Abstract:The initial verdict of XU Ting case is a judgment of strict legalism.The reason that it evolves into a public event is the joint attacks of some lawyers,scholars and the public.The retrial verdict applies the special mitigation system which is stipulated in clause 63 of Criminal Law of China and reduces the initial sentence of life imprisonment to five years imprisonment,with the same facts and same crime which is affirmed in the initial verdict.Although the retrial verdict meets the expectations of the public,it has damaged judicial authority immeasurably.Besides,it shows the terrible consequence of untied discretion power.In fact,the crux of the case does not lie in judiciary,but in legislation.Therefore,the special mitigation system can not provide us a feasible scheme for solving the cases alike.Only by establishing regular constitutional review can we completely solve the problem of judicial injustice which derives form legislation injustice.

Abstract:The imperial examination system in history was not so dark as what it is thought of by the modern people. Therefore, it is necessary to reappraise this system because of the incomplete and non-objective understanding and knowledge of it in the past. The prejudice today comes from the negative attitude towards it prevailing in the late Qinng Dynasty. In fact, many famous scholars in history, from the Sui and Tang Dynasties to the Ming and Qing Dynasties, praised this system, and many of them regarded this system as "the most fair" one. To redress this system has already become an ideological trend in the contemporary Chinese academia. A study of this system is beneficial for our better understanding of the characteristics of Chinese society and the destiny of Chinese traditional culture. At the same time, we can draw a historical lesson from it for the present examination reform.

Abstract:Fairness in college entrance examination is the fairness based on examination achievements; efficiency means following no set form to select excellent talents based on an overall consideration of various factors. The group who favors efficiency thinks the college entrance examination institution should be reformed completely when it＇ s the time to pay more attention to efficiency instead of fairness intentionally. The other group who supports fairness considers selecting talents fairly is the uppermost concern which the masses draw much attention to, and it＇s also the elementary function and spirit of college entrance exami- nation institution. Multi-admission should obey the rule of fair and square, to avoid money and power＇s interference into admission. Nowadays fairness should be given priority to, and in the future fairness and efficiency should be given equal consideration.
African Americans and the Making of Post-Civil War Constitutional Order

Abstract:The paper offers an analytic narrative of the intellectual and political struggles carried out by African Americans during the Civil War and Reconstruction era for gaining equal voting rights. The paper argues that, although no African American representatives had directly involved in the making of Reconstruction laws prior to 1870, a novel political discourse of transformative constitutionalism had been created by such African American leaders as Frederick Douglass and others, who had first foreseen the great potential and opportunity for constitutional transformation as brought by the Civil War. The so-called "African American constitutionalism", built upon the combination of the American constitutional tradition and the political imagination as inspired by blacksact of self-emancipation during the wartime, provided important intellectual and legal support for the Republican lawmakers in Reconstruction Congress. The paper intends to challenge the conventional Reconstruction study that generally neglects blacks'role in constitutional reconstruction process, as well as to explore the possibility to incorporate into constitutional history such fields of African American studies, social history and intellectual history.

Abstract:The Voting Rights Act has been widely hailed as one of the most successful pieces of civil rights legislation in the country’s history. It is our most significant shared national commitment to equal electoral participation and equitable political diversity, based in part on history that allows us to recognize that we all suffer when such a commitment is absent. In 2006, Congress voted overwhelmingly, and in bipartisan fashion, to reauthorize and update the Voting Rights Act. There had been undeniable and positive progress since 1965, but that progress existed in part due to the very protections that the Voting Rights Act offered, which were necessary to preserve equal opportunity. Those protections have since been degraded by the courts – particularly, but not exclusively, by Shelby County v. Holder. That same Court also issued Congress an express invitation to rectify the matter. The continued update of effective measures to prevent discrimination in the franchise are regrettably, and no less undeniably, necessary today.This testimony reviews the continuing need to restore the Voting Rights Act, explaining why election harms are distinct from other civil rights harms, and require distinct treatment. It analyzes the aftermath of the Shelby County decision, and the particular ways in which Shelby County, and a few follow-on cases in Texas, have left the electoral system dangerously vulnerable to discrimination. And it canvasses the legal authority delineating Congress’s constitutional ability to pass restorative legislation responding to this threat.

