Adult Guardian System and Rights Protection of the Disabled——Observations under Civil Law

Abstract:Adult guardian system is of great importance to protect the disabled people's rights.However,there is no completely and systemic one in China.In fact,the group of the disabled who needs protection is fairly large.Among them there is few who gets appropriate guardian.What's worse,many of the legal guardians could not fulfill their duties without hurdles.These situations have raised higher requests for China's adult guardian system.Drawing the lessons from Germany,Japan and Anglo-American law system,this paper suggested that wards' fundamental rights should be fully protected as legislation ideal;scope of application should be extended for guardians;a clear definition should be set for guardians' responsibilities and an effective monitoring and supervision system should be established.
