Abstract:The modern university system and modern higher education governance necessitate new development patterns, comprehensive institutional reforms, capacity and intension building and governance effectiveness. The intension of higher education governance includes the establishment of a common-governance structure and of a culture of community by promoting harmony. Such a pattern is expressed by (1) the shift from governance control to governmental supervision;(2) the shift form external command to selective self-discipline;(3) the shift from academic autonomy to governance autonomy, and (4) the shift from“hard administration”to“soft governance”. The government is required to improve the governance capacity, to provide physical conditions and services and to hand over university to educators;the shift from executive documents dependence to the rule of law should be realized;management philosophy and patterns should be improved, including the introduction of the contractual objective management pattern;the rule of law and the university’s autonomy should be balanced within university;and the governance by the community of professors and other shareholders should be promoted. In terms of the authorization for the university’s constitutionconstruction, the differentiation principle should be adopted in order to realize“customized governance for each university”.

The “Legal-civil Relations” in the Rule-of-law Practice of Contemporary China

Abstract:The Western theory of rule of law has a number of limitations. The Chinese theory of rule of law must have a deep understanding of the ideal types and general principles of legal-civil relations. The legal-civil relationship is an inter-subjective one between legal people and ordinary people that has emerged from the distribution of legal explanatory power. There are two "ideal types" of legal-civil relations: the "passive legal-civil relations" characterized by the core of judges and lawyers and the guidance of the legal profession; and the "positive legal-civil relations" characterized by the core of judges and involving parties and the guidance of the legal profession and ordinary people. The two types of relations have caused different "microscopic judicial environments" pertaining to the legal explanatory power in specific cases and different "macroscopic situations with the rule of law" based on judicial mutual trust and rule-of-law beliefs in general. China should explore its own path of rule of law in accordance with the legal-civil relations based on its national circumstances.

Abstract:Many modern scholars attribute the problems in Chinese traditional politics to the rule of man,rather than the rule of law.Therefore,the establishment of a society of law is an important part of the Chinese modernization drive.This can be a very influential argument.However,throughout Chinese ideological history,there have been many suspicions about the rule of law,especially from the thinkers in late Ming and early Qing Dynasty.Huang Zongxi,Wang Fuzi and Gu Yanwu put forward different views on rule of law.According to them,rule of law,though necessary,is not the full requirement for state governance.And law itself can not be automatically enforced if man's leading role is not involved.Thus,the formulation of laws should be universally based on the interests and well-being of the people,and the law executors should be morally endowed and out of their goodness to exercise their power.In playing a supervisory role,they should focus on learning to educate the public.

Abstract:Since this year,the education of the idea of socialistic rule of law has been carried out through the na- tional political and legal front.In the seminar on the socialistic rule of law idea in April of 2006,Comrade Luo Gan pro- posed that the basic content of the education of socialistic rule of law idea is "governing the country by law,executing the law for the people,serving the overall interests,performing fairness and justice,sticking to the lead of CPC." This idea of socialistic rule of law emphasizes the "sinitic" and "socialistic" characteristics of rule of law.It has fully demonstrated China's awareness to explore the ruling theories of building a socialist rule of law,and has also made a very targeted clarification theoretically for the different arguments and deviated ideologies in practical life.To carry out the modern rule of law,in an organic way the construction of the judicial system and the realistic situation of China and Chinese people should be consciously combined,as well as the essence of the shared theories on human political and legal civilization and the unique idea of the political development of Chinese society.We have every reason to expect that the theoretical and practical amalgamation of rule of law and socialism will predicate the perfection of socialistic theory and the enrich- ment of the rule of law theory.Moreover,it will be a signpost of China's law and its development and practice; it may even be a turning point towards the renaissance of ancient civilization of China.

Abstract:This article argues that Shang Yang’s philosophy of law was not only a means to enrich the state and strengthen its army, but also envisioned the orderly rule of all All-under-Heaven. Through a fair, universal, and reliable use of rewards, punishments, and also teaching, this vision of laws could ultimately lead to the promotion of moral values, popular consensus, and people’s self-governance. While the authors admit that in Shang Yang’s own historical context, law was no more than a tool used by the ruler to suppress his people, potentially his ideas could contribute to a future Chinese society fully ruled by law and morality, and inspired by the rule of law.

Abstract:In China's context of perusing the Rule of Law and building a rule of law government, the idea of "administration in accordance with law"has been widely accepted by both scholars and law reformers. In its essence, the fundamental logic of that ideology assumes that administrative actions in line with law shall be legitimized, since law is presumed as result of democratic procedure. However, those presumptions are quite far from realities in today's China because of the increasing role of administrative made laws and the real story of administrative functions. To bridge the huge gap between the ideology and the reality, one possible approach is to improve the logic of traditional ideology through introducing additional legitimizing strategies such as models of "legitimization through rationalization" and "legitimization through public participation".