Abstract:In a certain sense,imperial examination(IE) was college entrance examination(CEE) in ancient China while CEE is IE in modern China.The tradition of IE pursuing fairness in terms of not only scholarship but also equal opportunity across regions has an impact on the regional distribution of modern universities and the practice of enrolment based on provincial quota and scoring classifications.It is argued that in the process of reform and improvement of CEE we should draw upon IE measures which had proved effective in preventing cheating and IE management practices with a view to strengthening current legislation for examination.The study of IE has important implications because it can provide valuable lessons and theoretical references for the current campaign of CEE reform.

Abstract:In Shelby County v. Holder (2013), the Supreme Court struck down a core provision of the Voting Rights Act (VRA) that enabled federal electoral oversight in select jurisdictions. We study whether this decision disproportionately impacted ballot access for Black and Hispanic registered voters. We use a rich dataset on voter behavior for the universe of registered voters combined with Census block-level sociodemographic attributes to document a decrease in turnout for Black, relative to white, individuals. We observe suggestive but less robust evidence of decreases in Hispanic turnout. These effects are concentrated in counties with larger Black and Hispanic populations, consistent with strategic targeting of voter suppression.

Abstract:Educational inequality is caused by regional economic differences, educational resource allocation differences, class differences, and other factors. The concept of equal rights in education is an extension of equal rights in education’s political and economic fields. It refers to an important element of democratization of education, in which people are not restricted by political economy, culture, ethnicity, faith, gender, and geography. In law, people have the same right to education and have the same access to education. Conversely, education inequality still exists, and people suffer from certain discrimination or unfair treatment in education. Despite the rapid economic development in the world in recent years and the obvious progress in education investment and development, inequality in education is still widespread. This paper briefly examines educational inequality in four areas: the differences in education and the pursuit of equality between blacks and whites in American education; the educational problems and social reproduction of children in rural China; the influence of black students in the pursuit of educational equality and the influence of assimilation education; and also gender inequality in the field of education in rural China. Based on the principle of pragmatism, this paper attempts to seek the real reasons and substance behind the phenomenon through the current educational inequality situation to discover the factors that lead to educational inequality.

Abstract:Abstract Compulsory schooling laws are commonly believed to be effective measures in ensuring individuals benefit from education. However, their implications for racial equality are less-apparent. Exploiting timing and geographic variation in legislation reforms among Southern U.S. states, this study evaluates the differential impact of minimum school-leaving age requirements on short- and long-term labor market outcomes between Black and White men. Results show that each additional year of compulsory schooling produces about 7.3–8.2% increase in adulthood weekly income. While there exists a substantial gap in returns to education between Black and White men at early career stages, this gap is reduced by 37 percentage points at mid-late career. Findings imply that mandating compulsory school attendance motivates both Black and White men to stay in school longer, and thus reducing racial gaps in returns to education.

Abstract:The Transatlantic Slave trade began during the 15th century when Portugal and subsequently other European kingdoms were able to expand overseas and reach Africa. The Portuguese first began to kidnap people from the West Coast of Africa and took those that they enslaved to Europe. This saw a lot of African men and women transported to Europe and America to work on the huge plantations that the Whites owned. The transportation of these Africans exposed them to inhumane treatments which they faced even upon the arrival at their various destinations. The emancipation Proclamation signed on 1st January 1863 by the United States President Abraham Lincoln saw a legal stop to slave trade. However, the African Americans that had been taken to the United States and settled especially in the Southern region faced discrimination, segregation, violence and were denied civil rights through segregation laws such as the Jim Crow laws and lynching, based on the color of their skin. This forced them especially those that had acquired an education to rise up and speak against this treatment. They formed Civil Rights Movements to advocate for Black rights and equal treatment. These protracted movements, despite continued violence on Blacks, Culminated in Barack Obama being elected the first African American President of the United States of America. To cement the victory, he won a second term, which Donald Trump failed to obtain. This paper sought to critic the philosophies of Booker T. Washington in his civil rights movement, particularly his ideologies of integration, self-help, racial solidarity and accommodation as expressed in his speech, “the Atlanta Compromise,” and the impact this had on the political and civil rights arena for African Americans.
