Abstract:The first Property Law in China was enacted in March 2007. In this law the protection on private property was emphasized and the public interests were put into premises when government performs its eminent domain. As a tool of realizing public interests and performing public intervention, urban planning would be involved in related issues and arguments about what are public interests. From the practice of modern urban planning in western countries, public interests are discussed not only in case of performing eminent domain but in case of regulating freedom of land use. This paper intends to identify the changes of urban planning in China under the circumstance of Property Law of 2007 and to look forward the situation in future that urban planning must respond to, through reviewing the birth and evolution of modern urban planning and comparing the understandings of public interests between China and U.S.

Abstract:The new law on the property rights will be a significant factor in the reform towards market economy,and it is a landmark in the protection of private properties in Chinese history.Form the perspective of land rights,that law will have a profound impact on land use planning.First of all,land use planning de- fines land rights.Definition of land rights makes land use planning political in na- ture.Uncertain zoning will make land rights ambiguous,and ambiguous land rights are responsible for wastage of land resources and deterioration of urban environ- ment.Good cities are based on private land rights free from infringement.However, too strong private land-related interests will hurt the interest of urban community as a whole.There are many lessons we should learn from developing cities in this re- gard.

Abstract:the public policy attribute of urban planning reveals that urban planning is the re? ection of government's coercive power.In the making and implementation process of urban planning,the property right especially real property right of citizen is prone to be hindered or even deprived.Therefore,the conflicts between public rights and personal rights are inevitable.Referring to the experiences of development countries in dealing with the relationship of government's planning power and citizen's real property right,this paper argues that the exertion of government's planning power should be based on the Constitution,related laws,and reasonable principle in order to balance the government's power and personal right.

Abstract:For a long time, China's urban planning research has emphasized on the morphology and design proposals, relatively few on economic studies. A large number of urban planning in theory or practice of attempting to adopt the best drawings on the spacial plan to solve complex practical problems, the results of either plan can not be implemented, or after the implementation of the results is not good. Therefore, in a market economy environment, reconstruction of urban planning based on the theory of economics is very necessary and urgent. This paper introduces a new institutional economics and property rights in order to approach the theoretical basis for a new perspective into urban planning field. However, in terms of the new institutional economics point of views, this paper argues that a critical attitude should be taken as to the application of research methods, rather than a whole.

Abstract:Urban general planning has the typical public management characteristic,and its major function differs in different development phases in history.Currently,against a background of social & economic transformation,the restriction of urban general planning has been an issue of benefit conflict between regions and departments.Generally,the issue includes three aspects:first,the vertical competition engendered by localism and opportunism under power gambling;second,the adverse reaction to excessive horizontal competition;third,the spatial benefits contention between multi-interests bodies in the interior competition.As to the problem of benefit conflict,recently urban general planning should take rural & urban planning as a whole and regional harmonizing as the fundamentality.Our major suggestions are as follows:Firstly,taking the public benefit as the core concept and reforming the planning value system;secondly,reforming the planning system and harmonizing the vertical benefits;thirdly,integrating regional strategic resources and harmonizing the horizontal benefits;fourthly,building up the whole space zoning and establishing regulation mechanism;and finally,optimizing the public goods supply and promoting the equalization of urban and rural public services.

Abstract:After the reform and opening up, Chinn’s urbanization has been greatly improved. In this process, with the legal status of the land use rights established in urban development, its nature as a usufruct has been widely recognized and accepted by the land market; on the other hand, although its characteristics as a development right have been widely recognized in the practice of urban and rural planning, but limited by the ideology of the land’s public ownership in China, the discussion on the development rights and the mechanism of forcing planning power on the development rights is not sufficient. In the field of urban development, many contradictions and problems between the different levels of the government, between the different departments of the government, and between the government and society, such as the gaming on the acquisition of construction land quota, “multi-plan coexistence” and “land finance”, are all rooted in unclear understanding of the nature of land development rights and planning power, lack of theoretical research on it, and ambiguous application of different types of laws. In light of these inadequacies, this article attempts to examine urban land development rights and planning power from the perspective of public law and private law, analyze the differences and relevance between the two, and put forward suggestions for determining the functions and responsibilities of the government and formulating a framework of planning logic for urban land development.

Abstract:Urban planning is an important public policy relating to a city's development and construction.At different historical stages and under various social economic backgrounds,the control performances of urban planning indicate different characteristics and mechanisms.This paper establishes a framework for analyzing the spatial planning performance by integrating remote sensing decipherment,landscape matrix,planning control index,and planning decision logic.Via this framework,the paper analyzes the spatial-temporal evolution characteristics of Beijing's urban spatial form during 1978-2006,the control performances of planning during 1958-2004,and the evolution process of planning logics.The paper also discusses the internal mechanisms forming the differences in planning performance at different historical stages based on the analysis of urban designated function,urban spatial structure,urban size decisionmaking,developing model,and the change of multi-stakeholders.The purpose of this paper is to provide reference for improving decision-making mechanism in future urban planning.

Abstract:From historical perspectives,the governmental city planning values are systematically analyzed in this thesis which indicates that such values are mixed with those policy's,political,organizational as well as ideological values,and seem to have a distinctive feature of pan-publicized interests.Such a phenomenon not only intensifies the conflicts between public and private interests,but brings about undesirable impact on urban planning itself.The rights of urban planning derive from the governmental administrative authority and the planning decision mode of the centralization is the main reason for the pan-publicized interests.The problem of city planning values should be the priority to be taken during the process of transformation of urban planning system.

Abstract:The institutional reform of land property rights is confronted with various challenges from all aspects of the economic and social lives in the current stage.The original property reform theory does not agree with the current practical requirement of land use and management.How to fully reflect the political,social,organizational and juristic nature of land property right in the newly-formed concepts of land property reform and its institutional innovation,and further provide a trajectory for future reforms in China,are the main purposes of our theoretical research.It needs to combine together the theories of economics and sociology to analyze related issues.The four-level-social-analysis framework proposed by Williamson provides a good logic to link property right with resource allocation,sociology with economics.Through such a logic,a comprehensive analysis on the nature and the assessment of Chinese land property can be achieved,which can further provide a theoretical basis for the trajectory choice of the current land property reform.The analysis offers scientific references for the new-round of land property reform in China.

Abstract:With the rapid urbanization and evident transfer of urban development and planning system from a planned one to a market-oriented one,the Chinese urban planning has encountered an unprecedentedly complex situation.Analysis and research on urban systems with complexity theory have consequently become imperative.Through the analysis of design-oriented and strategy-oriented planning approaches,this study finds that the latter is more effective in a fast-changing urban environment.The major reason is that the strategy-oriented approach is more flexible and is capable of solving the numerous problems in a complex urban system.Therefore,it can multiply social welfare progressively and achieve higher cumulative system utility or better cumulative social welfare.This study finally argues that the design-oriented approach should be replaced by the strategy-oriented one in four ways:(1) the traditional time-driven and design-oriented plans should be replaced by event-driven and strategy-oriented plans;(2) the time range of plans should not be too short or too long,and should take full account of the validity and type of plans;(3) a giant city master plan should be replaced by several small-scale strategic plans;and(4) in addition to physical design,urban planning should include institutional design,such as the formal design of statutes and informal design of criteria.