Abstract:China has entered a new era in our march toward the rule of law, and the principal contradiction facing Chinese society has changed into one between the people's ever-growing need for a better life and unbalanced and inadequate development. At the rule of law level, the contradiction manifests itself as a gap between the public's expectations of rule of law construction and its unbalanced and inadequate development in legislation, law enforcement, the judicial system, legal compliance, legal supervision, etc. The Report to the 19th National Congress of the Communist Party of China points out that law-based governance is an essential requirement and important guarantee for socialism with Chinese characteristics. It outlines an impressive blueprint for building the rule of law in the new era, and further expounds the basic strategy for building the rule of law in China in the future. It provides the guiding ideology and program of action for the comprehensive rule of law and establishes the goal of building the rule of law. Under the guidance of Xi Jinping thought on socialism with Chinese characteristics for a new era, rule of law construction in China will embark on a new journey.

Abstract:The contemporary connotation of the rule of law is embodied in the "governance of the people", which embodies the will and the interests of the majority. The contemporary requirements of the rule of law mainly include two aspects: the production of good law and the implementation of good law. In modern society, it is possible to produce good law is mainly because of the idea of the right to guide the concept of practice in the creation of a complete legal mechanism; the reason to be able to implement good law, mainly because of the institutional emphasis on power constraints and the overall law-abiding. China has its own specific national conditions, especially the construction of modern rule of law started late, the traditional thought of non rule of law deeply affected, so it has its own shortcomings in the production of good law and the implementation of good law; The production of good law mainly performance the rights of the cognitive community is strong while, individuality is weak. The formality of the legal structure is strong while the substantiality of it is weak. In the implementation of good law, the androgyny of the restriction of rights is strong while the allogeneic nature of the restriction of rights is weak. The passivity of fully law-abiding of good law is strong while the initative of it is week.

Abstract:This article investigates the Confucian and Western traditions specifically with regard to the relation between morality, law and good administration. It is argued that the common opposition between the rule of man and the rule of law as reflecting the basic difference between the two traditions is inadequate. Confucianism can be better characterized positively as the rule of morality. It should also be noticed that the rule of law' is increasingly being introduced into the Chinese administration. Similarly, even though the Western tradition can be summarized in terms of the rule of law, it is acknowledged that the rule of man' cannot be avoided, and that morality is important. Both traditions oppose the rule of man, in as far as it refers to someone acting out his selfish preferences. It is concluded that good administration requires officials with both good morality and respect for the law; whether this is a kind of convergence is a matter of debate. Points for practitioners This article studies Confucian and Western administrative traditions in relation to the notion of good administration. It is argued that the common characterization and understanding of the Confucian tradition in terms of the Western reviled rule of man' is misguided. Rather than understanding the positive moral connotations of the Confucian good administrator it associates them with a specific negative notion; at the same time, overstressing the Western rule of law' may obscure the need for moral persons for good administration.

Abstract:At a time when the world is undergoing profound changes unseen in a century, Xi Jinping’s Ideology on the Rule of Law has been formed as a major theoretical achievement in order to build a modern socialist country governed by the rule of law and a new form of Chinese-style modern human civilization. The Marxist rule of law theory is the theoretical origin of Xi Jinping’s Ideology on the Rule of Law. The traditional philosophical thoughts of Confucianism and Legalism in traditional Chinese legal culture, as well as the accumulation of legal practice and excellent cultural traditions of ancient Chinese dynasties have created the cultural roots of Xi Jinping’s Ideology on the Rule of Law. The Communist Party of China’s more than one hundred years of exploration in leading the construction of the rule of law has laid a practical foundation for it. The organic unity of “people first” and “rule of law” thinking in Xi Jinping’s Ideology on the Rule of Law demonstrates the theoretical background, the Marxist view of human rights, the view of the rule of law and the “two combinations”. The integrated combination highlights the theoretical penetration of Xi Jinping’s Ideology on the Rule of Law. Abstract:The concept of the rule of/by law is one of the most important political concepts in 20 th century China. From the Constitution-amending movement of late Qing Dynasty in the early 20 th century, to the Reform and Opening in the end of the century,this concept had always played an important role. Like many political concepts in 20 th century China,the meaning of this word was ambiguous,and it had different or opposite meaning in different users. The wide spread of this word in China lately dose not begin with the time of Reform and Opening,but begins with the movement of Examining Confucianism in the late stage of the Cultural Revolution. Inthe context of that time,the concept of rule of/by law was used to refer to the Legilist thought,and was highly praised. With the great influence of Liang Ch’in-ch’ao,it has been widely accepted during the period of the Republic of China that the concept of rule of/by law referred to or was equivalent to the Legilist thought. Although Liang(and Hu Shih,Xiong Shili,Hsiao Kung-chuan,Ho Lin,etc which followed him) made deeper research on the complicated relationship between the modern idea of rule of law and ancient Legilist thought, with the great influence of modern nationalism and historicism,the Legilist thought became the basso continuo of the concept of rule of/by law in China in 20 th century to a great extent.

