of family contracted land on the part of the commercial enterprises:clearly define the qualifications of the agriculture-related entities and the conditions for the entry threshold,set up examination and approval system,improve the legal restraint mechanism of "Non-food" and "Non agriculture",lift the mechanism of the leasing contract and reinforce special legislation.

Abstract:With the enlargement of the European Union (EU) and the economic expansion of China, bilateral trade between the EU Member States and China has experienced noticeable growth. With the increasing number of EU small and medium enterprises entering the Chinese market, their inexperience in trademark protection may hamper their business development in China. Despite China's effort to strengthen its legal framework and enforcement power for trademark protection, its record remains less than fully satisfactory in the opinion of much of the international community. In this article, we present some common forms of trademark infringement in China and discuss some of the complexities of legal and institutional conditions and linguistic factors. We also provide recommendations to tackle these issues.
How Are Unregistered Trademarks Protected in China?

Abstract:As in most civil law countries, registration is the only way to acquire trademark rights in China, and the protection of unregistered marks remains a marginal issue. However, companies always have considerable interests in the protection of their unregistered commercial signs. Problems with trademark piracy and passing off regarding unregistered trademarks in China have drawn attention throughout the world. Besides the absence of spontaneous market order, defects in the current trademark and competition law systems are the main reasons for this problem. The bona fide principle, as incorporated in the PRC Trademark Law, is applicable only to piracy of those trademarks that have been used in China and are known to the relevant public. The action of passing off in the PRC Anti-Unfair Competition Law does not cover unregistered trademarks as it stands, and they can only benefit from this protection by being disguised as a product name, packing or decoration. The protection of well-known trademarks is nearly unavailable because the fame requirement is too high. The last revision of the PRC Trademark Law improved the current regime by enlarging the scope of application of the bona fide principle in trademark law. However, we still need to give a clear status to unregistered trademarks in anti-unfair competition law, and Chinese courts should lower the fame requirement in the recognition of well-known trademarks.

Abstract:The legislation of commercial registration lays down general laws regulating commercial registration. It could be classified as commercial registration law in it formal sense and that in its substantial sense. While the former is the law of commercial registration in the narrow sense,the latter refers to the law in the broad sense. If we take the view from the latter, numerous concrete laws and regulations concerning the commercial registration have already been set up in China. However, a number of problems existing in this area will become the future obstacles in the strengthening of international competitive force of Chinese commercial subject and in the promoting of the further development of Chinese market economy.

Abstract:Traditionally, trademarks convey source information to consumers through the use of words, letters, or numerals. The types of signs that are nowadays considered as being capable of constituting a trademark have expanded beyond words or figurative devices. Although non-traditional trademarks have received wide acceptance in many jurisdictions, the hurdle for obtaining registration appears to be higher than for traditional marks. Two issues have figured predominantly in the debate over protection for non-traditional marks: distinctiveness and functionality. Applications for non-traditional trademarks in China have given rise to a number of judicial decisions. The jurisprudence in China has taken a cautious approach in making decisions on a case-by-case basis, depending on the kind of mark in question. After a brief introduction to non-traditional marks, section 2 interprets the trademark definition in the China Trademark Law and reviews the extent to which non-traditional marks might be protected under the existing laws. Sections 3, 4, and 5 present a comprehensive and systematic analysis of the functionality and distinctiveness issues for three-dimensional marks, colour marks, and sound marks. Finally, the Conclusion highlights the main problems in the protection of non-traditional trademarks and proffers solutions for analysing distinctiveness and functionality issues for non-traditional marks.

Abstract:In the fierce market competition,more and more enterprises gradually realize that brand name is great intangible assets.Since China enter into the World Trade Organization,Chinese products will step into the world market and compete with their counterparts.It is not only the competition of goods and service,but that of the image of Chinese enterprises and well-known brands.It is a new subject for Chinese enterprises that how to set up a well-known brand name with international-leveled design and world-wide recognition.The cultural diffenences different culture between China and the West bring about a lot of trouble in naming and interpreting brand name.This paper begins with the characteristics of brand language,further discusses the methods applied in the process of translating the brand name and meanwhile putting forward the principles that trademark translation should follow.

Abstract:With the constant advancement of the economy and technology, especially the development of high-tech technology, the traditional trademark can no longer meet the needs of social and enterprise development. From traditional visual trademarks to three-dimensional trademarks, sound marks, and even scent marks, non-traditional trademarks are playing an increasingly important role in transactions. Therefore, the legal protection of non-traditional trademarks is particularly important. By collecting and reading the relevant references and materials, this paper adopts the methods of literature analysis, comparison method, and case analysis to analyze of Legal protection of non-traditional trademarks from a global perspectivetaking scent trademarks as an example. The paper points out the current situation in the protection of non-traditional trademarks, taking scent marks as an example, and puts forward some feasible suggestions, such as: Reference the "staff " representation method, Promoting scientific and technological progress, and Scent branding prompts in the product. It can be concluded that the registration and protection systems of scent trademarks in various countries are not perfect, they can be shown in the strict requirements for registrable trademarks regarding the representation of odor, the distinctiveness of trademark registration, and the functional of marks. Countries should pay more attention to them. The study suggests that it is necessary to improve the scent trademark legislation, which is conducive to better protection of intellectual property rights, encourage innovation of enterprises, and safeguard the interests of enterprises.

