Abstract:The Tomb is a special kind of building that connects the social relationships between the dead and the living in the countryside.It's a kind of special housing land which belongs to the rural collective construction land in law.As an important place for the daily religious life of farmers,it`s also crucial to maintaining the social solidarity and "culture nexus" of the countryside.At the same time,it's an important social welfare for the farmers.Essentially,the movement of destroying cemeteries in Henan Povince is a kind of Land capital operation,which is subjected to the land policy of the state and the developing models of the local.It misunderstands the legal social nature of the cemeteries and ignores the important social function of them.As a result,it damages the land rights of farmers a lot.In order to preventing it from happening again,the land policy and the land law should be improved.
