Abstract:For a long time, on the studies of land people always considered land as a flat object, but neglected the existence of three-dimensional space that consists of surface, ground and underground. However, from the perspective of vertical land use, "space" is contained in the broad concept of land. With the development of social productive force and science and technology, population growth and increasing urbanization process, land use of three-dimensional space has become possible and necessary. Now the land use of three-dimensional has become the general trend of the world. Many foreign countries establish a legal system of land space right in the Civil Code, or through a special law, or by judicial precedents. In China, although the phenomenon of land space use has been very general and the Property Rights Law has been promulgated, but relevant legislation are not perfect. So, based on foreign space land right legislation practice and the development of China's Property Law, this paper studies the right of surface, ground, and undergroundt, hoping to be helpful to the related leg is lation and practice.
