Analysis about the Core Value of Chinese Business Law:Logic Expansion and Practical Application

Abstract:The major causes of the plight of law application in Chinese business judicial practice include the lack of the general rule and the mistiness of business law's core value by the carrier of the general rule. To guide the theoretical research of Chinese business law and practical activities such as legislation and justice of business definitely, it is necessary to research systematically the logic expansion and practical application of the core value of Chinese business law. The core value of business law had been generally defined as efficiency or benefit. However, with the purpose of radically reform, it should be defined as freedom which manifests in strengthening the autonomy of private law and the freedom of operation. The boundary of freedom value in the business law should be based on the order value. In the activities of legislation, regulation and trial of business, the balance of freedom and order should be based on to make the core value of business law to be applied reasonably.