Abstract:The law means the order.The religion means the faith.Without law,the mankind can't support social order.Without the faith,the mankind can't face the future world.At all cultures,there is the interaction between the law value and the religion value,there is the mutually influence between the religious divine nature and the law logos.The history tracks of dialectical interactive movement between the western religious divine nature and the law logos:Combine,Conflict and Harmony.At ancient times,the western religious divine nature and the law logos usually combine together.The law logos is the expandedness of the religious divine nature.At the last Middle Ages,the religious divine nature has been come into conflict with the law logos continuously,the law logos has been separeted from the religious divine nature.However,the long-term abruption made the occidental sank into the unprecedented spirit crisis,the western religious divine nature and the law logos had to introject again,and arrived at the new harmony.The harmony can vindicate the social order and realize the social justice and push the rule of law.The history track of dialectical interactive movement between the western religious divine nature and the law logos may be used for regerence in the rule of law in contemporary China: the rule of law in China must not only carry on the system construction but also rebuild the whole political culture and the law culture to obtain good result.

Abstract:The article studies political and legal thought in Ancient China. Ancient Chinese thinkers in their works reflected their approaches to understanding law. Shang Yang in "Shang jun shu" ("The Book of the Ruler of the Shang Region") considers the law as the only regulator of social relations. Legalists equate the concept of law and law, law is considered as a set of rules of conduct emanating from the state and protected by it, which corresponds to the normative concept of legal understanding. Another version of legal understanding was developed by representatives of Taoism. Lao Tzu in his work “Tao Te Ching” (“The Book of the Way and Grace”) paid special attention to the exposition of his teaching about Tao as the highest law of the development of the universe, nature, society and man. Tao acts as a natural law of immediate, direct action. Taoists are supporters of the natural law concept. In Confucius' work "Lun Yu" ("Conversations and Judgments"), the main regulator of social relations is not the Tao or the law, but the norms of ritual li. The right is not reduced to the law, but is considered as a set of legal relations, and the legal order that develops on the basis of them. Legal understanding of Confucius can be attributed to the sociological concept. In the work of Xun Tzu, there are attempts to bring together the Confucian rules of the ritual "li" and the Legalist law "fa". A new, orthodox Confucianism is emerging, which no longer completely denies the law, but advocates management both on the basis of li and on the basis of fa, with the dominant role of li. In China, a new type of legal understanding is emerging - integrative or synthetic. The article concludes that within the framework of the political and legal thought of Ancient China, there were various approaches to understanding law. After the proclamation in II BC. updated Confucianism with the official ideology of China, the integrative type of legal understanding becomes dominant, both in theory and in law enforcement practice.

Abstract:The idea of Zhong Zhi He(holding the middle so as to achieve is an important ideological resource for the construction of a harmonious society.He implies the harmonization of different sounds to generate beautiful music.When men realizes the principle that harmony is conducive to the generation of all things;uniformity will stop the development, they would apply this principle to the field of cognition,law,politics,ethics,and aesthetics to coordinate forces of different interest groups so that the goal of Da He(big harmony) could be achieved.The original seal character for Zhong(the middle) was in the form of a royal flag,denoting the middle way of the law.Later it began to mean the ethic righteousness and the uprightness of personality.Zhi Zhong Zhi He thus implies that the rulers should be righteous and upright so that they could position different forces appropriately with the right law.Zhi Zhong(holding the middle) is a principle for the ruler.Those who help the ruler to realize his aim of achieving harmony,however,might ingratiate themselves with the ruler once they become members of the bureaucracy and disrupt the stability of the ruling power and the constraint of rationality,resulting in social turmoil.After a long cycle of turbulent history, the mass overthrew the monarchy in the democratic revolution.Today when we make use of the idea of Zhong Zhi He to construct a harmonious society,we must trace the origin of this principle so that we could avoid its historical limitations and revitalize its power.