Actual Problems of Russian Law

Abstract:The paper attempts to investigate the issue of the protection of non-traditional trademarks in the People’s Republic of China that is ranked first in the number of registered trademarks in the world. The author analyzes the national legislation on the registration of trademarks that permits the registration of such types of non-traditional trademarks as sound, color combination and a three-dimensional designation, as well as judicial practice on appealing decisions of the National Trademark Office of China to refuse registration of three-dimensional, color and sound trademarks. The author determines the criteria for the protection of non-traditional trademarks, analyzes their application to each type of such marks. The paper highlights the main problems of registration of non-traditional trademarks in China. A conclusion is drawn about the need to improve legal, including international, regulation to stabilize and simplify the protection of non-traditional trademarks in the world.

Abstract:In China's judicative practices of the Anti-unfair Competition Law, the theory of a general clause has been commonly accepted by courts in confirming many types of unfair competition, which have a common characteristic, i.e. unfair imitation or utilization of the business achievements of others. The protection of these business achievements is based on reasonable arguments: The business achievements must satisfy three conditions —— being not protected by laws of intellectual properties, having some distinctness and being, to a certain degree, well-known on the market. Imitation or utilization of the business achievements must have special unfair circumstances.

Abstract:As China steps up to take the lead in the global economy, the protection of intellectual property (IP) in its stirring economy is worthy of examination. In 2017, a significant milestone was achieved with regards to the protection of trade secrets, as the General Part of the Civil Code1 promulgated on 15 March 2017 expressly included trade secrets as IP subject matter in China.2 During that year alone, Chinese courts were reported to have dealt with a total of 213 480 IP rights cases, an increase of 40.4 per cent from the year before.3 Among the different types of IP rights, trade secrets are by nature unique. Whilst the three traditional forms of IP are ‘open secrets’ published or used while being accorded positive legal protection for a finite period, trade secrets can be potentially protected forever, as long as they are kept in confidence and away from public knowledge. One can glean a sense of their importance by considering the great lengths that Coca-Cola has gone to protect what it calls ‘the most guarded trade secret in the world’—its secret recipe—which apparently remains stored in a safe box locked away in a vault in Atlanta, Georgia, and is only in the knowledge of two senior executives at any one point in time.4 This article thus traces how China came to protect this priceless class of assets, and focuses on the examination of the present framework for their protection under the Chinese laws, both in legislation and in practice, with specific attention being paid to the amendments made in the 2017 revision of the 1993 Anti-Unfair Competition Law (ACL).

Through comparative analysis of international and domestic legal frameworks, alongside a review of infringement cases, this research delineates the primary infringement modalities—trademark squatting and counterfeiting. It emphasizes the need for a multi-faceted approach involving legal reforms, enhanced judicial protection, and proactive risk prevention measures. The findings underscore the critical importance of adapting China's intellectual property laws to the dynamic global e-commerce landscape and fostering a robust trademark protection ecosystem to safeguard and stimulate the country's economic globalization ambitions.

Abstract:With the world's standard of living improving continuously,the global mobile phone markets are in grater demand.China's domestic phones constantly meet the demand on the domestic market on the basis of being constantly open up overseas markets.However,the export market is too concentrated,cell phone products to be "foreign" high degree,the lack of independent intellectual property rights.royalties shadows linger,the export price has declined substantially trends in the problem exists,China's exports of Chinese-made mobile phone market share is still relatively small,and international competition is still relatively weak.In this paper on China's domestic mobile phone export status largely on the basis of understanding,through SWOT analysis on China's domestic mobile phone exports competitive advantages and disadvantages facing opportunities and threats carried out a detailed analysis,the impact of China's domestic mobile phone exports SWOT factors.In this paper,the Nokia cell phone with the wave guide used in the empirical analysis,a discussion of foreign brands and Chinese-made mobile phone competition difference was made.Finally,in response to China's domestic mobile phone export process the issue,the author gave some advice such as increased autonomy innovation,strengthen the brand-building and so on.

Abstract:This study focuses on analyzing the reform of commercial registration system in Shanghai Pilot Free Trade Zone (FTZ) and Hainan Free Trade Port (FTP) of China, by adopting the evaluation indicator of Starting a business of the World Bank's Doing Business. By implementing the new policies of Negative List and relative supporting policies like the separation of two licenses and e-registration, the reforms as to the mode and guiding philosophy of regulations on commercial registration in the FTZ/FTP achieved a positive spillover effect. However, there remain several problems, such as the fragmentation of the normative documents related, the overlarge scope of substantive examination of commercial registration, the Chinese government needs to further perfect the commercial registration system by means of delimiting the scope of application of market access upon commitment, further optimizing the Doing Business, enhancing the regulations of financial information of enterprises, harmonizing the legal system of regulatory authorities and strengthening the legislation on applicant's accountability and disciplinary mechanisms.
